  3. it is not normally the case that lloyds ask for a loan to be repayed as it is a seperate agreement from your bank account. i am claiming against lloyds tsb and i have a 5000 loan and they have not asked me to repay it so you should be fine regards paul

Hi Welshcakes, i couldnt agree more. just seem to be delaying tactics that these institutions employ to make claiming as difficult as possible. they did send the schedule 1st class post though. i got a letter detailing all the charges that had been levied against my account over the past 6 years,Happydays as i dont have to trawl through mountains of statements working out my charges. the same day i got the schedule of charges i sent them a prelim letter asking for my money back total was 1233.00 . today i got a response from the woolwich, the usual blah blah blah letter, we will reply to your complaint by the 23rd april blah blah blah signed by michele wallis (from what i can gather she signs all woolwich letters, must be aa very busy person). i hope they dont think im gonna wait til then ,ive got news for them if they do. my prelim letter gives them till 5th april, then it will be a LBA on the 6th and by the 20th april i will be filling out the N1 form for court. once i get a reply i will post the response on herre regards paul
  6. well, this morning i recieved my N1 form back from the county court along with a notice of issue my claim was issued on the 19th march, it will be deemed served on 27th march and Lloyds TSB have til 10th April to reply cant wait paul

Hi MCOL stands for money claim online which is the online courts service. dont worry about the interest as its only applied when you lauch a claim in the courts, if you have sent the bank a preliminary letter asking for the charges back giving them 14 days to comply and then you have sent a Letter Before Action giving a further 14 days if the bank hasnt refunded you the money by t he end of that time frame then its off to court and then you can add S.69 interest at 8% i hope this helps regards paul

Hi Joe, im also taking on the woolwich and have recieved the same schedule of charges instead of statements like you. the OD charge is reclaimable as its the fee they charge you when you have gone over your overdraft without authorisation and to add insult to injury they charge you daily for being over the limit so the amount soon racks up should you need any help just post a message on here and someone will help you out regards paul

Hi yes you send all 3 N1 forms to the court along with 3 copies of your schedule of charges. the court will then stamp all 3 copies with the county court seal and return one copy to you along with a notice of service stating when the claim is demed served,one to the bank and one copy will be kept by the court regards paul

Hi GPM Good luck with Black Horse. i had a claim going with them and they paid out without the need for court see my thread.... http://www.consumeractiongroup.co.uk/forum/other-institutions/57102-pt2537-black-horse-finance.html with regards to charges that have not been levied yet against your account theres not really alot you can do about it, however having said that there is no harm in contacting your local business centre and speaking to the manager and explaining that should they apply those charges you will just claim them back such as what you are doing now and if they pi$$ around then you will take them to court and add S.69 interest under the county courts act 1984. it may work, it certainly did in my case as i asked them to refund me the money and they did as i explained i would go to court which would mean interest and adverse publicity as well i hope this helps regards paul
  14. hi sally, just out of curiosity are you asking to be allocated to the fast track ? its just that the info i provided you with is to do with the fast track. however although your claim is over the five thousand pound limit for small claims track you can still ask for it to be allocated to the small claims track see http://www.consumeractiongroup.co.uk/forum/bank-templates-library/11644-allocation-questionnaires-guide-completion.html the thing is that with the small claims track if you lose you cannot be held liable for the other sides cost however im not so sure this is the case with the fast or multi track i hope this helps you a little paul

  17. just got off the phone to the wollwich customer care, they said they are sending me the schedule of charges applied to my old account over the past 6 years. they were kind enough to tell me they had charged me 1233.00 in charges though. as soon as i get the schedule i will be sending the prelim letter asking for my money back.

  20. well the forty days well and truely expired on the 6ht march for the wollwich to supply my statements and no sign of them so i called them to find out why... to my amazement i was told they had not recieved the SAR so i pointed out that it was sent recorded delivery and i have proof via royalmail.com that they have recieved it. they said that while it had been recieved they have not been passed my SAR and the attitude they show was that it was my problem that they did not have my SAR. i pointed out that they are breaking the law but they were not bothered. on the 6th march i sent the LBA for non compliance and on the 8th march i recieved the Dear sir we are sorry you have had to complain blah blah blah we will respond by the 5th april after investigating ( I THINK NOT) so im now at the point where i am looking to issue a claim in the court to get my data. can anyone offer any advice on what to put for the particulars of claim etc on the N1 form thanks paul

Well, i thought i had better update this thread as i have been tied up with other claims against barclays,first national,egg and many others sent my prelim letter and got the usual S*D OFF letter in reply then sent LBA on 1st march still not got a reply to the LBA so i thought im not giving them any longer and this morning i filed the N1 form at the southampton county court so its a waiting game now for the courts to approve my claim for fee exemption then the claim will be served i will update when i get some more info

Hi, I too am chasing First National Tricity Finance. however i found that First National & First National Tricity while being part of the same company are actually quite different as one does not deal with accounts relating to the other ( if that makes sense) the Telephone Number if its definatley a Tricity account is 0870 550 0100 and the address for a SAR i was given by them is First National Tricity Finance PO Box 700 Leeds LS99 2BD which is the GE Money address, but make sure you mark it for First national tricity Good Luck with your claim regards Paul

Hi Rob No i didnt get it in writing as it was in the course of a phone call. my main gripe is where the hell are you suppossed to place a permit of that style on a motorcycle. i mean if its windy it will blow away, if it rains it will turn to mush and not only that as our council charges 7 pound a strip as each permit covers five days some little sod would nick it as our council limits the number of perrmits it issues for free. i even approached the council about a motorcycle freindly version I E round one so that it would go in a tax disc but they said no regards paul

Hi Everyone, I had a strange conversation with a traffic warden regarding parking outside my mother in laws on my motorcycle. in their road it is a permit parking area and their permits are around 4 inchs wide by 12 long and are paper, which you need to write the day sate and reg no for each day you wish to park in the street. anyway, i parked my motor cycle and went in to visit my mum in law, when i came out i was greeted by Mr Jobsworth who pointed out i didnt have a paper permit on display (10 out of 10 for observation) he went on to say i was breaking the law as i needed a permit to legally park. i tried to reason that its a motorbike and where exactley are you supposed to display this permit on a motorbike? he said basically thats not his problem and if he saw my bike again he would ticket me anyway he did (saw the bike) and he did ( ticket me) when i argued with the local authority that it was obsurd to expect a motorcycle to use a permit which was clearly designed for a car IE to be left on the dashboard and they say the cant be seen to discriminate between car and bikes ( but isnt that what they are doin) so they use one permit for all anyway they told me that the way i should get around this is to fix another tax disc holder to my bike and then use it to house the permit. i points out that a tax disc is circular and these permits are rectangular and they said to cut it up so it fits. i did just this and then got another PCN this time for defacing the permit does anyone know if this is legal IE requiring motorcycles to display parking permits in the street and if the local authorities action are legal
