Just to keep you up to speed I received a letter from the Halifax this morning with a "goodwill gesture of £250" (they owe me £1999), I have no intention of accepting, but what I want to know is, do I reply to this offer saying I refuse and I wish full payment please can you advise what do I do and after this? Bearing in mind I sent my PLA 7 days ago.

 

Please can you help me on the stages step by step I have read the posts and I am just a little confused as some people have said they have accepted as part payment and will pursue the full amount and others have just ignored the letter.

 

Of course like all of us the easier and quickest route possible lol.

Up to you. I found it far too confusing to accept and then pursue the rest so I just flatly refused and put in my Moneyclaim for the full amount.

I'm assuming the 'PLA' is the preliminary letter? If so, when you send the Letter Before Action amend it to say you accept the £250 as an interim payment and will pursue the rest.

 

They'll probably withdraw the offer and you carry on and claim the total amount

I too am in the same situation;

 

they have offered me £400 against £2557.50 in charges, due to my next deadline to send the LBA being 28th June, I'm going to include a line in the LBA stating that I will accept their offer as part payment against the total due but will continue to pursue for the rest.

12/06/06 - Bank statements (195 pages) arrive

13/06/06 - Standard letter from Halifax received ref Data Protection Act and unable to confirm manual intervention

14/06/06 - Preliminary letters sent

20/06/06 - Letter acknowledging "complaint" received

23/06/06 - Offer of £400 refund received from Halifax

30/06/06 - Letter Before Action Sent (LBA)

18/07/06 - N1 Claim form handed into court

21/07/06 - Deemed as served on Halifax

26/07/06 - Defendant filed Acknowledgement of service, they intend to defend

When I do moneyclaim can I do it now or do I have do wait 14 days?

 

 

You can register at moneyclaim, fill in the forms and then save it. That way it's ready to file at any time just by pressing the submit button. You can go back and amend it as much as you like until you submit, but don't do this until 14 days after you have sent the LBA

hi to every one

 

just to keep you posted, it seem like most pepole on the forum seem to find that halifax like to go to the wire when they pay out as in the county court way of things ( my friend say its because they hope you drop dead with the stress of it all so they dont have to pay you out joke ) so up to date money claim was filled in on the 18 july 06 and deemed to be served 21 july 06 they have till 4th august 06 to reply i have followed this all the way ie step by step from the forum, ie statement requests prem letter lba letter now off to court, it seems to me that as they pay us out, they still take off others ie charges and i think this will carry on for sometime yet. till the big boys put a stop to it so i would like to thank every one on the forum for there help and support and will keep you posted as there will be more post off me as i have a few unsettled scores with cap one barclays visa card lol so i mite be leaving the halifax part of the forum but you can bet i will be in a other part lol
