Hi, Send you LBA 14 days after your prelim letter. dont wait for barclays to drag their heels . you set the time scales not them so just go ahead and send the LBA and then if they dont reply in 14 days after they recieve it then its off to court you go!!!! ps. dont forget to send all letters via recorded delivery so you have proof they have received them Good luck with your claim regards paul

    can anyone offer some advice on PPI which was added to my egg card EGG have said that there is nothing on my application to suggest that i asked for PPI to be added and todate they have not been able to produce anything that says i asked them toi add PPI so if they cannot prove i asked for it and i personally dont remember asking for the PPI to be added can i claim it back? also when i was out of work ( which is the reason i was defaulted and incurred charges) eg never even said i had insurance or advised me to make a claim on it. i remember asking if there was any insurance protecting my card and was told NO any advice on if i can reclaim the premimums i paid and how to go about it would be great as im about to send egg a prelim letter asking for160.00 in charges to be refunded and would like to include the PPI too regards paul

    Hi WormHasTurned, the cca was in with the statements and other docs ie screen dumps of when their staff had logged into my account etc. it does show my signature too in your case thats fairly good news as they cannot legally enforce the agreement if they have not suppplied you with a signed copy of the agreement within the specified time frame i never asked for the cca so it was a pleasent surprise to find the info included although there is nothing to suggest i signed up to the PPI. also after speaking to EGG customer relations they have told me that there is nothing to suggest that i asked for PPI on the application form they have so i have asked them to prove i requested it and if they cant then i want my money back. i did try to claim on the uinsurance when i was out of work but found i couldnt and as a result i was defaulted so i may be able to push for a missold ppi claim too good luck with your claim, let us know how you get on regards paul

    Well. Finally got my statements and was surprised to find they sent me a copy of the consumer credit agreement as well. also included was screenshots of where operators had logged into my account. i checked through my statements and noticed that i had been charged for credit card protection insurance sometimes at 20-30 pounds a time. i dont remember asking for it and i checked the contract and there is no mention of me subscribing to this protection so does anyone know if i can claim this back too? and if so how do i go about it. thanks paul
  5. hi 1morenite the only thing to keep in mind is when it comes to filing court action (should it be needed) you have to put the head office address on the court forms as the defendants address as far as im aware but it doesnt matter at this stage regards paul
  6. to be honest it doesnt really matter as they will re-route your letter through their internal mail anyway. i sent my prelim letter to lloydtsb local branch in southampton and recieved a response from their customer service centre in andover so i wouldnt worry. regards paul
  7. Well. the other half had a letter todayfrom GE capital saying hey do not accept that they have done anything wrong however they are gonna refund my other half her charges HAPPY DAYS paul

Hi Patsy Yes the martin lewis one is just as good if you are only adding 8% interest under S.69 County Courts Act 1984.the only difference is that the spread sheets on here contain a little more info such as your name, the banks name, your account number and alittle more detail about the charges etc thats the only real difference . i guess the reason you cant open the spread sheets on here is you probably dont have the software installed on your pc. do you have microsoft excel on your pc? regards paul

Hi, my brother in law purchased a fridge freezer from powerhouse 2 days before they went bust. he purchased it in store on HP / finance but as powerhouse went bust he never received the item. now the finance company are chasing him for the money for the fridge even though he never received it. can any one offer me any advice on if they (the finance company) can still demand payment for an item he never recieved and if they cant what is the best way to deal with them to stop them demanding payment regards paul

Hi Oldbear, it would appear that black horse have atleast for the moment given up fighting claims ,atleast thats how it appears based upon mine and ians cases good luck with your claim, i hope its as smooth as ours Hi debt mountain, unfortunatley i didnt get the chance to charge them interest as tehy settled when i sent the LBA so no 8% interest oh well i will save the interest for lloyds tsb instead, regards paul

Hi patsy well, the main disadvantage of using money claim online is that you cannot get any financial help with the fees . the financial help is only available for paper claims through the post. with regards to calculating the interest go to http://www.consumeractiongroup.co.uk/forum/bank-templates-library/182-6-interest-calculation-spreadsheets.html and you will find the spreadsheet to calculate the interest for youjust select the one that says SIMPLE and you should be ok regards paul

Hi With regards to the cost of taking the bank to court , the best thing i can suggest is to give your local county court a call. i know that if you earn under a certain amount think its around 15500 per year then you dont have to pay the fees. what you need to do is ascertain if you are eligble for any assistance with the fees (you may be eligble for a reduction in the fees if you earn more than the maximum.) and ask the court to send you the relevent form N1 for your claim and EX160A to claim the fees. maybe someone may be able to supply a link to the courts service to find the info on the courts website other wise give the local county court a call with regard to the fee for the court action, it is my understanding that the fee varies depending on how much your claim is for so again the court will be able to help you there in my opinion once the 14 days has passed since they have received you LBA then they are ready to be taken to court so i would file as soon as this time has passed, dont wait for them to get back to you in their own time ,follow your time line i hope this is of some help regards paul

Hi roscodog18, i had the same as you with regards to no reply to the prelim and LBA letters, when i telephoned them to say last chance to pay up or we go to court i was told by my local branch that they are happy to settle and today i received the cheques so it appears they have finnally realised its pointless fighting and if they do fight then they have to pay the 8% interest as well regards paul

  22. WELL, that postie has just been and delivered me 2 cheques from black horse totalling up to the full amount of my claim so its fair to say now that i won still got lloyds tsb, barclays , Ge Capital, EGG, The Woolwich to tackle so its not over yet.

Hi Ian, Nah Nothing yet although i did agree to allowing them ten days to get the money to me .they have til the 23rd feb so they have a little while yet. i gave them this time so that if it does end up going to court it will go in my favor as i have been more than reasonable and im pretty confident that a judge will agree. i think( only my opinion) it would be a good idea to allow them til next friday then give them a call, that way they have the weekend to get the money to you and if they dont then i would be at the court first thing monday to file the N1. at least you will have been as reasonable as possible in trying to settle the claim out of court. once again its only my opinion. good luck mate paul
  24. hi millymollymoo, i got around the " please prove who you are" situation by sending them a secure message through thier website. like you my account was closed a while ago but i found i was still able to log in on their website so i just logged in to my account and sent everything via egg secure messaging. as their messaging service is secure they could hardly argue that it was not me accessing the service as i pointed out to them that i had to log in and only i could have the log in details. that seemed to do the trick still good luck with your case paul

    well. today i received another interesting email from egg saying that i must pay them by cheque ( no exceptions) otherwise my SAR would not be considered. also they say that the 40 days will not start until the cheque has cleared in their account and that it will take a minimum of 8 days to clear. as i result i decided to phone these fools and explain the DPA does not say that paymetn must be by cheque and the 40 daays start from when they receive the request and funds NOT when they feel like it. after speaking to a few incompetants i finally managed to speak to someone who atleast understood the DPA 1998 and they have now sorted the problems out for me and allowed me to pay using my debit card ( as i dont have a cheque book) because they say they are not allowed to debit the funds from my savings account although they couldnt tell me why still 40 days and counting till i find out how much they have taken from me
