Hi all I recieved a letter today from argos titled CCA SECTION 78 REQUEST. Anyway in the letter it just says how they are obliged to send me one and other things included, it also mentions THE CONSUMER CREDIT (CANCELLATION NOTICES AND COPIES OF DOCUMENTS) REGULATIONS 1983. which explains what must be included in the copy agreement. Regulation 3 provides that the copy may omit certain information, including the signature box and your name and address. Reg.7 provides that if the agreement has been varified the copy must include a statement if the terms of the agreement as varied.

In accordance with this, we enclose the following:

1. A copy of the executed agreement as required by s78(this is a copy of your agreement with the signature box and name and address omitted as provided by regulation 3)

2. A statement of the terms of the agreement as varied by regulation 7.


Please any advise on what this is meant to mean anyone??? They have also included 2 printouts stating (argos booklet t+c's page 1) this just goes on about things you are covered and not covered for and cancellation procedures. Followed by a 2nd page also stating (argos booklet t+c's page 4) this has a little section saying CREDIT AGREEMENT REGULATED BY THE CONSUMER CREDIT ACT 1974 between argos(+ their full address) and you, the customer who entered into this agreement with us. (then in a box it says):This is a copy of your agreement for you to keep. It includes a notice about your cancellation rights which you should read.


Well absolutely no signature from me or them on it my name and address are not even mentioned once. There isnt even a sig. box. can anyone help and explain this to me? Im pretty sure they dont have an agreement so I think this is why they sent me this. Can anyone advise if this is non-compliance to my request and have any ideas on a really good reply to send them, I already no about the non-compliance letter but I would really like something to get them hot under the collar. Thanks for looking everyone.

While the 183 regs do allow for some information to be omitted, that doesn't mean that the prescribed terms or information to identify the debtor can be.

After all how can you verify that it is YOUR agreement ?!

This is a typical Littlewoods' ploy.

Basically they don't have your agreement and they are trying to bluff their way out of things.


Now I'd WAIT until they demand payment again and then hit them hard.

After all the CCA clock is still ticking along nicely.

Hi thanks for replying so quickly. The thing is they are well past all their deadlines I sent the my first original letter on the 18/07/2007, initially they used the £1 fee to debit my account and sent me a default notice and totally ignored all my requests just up until I sent them a really good letter off here telling them I would want my money back and loads of legal stuff, the letter gave them 14 days. It obviously spooked them though because its the first ive heard from them. The even lied and said they had already responded to my first letter and included the exact same letter twice just changed the date, ridiculous they are. Anyway you wouldnt happen to know a really good wording letter I could now send to them? and one to all the other high instutions like ts, oft etc. about them? Thanks.

Dear Sir/Madam

Thank you for your letter of DATE, the contents of which have been noted.

With regards to your recent reply to my request under section 77-79 of the Consumer Credit Act 1974.

I note that you have replied to the above by sending a copy of your companies Terms and conditions and an unsigned agreement, I must inform you that this is not sufficient to comply with the request and that your company is still in default under the act.


To clarify:


On the 29th of December 2006 in response query Ian McCartney MP replied to a letter in his then role as minister for the department of Trade and Industry he stated this, “Mr Bardsley describes a situation in which he was sent a copy of a company’s standard Terms and Conditions when requesting a copy of a signed agreement form. Just sending the Terms and Conditions is a breach of the Act and Regulations as, apart from the information that the Regulations provide that you may exclude, the copy must be a “true copy” of the agreement”


This breach of the agreement can be demonstrated as follows;

As you will know section 180(1) (b) authorises, “the omission from a copy of certain material from the original, or the inclusion of certain material in condensed form.”

This refers to statutory instruments made under the heading Copies of document regulations and in this care in particular to SI 1983/1557.


Before leaving section 180 there are two other sections that should be remembered these are:


Section 2(2) (a) A duty imposed by any provision of this Act (except section 35) to supply a copy of any document is not satisfied unless the copy supplied is in the prescribed form and conforms to the prescribed requirements;


And more importantly


Section 2(b) A duty imposed by any provision of this Act (except section 35) to supply a copy of any document is not infringed by the omission of any material, or its inclusion in condensed form, if that is authorised by regulations.


You will see that this quite clearly states that whilst certain items may be left out of the copy document the rest of the document must be in the form and contain all items as prescribed by the regulations.


Turning to the regulations regarding what may be omitted from these copies these are contained with SI 1983/1557.


The regulations state:

(2) There may be omitted from any such copy-

(a) any information included in an executed agreement, security instru­ment or other document relating to the debtor, hirer or surety or included for the use of the creditor or owner only which is not required to be included therein by the Act or any Regulations thereunder as to the form and content of the document of which it is a copy;

(b) any signature box, signature or date of signature (other than, in the case of a copy of a cancelable executed agreement delivered to the debtor under section 63(1) of the Act, the date of signature by the debtor of an agreement to which section 68(b) of the Act applies);


It is quite clear what can be omitted from the copy document, what is being overlooked is the part highlighted, this again asserts that all other details of the agreement should presented in form and content as required by the regulations.


The requirements of the Agreement regulations 1983/1553 are very explicit in describing the form and content of an agreement and this as I have demonstrated also applies to the copy of any such agreement with the above mentioned proviso.


Nowhere within these regulations does it state that part of the agreement can be presented on a separate document headed terms and conditions.


It does state that all terms and conditions should be within the agreement document and is explicit of the form in which it is presented.

I hope this explains why your reply was unacceptable I await a True copy of my agreement and would remind you again that whilst the request has not been complied with the default continues.


I would appreciate your due diligence in this matter.
