    • Okay, I have read your claim form. A pity you didn't come to us earlier. You haven't pleaded any legal basis for your claim and you haven't cited the Contracts (Rights of Third Parties Act. How long have you been aware of this forum? We will have to bring that out later when you do your witness statement. Once again, do the reading very carefully. I suggest that you wait until Monday before coming back here and confirming that you have read everything. And in particular, as I have indicated, read the thread which I posted above very carefully and in particular we the details of the contractual terms which were discovered and get a copy for yourself. Post a link to them in this thread as well for other people to see. They are relying on the fact that you don't have a direct contract with them and they are referring to a contractual term which is apparently in the contract between them and Packlink which specifically excludes third parties. You will definitely want to see this. They have tried to rely on this before but they have never produced the contract. In your witness statement you will have to request that they produced the contract in court. In terms of the mediation, frankly we would have advised you to decline mediation. It's all done secretively. Nothing is ever revealed and of course they will try to get you to compromise on the amount of money you are claiming. We would strenuously suggest that you don't give up a single penny. Do the reading that I have suggested, find the details of the contract which I have told you about which accepts direct liability to you, the customer – and post it here.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Has anyone had one of these and what is the acceptance like.

 

I have just applied online and although it states instant decision, it said they are processing my application and will let me know within 7 days.

 

So they havent said yes but then again they havent said no!

Do you mean store or credit card?

 

In my experience, when they say they're thinking about it, they either will say no or hit you with a major APR hike, so where they say "typical APR 14 %", you'll end up with a 27-28%. Of course by then, you have had another credit search registered against your name. :mad:

Yes the store card.

 

I am moving house and need a few bits from argos so I thought I`d try and get them on credit as it is interest free if you pay within 6 months then right up to 27% :eek:

Computer always said no for me then I applied for a capital one card 4 months ago computer said we need to process more and I got a letter of acceptance 5 days later.

 

Are they usually strict when giving out these store cards?

Well you stand more of a chance than me. Capital one computer says maybe then a few days later I get a letter saying computer says no

Well I would say that they take a day or two in order to verify that the data to be added to the credit file is accurate before they add it.

 

Nope can't even keep a straight face typing that

Not sure if you're interested but Halifax have a new Classic card out which is for those building up a credit history (and less APR then Capital 1 .. but only just). I filled out the short application online and was immediately accepted and a credit limit given. The agreement arrived 2 days later ... :)

As far as I am concerned, store cards are a waste of your time and money, I will never take one out. In additiom to hgh interest charges they leave you open to junk mailshots, as they sell their address lists.

Its about 50/50 with regards to acceptance, its either been referred because of something like checking address against the electoral, requesting some form of proof of identity in which they will write to request, or a manual credit score.

Otherwise it means its been declined, will be manually checked before sending out a non acceptance letter.

I would generally suggest the latter of it being declined, but as an online app it could be the former.

The apr is 27.9% (Variable) and Argos are more likely to check with Experian (being both owned by GUS over a year ago)

Ex-Retail Manager who is happy to offer helpful advise in many consumer problems based on my retail experience. Any advise I do offer is my opinion and how I understand the law.

Strange ... I've checked my Experian & Equifax credit files online and there is no sign of a credit search as yet ... and as per my post above, they said I would hear in a couple of days ...:confused:

I have checked my file and they have done a search and are listed as home retail credit.

 

Which file did halifax classic card use to check you?

I dont want to apply if its experian as I dont want too many searches on my file.

Hi Pebs, I've checked my Experian file this morning and there isn't a credit search on there from Home Retail Credit. Maybe there was a problem with my application and they have to do it manually... :confused:

 

Halifax also used Experian. I was gobsmacked when I was approved online as due to a lack of credit history, it never usually happens :shock:

We applied for 1 of these before christmas to specifically buy a new oven. We chose pay off interest free within 6 months because we knew we would.

All the paperwork came through and whilst the options for all the different cards / purchase terms / APRs were there, it didn't give you the option to chose which one you want.

So I'm not sure if they then decide which scheme to put you on, rather than you choosing it yourself.

 

So if you do get it - as stated above - check you have got the what you wanted!

 

In the end we bought it using our credit card, and transferred it onto a 0% card!
