      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I love winding up DCA's on the phone. It's become a hobby these days.

 

Had the muppets from Halifax ringinging me 3 times every weekend for months now. Dispite 3 letters with the following written in bold type.

"I will communicate with you in writing only. I will never speak to you on the phone, as I have no legal obligation to do so."

 

The last conversation went a little like this.....

 

Halifax muppet: Hello is that Mr F Bobble?

 

Me: Yes it is. Who's calling please?

 

Halifax Muppet: Jason From Halifax. I need to discuss a matter

regarding your account as it's in serious arrears.

I need to ask some securtity questions before I can continue.

What is your date of Birth and the First line of your address?

 

Me: 1/2/1991 69 cunnilingus lane. (of course I live there) :razz:

 

Halifax Muppet: Those don't match the details I have here sir.

 

Me: So why ask me if you already know them?

 

Halifax Muppet: It's for security reasons sir

 

Me: (pretending to cry) But I don't know my date of birth as I'm an orphan and was left on a doorstep when I was a baby.

 

Halifax Muppet: You're not taking this seriously sir. £2000 of debt is a serious matter and you will go to prison if you don't pay.

 

Me: (trying to sound concerned) oooooh. :eek:

 

Halifax Muppet:So, Mr Bobble, how to you intend to pay this debt?

 

Me: What debt?

 

Halifax Muppet:The £2000 you owe on your credit card you have £200 arrears and no payment has been made for 3 months.

 

Me: I asked you for proof you are legally intitled to collect this alleged debt. I'm still waiting. I don't pay anything to just anyone who writes demanding money without proof that I actually owe them anything first.

 

Halifax Muppet: This conversation is being recorded and I think you are deliberately being akward and trying to avoid paying what you owe Mr Bobble.

 

Me: I'm being recorded?

 

Halifax Muppet:Yes, now how do you intend to pay? We require a minimum payment of £200 immediatly.

 

Me: Wow. I'm being recorded. Sings a few lines of Bros - I owe you nothing. (bad I know but was all I could think of at the time.)

 

Halifax Muppet: You're not taking this seriously sir.

 

Me: I am. What was the question again?

 

Halifax Muppet: How do you intend to pay?

 

Me: Pay what?

 

Halifax Muppet: (getting a bit peed off by now) The arrears on your credit card.

 

Me: What credit card?

 

Halifax Muppet: The card you are 200 in arrears with.

 

Me: Erm

 

Halifax Muppet: Erm what?

 

Me: I don't know.

 

Halifax Muppet: Do you want us to take you to court?

 

Me: Courts? Didn't they go bust a few years ago? Weren't they the ones who had Bruce Forsyth in their adverts?

I'd like to go, but I had a new sofa a few weeks ago, so you're too late.

 

Halifax Muppet:You're not taking this seriously, I'm putting a note on your account that you are deliberatly avoiding to pay your debts.

 

Me: Debts? I'm in debt? That's scary, I wasn't aware I was in debt.

 

Halifax Muppet: (getting really wound up) Are you going to pay now Mr Bobble? I can accept payment by credit card now.

 

Halifax Muppet: Can I use the halifax card you claim I have and owe £2000 on?

 

Halifax Muppet: No, your card is suspended as you haven't kept up with the payments on it. AS YOU VERY WELL KNOW.

 

Me: know what? Who are you anyway?

 

Halifax Muppet: (rants away about debt and court action for a bit)

 

Me: I'm sorry I suffer from Attention Defecit Disorder and find it hard to concentrate.

 

Halifax Muppet: That's not my problem...Are you going to pay or not?

 

Me: .....Ohh look a bumble bee.....

 

Halifax Muppet: Mr Bobble?

 

Me: He's not here.

 

Muppet hangs up. Probably to bang his head against the wall. Then hand in his notice and get a proper job at Maccy D's.

 

Needless to say the more experienced members of the CAG will spot a few breaches of the OFT guidelines. Such as carrying on without the security checks, prison if I don't pay, trying to collect a debt that is in dispute and failing to comply with a cca request, etc.

Complaint letters have already been sent + a SAR request so I can get a copy of the call and put it on here. :D

My work colleagues think I'm even stranger than before cos I have just burst out laughing!! The 'bumble bee' bit got me in the end although I probably looked liked I was having a seizure due to silent laughing!! Brilliant!! Keep them coming. I almost wish I had a DCA phone me so I can use some of your lines!!

Complaint letter already on it's way to Trading Standards, OFT and FOS

regarding - Halifax, Abbey, Moorcroft, Capquest, and Eversheds

 

For my girlfriend complaints about Brighthouse, CK Edrupt, Hunter Forrest, Robinson Way & co, CDCS, Barclaycard/Mercers, Commercial Collection Services, LDC, Barclays Bank

 

Quite a list there, but all of them have been complained about for one or more breaches of OFT guidelines.

