      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Morning...

 

I find myself posting more and more on this site everytime something jumps up and bites me from past experiences :)

 

About 4 years ago I took out a "deal" via The Link for a contract on O2, if I remeber rightly it was for a Samsung D410 and it was £25 a month (I had to pay a £50 deposit for it too).

 

Unfortunately I had the handset stolen and reported it immeadiately to the Police and O2. Upon making a claim for the handset I was told that it was not insured (this was not mentioned when I brought the contract, £25 a month and no mention of any extra for insurance) and made a complaint to The Link in regards to the fact I had not been told etc.. "deaf ears and excuses followed" I'd paid £50 deposit so I would not have not insuraned the phone, I arent silly :)

 

Now O2 sent me out a new sim which I could not use as my replacement handset was sim-locked to Vodafone, my old dear brought me a new handset for my b'day as mine has been nicked :)

 

I was recently contacted by 3 / 4 companies (Red / Lowell and Hamptons Legal) for a debt owed to o2 for near on £600 :eek: I contacted o2 and all they could say to me was "the debt as been sold" and I need to discuss it with the other company.... I am now paying £20 a month just to keep these people off my case and to stop the "threatening" letters that they send out.

 

Im cheesed cause The Link is now non-existant so I cant take the issue up with them and Lowell just want it paying!

 

Any advice would be greatly appreciated ;)

I beleive that if I end the contract early, which I did due to not having a handset for the sim, then I would be liable for the remaining term of the contract BUT 12 x £25 doesnt add upto £600 by my sums....

 

I think my best step would be to contact Lowell and ask them for a copy of my signed agreement?! I have had a look around the site but the templates I have stumbled across are mostly for SAR's letters etc.

 

Could anybody point me in the direction of the aforementioned CCA request letter?

I dont spose they will be too helpful, BUT showing these compaines I am no pushover should leave me in good stead :)

 

Already told Lowell not to harass me and told them they are breaking regulations etc... I got a "written" apology off some manager type person and the removal of my telephone numbers from their database so... ;)

 

Now time for a CCA request I think :D

I sent the following to The DSG Group last night (via email)...

 

Good Evening,

I am hoping that somebody could offer some assistance,

I took out a mobile phone contract with O2 via The Link (Newcastle Under Lyme Branch) sometime in July / August 2004. I am now in a position where I am receiving “demanding letters” from a company called “Lowell Financial” in regards to a debt of approx £600.

To cut a long story short, when I took out the contract I was informed it was £25p/m and had to pay a deposit to O2 for £50. Insurance on the handset was not mentioned and I presumed that this was included in the package I was sold, it turned out that this was not the case.

I had my handset stolen in September 2004 and immediately reported it to both the Police and also O2. I made contact with O2 in regards to a replacement handset to be told that I was not insured, O2 supplied me with a replacement Sim Card but without a handset it was no use. At the time I made a telephone call to the branch that sold me the contract (Newcastle U Lyme) and expressed my concern that Insurance was not supplied, and I was informed that the incident would be investigated and somebody would be in contact to discuss, I never heard anything so assumed that the matter was closed and sorted.

I have spent the last 3 / 4months trying to establish exactly what position I am in, legally in regards to the “debt” and have found myself paying Lowell £20 p/month to stop them threatening court action etc…

Obviously I understand that The Link no longer exists but am adamant that if procedures had been carried out correctly at the time of me purchasing the handset, I would not find myself in this predicament.

Please be aware that I will be contacting the OFT and also Trading Standards in regards to this matter and will also be seeking legal advice to ensure that the matter is dealt with amicably and efficiently.

Ill get on to printing and posting my SAR tomorrow, just a bit worried that Lowell's will scrap the agreement we have if I start to rock the boat :confused:

 

But then again, its worth a try to get the "debt" shrunk so I can get it paid and finally become "Debt Free :D"

Apologies in my lack of response.... the thread got lost amungst the other threads :-)

 

Suprisingly I did not receive a response from DSG, until I actually emailed the Chief Exec direct (its amazing what you can find via google isnt it :))

 

Anyway the reply basically advised me to contact o2 to discuss the matter (which I have done) so no real luck there Im afraid.

 

I am just looking into finding a letter or some type of something to send to Lowells to say "Prove it".

 

The last thing I want to do though is to just stop payments, I am trying desperately to get my Credit File cleaned up and do not fancy another default against me, if for any particular reason Lowells cannot supply the information I will request, then I will stop payments until they can!

Im hoping that the issue is now sorted and Lowells / Red & Hamptons Legal will leave me alone...

 

Finally got the Default removed (which they kindly added) and am awaiting receipt of a refund of monies paid :)

 

My advice to people who are trying to get themselves on a even keel.... keep on at it, youll get there in the end :D
