      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I am currently suspended from work pending an investigation. The only thing I can think of is that I will get charged with harassment / bullying.

 

My question is: can anyone give some examples of harassment / bullying and what sanctions were imposed?

PS for the record, I haven't knowingly done anything, so hopefully the investigation will draw a blank

to be fair, harassment/bullying is in the eye of the beholder, for xample you can do something pretty normal, but if someone takes a dislike to you they can use it against you.

 

i was once put on a warning at a place where i worked because i had a falling out with a female member of staff.

basically, i caught her simulating oral sex with a wine bottle within full view of some customers in hotel i worked ins bar, i told her to stop it and she did, but she then later went and made a complaint to the hotel manager, stating that i had made several crude suggestions to her.

 

in my defence i asked the hotel manager to view the security camera footage from the night in question, he refused to do so, stating that "the person in question has no reason to lie and is young and naive and would certainly not know about some of the things she had repeated to him".

 

i wrote my resignation on the spot and walked out, then got a payout for constructive dismissal.

Bullying behaviour

 

What is Bullying?

 

Bullying is intimidating, threatening or humiliating treatment of an individual (usually someone at the same or more junior level). It might include:

 

Aggressive/ excessive unjustified criticism of performance

Whispering or gossiping campaigns

picking on or ostracising a colleague

shouting

Repeatedly putting unreasonable pressure on subordinates, such as imposing unrealistic deadlines

yeah, the above is true, but like i said, harassment/bullying is in the eye of the beholder.

 

like in my personal example, i reprimanded a junior staff member for indecent behavior, and in return i recieved a warning for unsubstanciated indecent behavior, which thankfully i was later able to disprove and i recieved a payout for.

 

bullying/harassment is never right, but the only problem is its a bit of a grey area, especially if you cant back a defence up with facts.

Yes, I worked many years ago with a little man, like a midget, and some others used to kick him up the bum for a laugh.

 

That is a bullying classification.

 

No sanctions, bosses did it too.

if you have formally been suspended from work - pending an investigation

 

you should have received written notification of this, and have been told of the grounds of which the suspension was, and how long for

 

You will need to be called into a investigatory hearing you should be given at least 24 hours notice, be provided with representation, work colleauge or union rep - you should have had written notification of the reason prior to attending this hearing - rules of natural justice

 

so you have a contract / staff handbook - details will be there

 

as previously said bullying takes many forms and "the list is not exhaustive" - it depends on the circumstances and the allegation

No, and bosses shouldn't take part in this kind of behaviour but thats what a building site is like, in the 70s anyway.

 

I like midgets, they are just the same as everyone else but not so big.

 

And they shouldn't be fired out of canon either for entertainment.
