Hi stansfield5131 thanks . that puts my mind at rest a little. its my first time reclaiming charges and its a very daunting task and i just wanted to make sure i "cross the T`s and dot the I`s" so to speak. dont want to give them any chance to wriggle out of returning whats mine. i will be sending the preliminary letter in the morning asking for my money back and suppose i will have to wait and see what happens. thanks for your help paul

Hi everyone. well sent my S.A.R on Friday 5th january 07 to Black Horse and DAMM they were quick the statements dropped on my mat this morning. i have gone through the statements and i have worked out that they owe me 871.00 without the 8% interest. im fairly confident with reclaiming my bank charges from Lloyds BUT im not so confident with Black Horse. can anyone please tell me if the proceedure is the same for black horse loans as it is for reclaiming bank charges? i have looked through the forum and all i find are letters aimed at bank charges but nothing i have come accross says anything about reclaiming loan fees i:e late payment charges and returned direct debit charges. anyone who could offer a few pointers on how to proceed that would be great . its just i dont want to mess anything up by saying or doing the wrong thing thanks paul
  4. thanks morgan054 . luckily this year due to illness our income is below the 15000.00 level so thats great news. although last year i was slightly above 15000 i think it was around 15885 would this make any difference or is it just the income for the financial year that we are in? my biggest problem is my income is up and down as i only get paid for the work i do so if im off work sick or theres no work then i dont get paid so its hard to say what my exact yearly income any way thanks for getting back to me. regards paul
  5. does any one know what the current cut off is for earnings levels? on the court form EX160A court fees do you have to pay them? it says "You will be exempt from paying a fee if : 4. either • your gross annual income is less than the current cut-off* and you receive Working Tax Credit with a 'disability element' or 'severe disability element'; or • your gross annual income is less than the current cut-off* and you and your partner receive Working Tax Credit and Child Tax Credit between you." however it doesnt say what the cut off is. both me and my partner are on a slightly low income and have 2 children as a result we recieve working families and child tax credits . it would be of great help if we can get assistance with the court fees as as although we can claim them back youve gotta have the money in the first place to start the claim and we have got 5 claims that we are looking at proceeding with against various financial institutions any advice that can be offered would be great thanks paul.   6. thanks rooster. just wondering as i have a claim against lloyds tsb and black horse finance can i combine the claims together? its just that lloyds and black horse are effectivley the same company and funds are a little tight to pay for two court claims at the same time other wise i will have to wait till one claim is settled to pay for the other
  7. Hi everyone. well here goes..... I sent my S.A.R to LloydsTsb and Black Horse on Friday via recorded deliveryso the 40 days clock is ticking now. i have gone back over my statements on line with my Lloyds account and upto july 02 they have taken 2690 without including the 8% interest that im gonna add when we go to court. i can wait to get my statements as i am very certain that there is a huge amount of charges that were added between jan 01 and july 02 so the figure will definatley get bigger:D . With regards to Black Horse i have 2 accounts with them which they have applied more charges than i have had hot dinners , from memory they have added over 2000 pounds of charges on a 600 pound loan and i hate to think what the other account has had added to it and they have also added 2 defaults to my credit files:mad: i understand that defaults added to your credit file through these type of charges can be removed but am not sure how to go about it
  8. thanks sharman24 for your help. this is the first time i have had to do this process so i wasnt sure how to start things off and who send the documents to etc. one things for sure after reading all the success stories on the CAG website im not going to let the bank off the hook and i will take them to court if needed once again thanks for your help
  9. hi everyone,i was wondering if someone could give me some advice please as im just about to start the recovery process againt Lloyds TSB as i believe they owe me a few quid.i have sent of my S.A.R letter to Lloyds Tsb along with my 10 pound cheque. i just wanted to ask ,when i have recieved the bank statements and calculated how much i have been [Edit] by the bank where do i send the letter asking them to repay the charges they have taken. do i send it to the same place i sent the S.A.R ie 25 GRESHAM STREET,LONDON,EC2V 7HN or do i send it to my local branch here in Eastleigh
