    • Thanks, I've had my fill of this lot. What makes me so mad is that I had to take out student loan to get any DHSS help. And then when I tried to help myself and family they presented obstacles. Might be worth passing story to RIP off Britain?
    • there is NO exposure if you simple remove your name address/ref numbers etc from docs, over 10'000 pdf uploads are here. which then harvests IP addresses off of the people that then do so..which is why we do not allow hosting sites. read our rules and upload carefully thats exactly why we say capture as JPG, redact, then convert/merge to one mass PDF. then online sites to achieve that we list do not leave watermarks.  every once in a while we have a user like you that thinks they know better...we've been doing it since 2006 with not one security issue. thank you.

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I just need to know where I stand.

I had a 3 g contract with 3 network, i have so mucht trouble with them that I cancelled the contract just after the cancellation date. They sent me a final bill, which, after a huge battle to lower the amount from £483, to £203 I succeeded.

I am ready to pay the final amount in installments. I had a called from a solicitor acting on behalf of 3 G who informed me that I cannot pay this amount in installments and that they require the full amount by card now.

They said that if I do not pay this amount, they will send it to court and get an attachment of earnings or issue a bailiff warrant for the amount.

I just need to know what to do.

By the way, I have not received any letters from them, only telephone calls, as they have my old address on my system, as they confirmed this over the telephone. :?

You'll find their offer of settlement was just that - an amount calculated to close the issue. They would expect you to pay any amount on demand (they are not allowed to offer 'credit') and it could be argued that they were effectively doing this. As for the solicitor, they're only doing their job - and an attachment can only follow a successful case against you, but then extra expenses kick in and your £203 may well end up back at £483.

Since you got them to effectively half the bill, if there's any way you can clear it and get rid of them, it will be to your advantage.

Write to them stating everything that has happened so far, state that you cannot pay in full and offer them a repayment plan, DO NOT talk to them over the phone, make them put everything in writing to you, that way, should it ever come to court then you have everything in writing. If anyone comes to your door, do not answer it, deal with any DCA's in writing only and never ever let them into your home.

You didnt say what sort of troubles you had with them,. Let us know on this thread as this may constitute a contract breaker also

The solicitor has missed out a couple of stages in the court process. If they take you to court, you can admit the debt but ask to be allowed to pay in instalments. They will get judgment but the court won't order you to pay more than you can afford.

On the other hand, if they go to court, and if you don't do anything, and they get judgment. If you then ignore the court's order to pay, then they can move to enforcement action such as an attachment order or warrant of execution.

It is also worth remembering that if you do pay at once, you can - as part of the deal - insist that any adverse data on your credit file relating to this be removed as part of the settlement. If you enter into a payment arrangement, or wait for the courts to impose this, your credit record will reflect this for 6 years.