Awww LB you didn't get a chance to do the full script, funny though. The more daft calls the get, the less chance they get of suckering in an innocent person who hasn't discovered the CAG yet. Guess the DCA's are reading this thread and have got wise to things. I have to admit I had to call Moorcroft 3 times to get mine this time. Don't give up though. Been playing with moorcroft as you guys know. The new way of dealing with these [EDIT] is the way to go, but do the CCA request first. Had letter today from Moor[EDIT] admitting they can't provide a CCA (17 working days after I sent them the put up or shut up request. Now an alleged debt of £4300 has suddenly vanished in thin air.

 

Looks around to see where it went.....Ooh look a bumble bee.... lol

 

Another one to add to my sig file and another win for the good people of the consumer action group. Long may it last, and good luck to anyone fighting debts on here. You can win if you're prepared to put the effort into a few letters questioning what these people are doing.

see below for sig update. Off out celebrating, as the £10 in token payments DCA's would have got in token payments.... (if they hadn't defauted on the CCA requests)...I'm off to the pub with my mate for a few beers to celebrate. Will also be doing a toast to the CAG and the wonderful people here who helped not only me, but lots of others too.

 

Thanks everyone for your support.

When I get my bank charges back, me and my girlfriend will be making donations so this brilliant site can continue to help people in the future.

We would do now, but both struggling to make ends meet at the mo, but when we get the charges back, then the CAG is first on the list for a share of it. I hope others will do the same too. It's only fair to help the ones who helped us.

I don't owe anyone anything. They try to say I do,

but when they come up with the legal paperwork and send it

to me, then I'd admit it. Till then, it's up to them to prove I owe

them anything. Innocent til proven guilty.

 

You're right about the OFT though. Sometimes I think they're just

as bad as the DCA's themselves sometimes.

It's about time the whole consumer credit thing was

exposed and something done about it once and for all.

 

I also may get the hang of this internet thing one day too. :grin:

Probably BCW or some other bottom of the pond feeders.

You know for sure you have something unenforceable

when the bottom of the barrel DCA's get your account.

Just look on here for the ones chasing statute barred

debts to find out which DCA's.

If I had a pound for every hour of DCA muppets phone calls and security questions I'd wasted, I'd have enough for 6 pints.... (£18 if you live down south or £13-20 if you're a northerner like me.)....at my local pub or 12 litres of cheap n nasty cider (a.k.a. apple flavouring in sparkling tap water with more than a sprinkling of industrial alcohol added for fun.) at the local shop. (available at all good chavvy late shops). I know which one I'm going for tonight. :D

I won't regret it tomorrow morning, or will I be the one who's wasted for a change.

I wish I had an account with RW they sound like a lot of fun. Would make my day to ring one of them and ask how it felt that one of their workmates could be calling them 5 times a day in a few weeks time. :grin:

It also says RW had dissapointed results from portfolios they recently bought. Me wonders if a lot of the debts they bought were from CAG members? I have a feeling there will be a lot of DCA's over the next few years that will be down on the profits.

 

Can't wait till next month when the new CCA laws come into place. Time for lots and lots of complaints about DCA's. It will be a good day when we see a few credit licences been lost and hefty fines dished out. Time to spend a few £1 token payments on some champagne to celebrate. :grin:

The customers (aka evil debtors who must be hld to task at all costs) pay the phone bills.

 

Most DCA's use 0870 numbers when you call them and they make 5p a min. Soon mounts up when you get a few hundered calls a day.

 

Think Loyal Brummie has made them around £7 in calls so far. :wink:

I always add at the end "If you do not understand any part of this letter, you should consult a qualified solicitor" :p

 

I just sent that one to CK Edrupt lol

They claim to be solicitors, but I think my gingerbread man avatar knows more about the Consumer Credit Act 1974 than they ever will.

 

Great line though, and will be adding it to all my letters from now on.

LB is responsible for coffee stain on my laptop screen.

This was due to laughing at some of the stuff he write on here

and me spitting coffee everywhere.

I just had Eversheds on the phone tonight.

They suddenly decided to call me out of the blue yesterday. 6 calls in 3 hours lol.

Maybe it was my bog off you have no CCA letter I sent recently that woke them up to urgently want to threaten me.

 

The call went like this.....

 

Eversheds peep: Hello, this is suzie from Eversheds.

 

Me: Oh yes.

 

Eversheds peep: Is that Mr Fuzzy Bobble?

 

Me: Yes it is. How can I help you?

 

Eversheds peep: I need to discuss your account. Can you comfirm some security questions for me?

 

Me: That won't be possible.

 

Eversheds peep: Why not?

 

Me: I can't as I was killed in a car crash last week, so I'm unable to speak to you.

It's what you get when you rely on DCA's to help you find them.

 

If they don't know what a CCA is, then they have no chance

of finding a teatowel in a big pile of teatowels in a teatowel factory.
