    • Hi everyone,  There were many topics on this issue in the past. May I please have an update if anyone managed to buy or sell the house with the leasehold air space on it? would the bank lend the mortgage?  If I was not informed about the complications when selling the house. instead, they told me that this would add value to the house and sell faster which is the opposite. Can I file the case and dispute it for mis-sold and misrepresentation?  I am in the year 9th and I was not aware of the issue until I wanted to sell my house. There has been no communication since I signed the contract. The company has never contacted or updated me on how much energy the panels generated how much I used etc.    This is a free panel from the government schemes, run by  Freetricity.   Thank you

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi

 

I am newly registered so this is my first post........go easy on me! :)

 

Im in a spot of bother and im a bit confused what to do.

 

Basically, I have just returned from being on holiday to find 3(!!) UKPC parking tickets on my car to the cost of £170 EACH........so £520 total, or half the cost if I pay within 14 days!!! I am yet to receive the letter from UKPC but expect it to arrive next week.

 

The car was parked outside a friends house in north london for a week as he didnt think there were any parking restrictions in his area. The car was parked on a road (directly outside the friends house) with no yellow lines or anything, within a large residential estate, which you have to enter through a large gate. On further examination on my return from holiday there is a UKPC notice explaining that a permit is required to park ....but it clearly wasnt very obvious, as I didnt see it when entering the estate.

 

I had not left my carkeys with the friend, and therefore there was no way he could move the car when I received the first ticket. He did however leave a note on the car explaining that the car was parked with the permission of the houseowner and that it was not possible to move the car as I was out of the country until a few days later. However this did not help as I received 2 further tickets within the following couple of days.

 

Initially, my plan was to ring them and to agree to pay the first fine but appeal the following 2, as to me it appears that they are simply profiteering.......if i had been within the country then obviously i would have moved the car before receiving the 2nd two fines. But now having seen this site i am not sure what to do........i can see a lot of advice saying that not responding to the UKPC is the best option, but alot of this is in response to people parking on 'private' land like carparks etc - Is this still the same case for me on a residential estate?

 

Any advice would be hugely appreciated as if I have to pay the fines it would have doubled the price of my holiday! :(

It's a good job you received another 2 INVOICES then after the first or you may have been tempted to pay it straight off.

 

Remember that private companies cannot FINE you so these are not PCN fines, simply invoices for parking that you didn't agree to pay.

 

The ignore route seems to be the favoured one generally. I am awaiting a letter to RK from a company who put an invoice on my car about 10 weeks ago so it can be a slow process it seems. Not sure if I am going to use the template letters or the ignore route myself yet.

Of course they're profiteering! There is no 'appeals process'. Your 'fines' won't be cancelled, but then they don't need to be. They are unenforceable tosh.

 

You know the score - do not contact them and do not pay.

It would be interesting to know who gave them "permission" to operate on that Estate, or who's permission UKPC think that they have?

wait for the RK to get a letter (or three) from UKPC. they will have used form V888/2 and paid 2.50 per request made to the DVLA. Have a look at the V888/2 form on the DVLA website. you can and should request ALL the background evidence you are entitled to. This will include the Data Protection register entry number, the full postal address of the requestor (not just a post code), and evidence of the contract and so the name of the 'third party'.
