    • when did they (who) inform you there was a 'police case' and when was this attained? i will guess the debt is now SB'd as it's UAE 15yrs. have you informed the bsnk ever by email/letter of your correct and current address? you can always ignore anyone else accept the bank,  Block and bounce back all emails. Block any text messages  Ignore any letters unless it's: - a Statutory Demand - a Letter Of Claim - a Court Claimform via Northants bulk.  
    • I left Dubai 8 years ago and intended to return. However a job prospect fell through. I’d been there for 15 years. I decided to pay my credit card and the bank had frozen my account. There is no means to pay the CC so completely unable to pay when I wanted to other than the bank advising me to ask a friend in the UAE to pay it on my behalf!  fast forward bank informs there is a police case against me for non payment. Years later IDR chased me and after months/ years they stopped. Now Judge & Priestley are trying their luck. Now I have received an email in English and Arabic from JP saying the bank has authorised them to collect debts. Is this the same as IDR although I didn’t receive anything like this from them. Just says they are authorised?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

When anyone asks a question on this or any other site they take a risk:

 

a) The risk that there isn't anyone available who knows the answer.

 

b) The risk that the person commenting may not know what they are talking about, even though they might sound convincing.

 

c) The risk that no-one will answer the post in time for the info to be helpful.

 

tt offers a shortcut - but like any other person who offers a service she is entitled to charge for it.

 

As for £1 a minute being scandalous, what about the fees solicitors charge? and I'm not talking about legal aid rates.

Unless you are lucky, you don't always get the right advice or information - I know, I've been ripped off by solicitors who pretended to know what they were doing and didn't, and there is nothing you can do about it afterwards except pay them, or face the bailiffs they'll send.

So as not to offend the delicate sensibilities of anyone who may read this post, may I gently and respectfully suggest that this is unlikely to be the final post from either yourself or tomtubby, I've seen threads like these rumble on for months.

 

 

Given their is no way of contacting this company other than via the 0906 number or paying another £10 fee to ask another question....my thoughts were, you have tried for along period to contact them on the phone and not been able to do so.... you have no office address or alternative number...or email address...your only option is to pay another £10 to ask about this problem....well they could have offered alternative means of contact in the event of any problem with their reply or accessing the areas of the site "the password" allows....unfortunately none of these options are available.... and thought perhaps there is something not quite right.... Trading Standards was the only official body I could think of who would be able to carry out an enquiry.....

 

 

Without wishing to cause you or anyone reading/moderating this thread any offence, you have been on this site since November 08, and in that thread you were in contact with tomtubby, you could just have easily posted the question "Does anyone know anything about B....A....Online".

 

Posting the title "BEWARE....." is appears to be suggesting that you know for sure it is a website to be distrusted, and that is potentially damaging and may have caused tomtubby some loss.

That's not fair to the site-owner, who is ultimately responsible for everything that is posted and that's why we try not to make such statements publicly or say anything potentially damaging about any company or person, unless it is obviously fair comment.

 

I am now sorry for making that offer, as the post being made by me on their behalf may well prevent me from getting advice in future....

 

Jacqui that truly is offensive and unfair to the regular posters on this site who are not so small minded.

I think most regulars on this site would agree that the title of this post could have been chosen more thoughtfully and the position you've taken over ten quid a bit OTT; IMHO it makes you look as if you've been a bit trigger happy on this occasion.

 

But that doesn't mean that anyone here would be so malicious as to deny you or anyone else information that might help reduce your (or their) distress.

 

It was very decent of you to offer to help people who don't have an internet connection, there is no reason why you should stop doing that.

 

 

The reason for stating previously that no further post would be made, was due to others attempting to hi-jack this thread or post for their own agenda...

 

No-one that has posted appears to me to have attempted to do that.

 

I suspect you may be referring to the posts made by myself and Letsmakeamark and deleted by Jonni2bad.

 

So it's important that you understand that:-

Neither of us was making a personal attack upon you - I wouldn't do that.

Neither of us was attempting to hijack this thread - however they were read.

 

I hope that everyone involved in this thread has learnt something useful from this miserable and unnecessary affair.

 

 

Remember - we are actually trying to help each other here :grin:
