    • The address is only a paper address with no actual manned staff address. Police have rang me this morning and taken some more information including the details of the driver who they say they will contact and interview.  They are also putting in a formal request to Shiply to get the couriers driving license and biometric information held on file. IF anyone else has been in the same position with this particular courier, please please let me know and we can perhaps go down the strength in numbers route xx

    • Morning dx and thank you for your message.   With regards to your comment about them not needing to produce the deed, the additional directions ordered by the judge included 'a copy of any assignment o the debt or agreement relied upon'  so that is why I thought that point was relevant?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

 

I am new to the site but have a couple of issues that I thought I would discuss.

 

I stupidly purchased a loan from Welcome in June of this year, I know my credit score is not the best but I have not previously struggled with debt. My payments are scheduled for the end of every month, however, towards the end of November it was becoming clear that I was not going to be able to make a payment and so I made contact with my local branch to arrange an alternative payment date.

 

The first time I rang the woman who I spoke to seemed like she was able to help, but advised me that her computer system had gone down and she would have to give me a call back in the next 20 minutes. I heard nothing so rang back shortly after but there was no answer. I figured that as it was the end of the day, she probably just wanted to get home.

 

I rang up the next day and the person who I spoke to said they were unable to give payment breaks. I made them aware that the payment for November would not be paid until mid December when I next received some money. This I thought was noted.

 

Over the past couple of weeks I have been receiving phone calls from Welcome, the first of which I missed due to being at work. However, a message was left asking if I was interested in topping up my account in time for Christmas and if so to contact them. Obviously I was not interested. I then received a letter at the end of last week asking if they could tempt me with topping up my account. Again I was not interested.

 

Tonight I have received a phone call again but I chose to ignore it as I thought I am not interested in topping up my account. However, this time it isn't asking for me to top up my account but to make a payment on the overdue amount that I contacted them about 2 weeks ago.

 

The person who I spoke to is adamant that the phone calls they have been making have been chasing payment and that I will be charged for these, she has even spoken to my mum about my account saying that this is a serious matter and that I only had 15 minutes to get in touch with them before it became a police matter. Apparently, if I miss a payment in the first four months of taking out a loan with them it is classed as fraud?

 

This is the first time I have missed a payment and I made them aware of this.

 

The woman who I spoke to made no security checks on my account so I could have been anyone, and she kept referring to me as darling. Now I told her that I made an arrangement to pay this on the 19th Dec, but she wanted to take my details there and then. I told her I would contact them on Friday as arranged and make payment.

 

I realise that payments should be made on time, but she discussed my account with a third party and had she been a little bit more professional on the phone I would not have had a problem.

 

I am aware that I will now be charged for the phone call she made, but the previous phone calls were made to offer funds on my account and therefore I am reluctant to pay anything more than the agreed monthly payment. I have a record of the voice mail I received that if she does insist on involving the police I will be more than happy to share.

 

If people have any comments, they would be much appreciated, sorry for the long post.
