      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Paul I have been dealing with HFO for several months now and believe me all sense of logic goes out the window! They prey on the weak and vulnerable. From my first telephone conversation with them, to the court action arriving on my doorstep (26 days), they added £3800 of charges but will not give me any information as to how they arrived at that figure. I dont have a court date yet but I sure am looking forward to it. Bring it on!!

KK got a letter this morning from some one, I guess it must be Welcome as its on the letter head. Well I take it from this letter that it proves they got my first letter asking for details, but it seems they have forgot to send me the other letters I asked for, ie the CCS :-)

 

Not sure what this is or what Im surpose to think of it, so any feedback would be fantastic

You need to look at this letter very carefully. You need to check the logo. against any other correspondence you have from Welcome. The liklihood is that it is shiny and not printed. You also need to check the FSA regulation at the bottom. The FSA compliance is very rigorous and the wording and spaces, even punctuation need to be exactly the same. If you are in any doubt, send a copy to the Cjief Compliance Officer at Welcome and tell him you believe this is a forgery. I dont suppose for one minute it came from Welcome. I have seen this before. Remember, if HFO had the correct documentation to persue this debt, they would not behave like this. This is quite important, if it can be proven that this is happening on a grand scale, we might just be able to beat these bullies.

IMHO it's a fake as Welcome Finance is a trading name of Progressive Financial Services, that's what should be on the bottom of the letter, and if you check the co no against Companies House (you can do this for free) you might find another booboo.

 

Also if they assigned it in February why didn't you get this then? Also HFO's address is actually 165 Broadway, Wimbledon SW19, and again that PO Box is a giveaway, it should have the REGISTERED address of the company on the assignment and HFO's registered address is not West Byfleet...

not sure what you mean there. I entered the company details and got back the following

So yes its not the one on the letter but would they be that stupid and make that mistake.

You would be surprised - a 'postcard' arrived here today from a supposed courier company which is from their tracing department First Direct, it came via Royal Mail 2nd class post... if they think the person its for is going to ring them to check on a parcel they are mistaken.

ok firstly, can i ask what the finance is which they are refering to, is it credit card,loan etc???

 

now then have they todate provided you with a credit agreement for this account in response to your request?

 

irrelevant of the notice of assignment, there is still an obligation to supply the credit agreement

 

some DCAs try to hide behind the Assignment of a Debt as they like to claim they own the debt but none of the responsibilities under the Law of Property Act 1925 which its utter tosh,

 

the plain rule in most cases is NO CCA = NO ENFORCABLE DEBT

To give you as much info as possible, I have no idea what its for, or how it was done, so your as in the dark as me on that one

 

And so far they have only sent me the letters i have uploaded, So I guess thats a no :-)

 

I upload as soon as I get details as I have never had so much support for anything in my life, and this site and the people on it are making me stronger each and every day :-)

Sorry about the confusion from my earlier post. IT problems whilst drafting.

 

I was going to say that the first letter translates as "I've opened the file and realised we have nothing, so I'll try to wrap up a demand as an 'offer'.

The second letter translates as 'Looks like he's a CAGer, so I'll try to bully'.

 

The letter from Welcome is probably a forgery. HFO tried the same with me with another firm. Only problem was one version arrived from the finance company but the supposed same copy HFO sent was different in some wording and formatting. Both letters didn't have the right FSA wording and the finance company logo was slightly different.

I have read trough your post and think you might be fighting your case with the wrong company. it looks like Welcome Financial Services own the debt and just be passing it round different debt collectors to get the money for them. I would advise try contacting Welcome Financial Services directly and ask them for a copy of the contract which they say the debt refers to. Get the name of the person you talk to and always ask for them every time you call.

 

I dont think the letter from Welcome is a forgery - you sent letters to HSO asking for proof of the debt and you got a standard letter from Welcome as a result. (companies change letter heads all the time)

 

All the letters look like standard templates companies use.

If you do get through to Welcome Financial be sure to take the name of the adviser then call HSO and tell them who you spoke to and the outcome.

One thing you never do is phone HFO.

Unlike other DCAs, HFO seem to specialise in actually buying the debt by a deed of assignment. The first a debtor may know about the arrangement is when HFO, through their related delivery company, First Logistics (or some similar name) send a postcard implying they have a parcel to delivery and ask to call them to confirm the name & address.

Once you have called to confirm your details, HFO write to you. Initially with a 'friendly' demand, but quickly becoming bullying, especially if you ask to prove their claim or, Lord above, issue a CCA request. They just keep the £1 fee and ignore the request. They then issue N1 county claim, ignore any request for information and hope you don't get a defence in within 28 days. On day 29 they apply for judgement in default. For some reason, they seem to prefer travelling to their local county court in Wandsworth, rather than issue proceedings online.

I think you will find the fight is now with HFO, not Welcome, but I agree it wouldn't hurt to ask Welcome for a copy of the Deed of Assignment, or just the Notice of Assignment that Welcome should have sent you in the first place. If they do send a copy Notice, it may well demonstrate that the copy from HFO is a forgery.

Not sure I like the reply from G-Force. Doesn't sound like a true CAGer!

 

These letters are definately a forgery.

 

Rosie is right, at some point someone has got to have the balls to listen to us. The net is closing in and we can bring them down! I can imagine them (DCA's) reading this and laughing at us little people but they need to watch their backs, the tide is turning.

Now what i need to know is is the above proff to a judge that the debt is mine, if so should I just cut my losses and pay this off to keep a judgment hitting my home.

 

The thing I dont want is to fight this (as it really is nothing to do with me)

and have extra cost from both sides only to have a judge look at this and go sorry mate your loan your problem, and having the loan and the extra cost hit me.

No there is no claim made yet, just threatening to and so on and so on

 

As for why dont I owe the money.

 

Dam I wish I could get a barclaycard never mind running up a debt with one.

 

I have never had a barclaycard nor I have I ever had a loan for 2k+ with any one

 

LOL my credit score is not that good :-)
