  1. Hi, My friend, yes not me honest! has just recieved a 28 possession order yesterday. He is beside himself with worry and has suffered a serious breakdown before, which is why i writing on his behalf, also im not new to this so can help as well. He went to court, told him to get there early as mediation or a"chat" with the other side is usually possible, he offered the contractual payment plus £100 per month, he is currently unemployed as was also made bankrupt which meant he couldnt find any work in his field which is mortgages ironically. He was unemployed for a while and was getting DWP mortgage relief and has told he will get that again in April which will cover most of the contractual interest only payment. What can he do? he has a partner and 2 kids, and the arrears are about £18k. The other side didnt reach an agreement and asked for either a 28 or 56 day possession order and the judge gave a 28 day one. Please advise on what to do next, and any other info needed to help answer this one. Many thanks in advance Excel
  2. Hi all. I was made bankrupt a while back, in that year's May. The council have pursued me for the Council Tax for that year from May onwards, but not for April, which they have said is covered by the bankruptcy. The thing is - I always understood that Council Tax as a debt, is DUE in the April of any year, for the year ahead. The fact that Councils allow us to spread the payments is purely a concession. IF that is true, and the liability for the WHOLE amount is actually applicable in the April, shouldn't the full year's Council Tax due be part of the bankruptcy, and thus written off, not just the first of monthly payments the Council would be ready to accept? The fact that the concession allows payments to be made for the months AFTER the bankruptcy shouldn't change the (earlier) DUE DATE for the year's tax, should it? Hope someone can advise. NotGivingUp
  3. Hello, I was hoping someone could give me a little insight into something going on with my credit score, and how welcome finance are keeping records of my finances. I was made bankrupt just over a year ago. In fact my bankruptcy discharge was the 11.11.10. I've been keeping a close eye on my credit score and report and watched it steadily rise. The issue is, on my credit file, some accounts are showing settled, some show default (with a date) my welcome finance record is showing late by 6 payments (closer to 36) and updated every month!! Is this right? I'm trying to clear my past, start afresh and learn from my mistakes and I want to make sure this is reflected in my credit score! Any ideas?? Thanks

I have a council tax debt from about 5 years ago (been chasing me for years and I just ignore them) now the council have written saying they are petitioning for my bankruptcy (about a month ago). I own them about £2,000. I also have other unsecured debts totaling about £7,000 altogether (housing benefit overpayment, credit cards, utility bills). I have no income other than Job Seekers Allowance and Housing Benefit. I have no assets other than clothes and ordinary household items (like a DVD player and clothes). I'm worried this 'bankruptcy petition' could arrive any day, I've just been looking up my options and discovered the Debt Relief Order (DRO) and it likes like I might be eligible, I have no idea what to do If I inform my creditors I am applying for DRO will it slow them down until it's gone through? Please HELP!
  5. Would someone help me out with any advise? I was made bankrupt in Jan 2006 for a CCJ of £1K. The CCJ was obtained by default as was sent to a residentual address that no longer lived at. The Stat demand had an order that it could be served by post but was soposidly posted at the address by the solicitors. I attended the high court by application to get the case adjorned and applied to get the CCJ set aside. The CCJ hearing was heard and it was ordered adjurned pending me to supply a deposit in case I was to loose the case. I was unable to provide the deposit as no account had been set up by the court. On the date (Oct 2005) that the deposit was to be paid their (Local Athourity) solicitor phone me and wrote to say the judgment stood and I was made bankrupt... i also got tonnes of junk mail relating to this. It was imposible for me to continue trading for various reasons but mainly because a clause in me lease prevented it. I gave everything up as at the time i was so depressed after going to high court and county court being chased by the LA for a debt that i could prove i did not owe. The registrar had led me to believe that I was in the right but refused to dismiss the case... Try and get the point now! I now wish to get the bankruptsy annuled, I have contacted the OR again (I had previously after about a year, filled in a PIQB and heard nothing). They confirmed my address etc. but continued to send to the previous residentual and work address?? I have now filled in the PIQB again and emailed it to the OR. There is a bit more to it but any advise on filling a 7.1A form and should I try and get the CCJ proved (no longer shows as over 6 years old).. How I should deal with the OR as I think that they can also apply to get the annultment or anything else will be very much appriciated. Jason

I am a freelancer who has gone Ltd, he owes me from before I went Ltd and after. He also owes countless other freelancers, some of them over £5k but most about £1.5k. None of us have seen any money in months and he has been paid for the events we worked on. As far as anyone can see he has no source of income and will be bust when his rent and rates are for payment in December. What he does have is assets. We would be happy to take some of these and start our own hire operation so we can continue to work and slowly pay everyone back (long term solution as he will leave a big gap in our diaries). Payment would obviously be preferable, he clearly does not have the funds though and I suspect he is close to insolvent. Having been on the receiving end of an insolvent company in administration before (I didn't see a penny of £4k) I suspect if we don't do something before he goes under allot of freelancers won't get paid. There is also the possibility he will try to sign the assets over to someone else before he goes bust. There seems to be quite a complex company structure in place. I have spoken to the union BECTU and they gave a very bleak image, saying that everyone would have to go to the small claims court and he would probably be bust before it got anywhere. That and they were not willing to get involved in any kind of joint action as not everyone is a member. Do we have any options here? Does anyone have any ideas? Thanks in advance for any advice.

  8. Hello, I was wondering if someone could answer my question. I was made bankrupt 11 months ago. Found it all easy and havent had any real issues ( aside glasgow city council ) 2 weeks ago, I had to take out a loan from Wonga, didnt even realise I would manage it! I paid it back, but I'm worried that I may be in breach of my bankruptcy terms?! I'm too scared to call AIB and ask. I'm sure that in my terms from the AIB I'm not allowed to have ANY credit, OR it wasn't allowed to be more than £500?
  9. My husband is going through bankruptcy over business debt. It has reached to the point where a trusty has been appointed. There is a flat is which is on joint names and has equity over 40,000. We have owned this flat for last seven years but my husband never paid its mortgage. He was initially jobless then opened his business but could never made any profits. I have been working all this time, was paying mortgage and other bills.Through bank statement we can prove that My question is because I have been paying mortgage all this time, Does that still means that he has 50% share? Am I not eligible for more than 50% share? Kind Regards. NMittra
