I have received a letter from BCW with reguards to a mobile phone contract that i was disputing with Hutchinson 3G , i have asked 3G to supply me with a copy of the contract and to substantiate the default placed on my credit file, i have had no communication from 3G at all.

This was over 6 months ago.

I have just had a letter from BCW demanding full payment.

As this is in dispute is there anything i can do to get BCW to provide me with the contract and T&Cs?

I understand that mobile phone contracts are not coverd by the CCA1974, IS THIS CORRECT?

You are indeed correct Mobiles are not covered by CCA.

I am disputing the total value of these debts with 3 due to **WHATEVER REASON**. As such, therefore, I consider this account to be in dispute and no further action or payment shall be made until this matter is resolved.

As per OFT guidelines Section 2.8k "not ceasing collection activity whilst investigating a reasonably queried or disputed debt."

 

I hope that you will enter into a sincere dialogue with me about this matter and I am writing this letter to you on the assumption that you would prefer to do this than merely respond with standard letters and leaflets.

 

I would appreciate your due diligence in this matter.

 

I look forward to hearing from you in writing.

Thank you for that reply, i will be sending that letter by RD today.

Due to the fact that mobile phone contracts are not covered by the CCA1974, would i have any defense if they started court proceedings without producing the contract ?

BCW have now set scotcall on to me and they are going to send a chap round for a cup of tea!

so i have sent them a letter telling them that i only drink tea alone, lol.

i sent the letter about doorstep callers.

not had a reply from them yet.
