Hi perseus i have not had any written contact from black horse, however i did have a call from the local branch manager at southampton the other day telling me that they are dealing with my letter (LBA). my partner took the call and they wouldnt say too much to her. anyway i called them back and i got the idea that they were trying to delay me by saying that they were looking into it so i re-itterated to them that if nothing in the way of a settlement is forth coming by the 7th feb then its off to the county court and the bit i included about being a second year law student when they started telling me i was wrong regarding the law certainly stopped them in their tracks.anyway i will update this post on or before the 7th feb. good luck all regards paul

Good Luck everyone with your claims against the black horse ive just been told by my partner that black horse called today in response to my LBA saying they were dealing with my request and will be intouch shortly. i wont hold my breath but you never know they may change tact and pay up without the trouble of having to go to court.then again pigs may fly!!!!!!! i will update the thread again when i know more regards paul

Hi mrpromiscous thanks . its good to hear you have had success against Black Horse, i just wanted to ask what address did you use on the court form N1 for black horse? i sent my prelim letter and LBA to their branch in southampton but im not sure what to put on the N1 form where it asks for the defendants address thanks paul

Well, 14 Days have passed and no sign of a reply from Black Horse regarding my prelim letter. so off went the Letter Before Action this morning . they have another 14 days then its off to the county court at southampton to file my claim. does anyone know if this is normal for black horse to totally ignore the first letter? regards paul

Hi FulhamNick, Thats correct . the first letter basically asks the bank to repay you all the charges levied against you account. you need to include the schedule of the charges the bank have levied against your account with this letter. then if they dont reply you send them the Letter Before Action along with another copy of the schedule of charges they have taken.you need to give the bank 14 days to respond to your first letter before sending the L.B.A and again you need to give them a further 14 days to respond to the LBA before you consider court action then if they dont respond or do not respond in a positive manner then you go to court, its at this point you add the 8% interest. if you get stuck the letters to send are available in the templates library and there is a full FAQ section should you get stuck also with regards to your reference to your S.A.R as long as you have the statements showing the charges that the bank have taken from your account you should be fine Good luck with your claim regards paul

Hi Fulhamnick if you are just about to send your first letter to LloydsTSB asking for the money back then you dont need to include interest at this stage, interest at 8% comes when you are in the process of taking them to court. the spreadsheet you need is here http://www.consumeractiongroup.co.uk/forum/bank-templates-library/182-6-interest-calculation-spreadsheets.html go to this page and click on where it says "click here for vampiress' chamber of spreadsheets" when the new window opens it will give you various different options for spread sheets . i initially used number 3a the one without interest. i hope this helps regards paul

Just received a email from the info commisioners office as i sent them an email asking them to look into the fact that Black Horse may not have supplied them with the correct contact details for their data controller. on the info comm's register black horse are registered at holdenhurst road in bounemouth which is incorrect as their office is in london and this was confirmed to me by their call centre in wales,they said that they have not been at holdenhurst road since the company changed its name from chartered trust to black horse many years ago . form reading the email it seems im not the only one to log a complaint with them 19th January 2007 Reference: ENQ0147023 Dear Mr ********* Thank you for your email of 10th January 2007 concerning Black Horse. Hi un1boy i just wanted to ask when you say you wanted to claim for the collect activity fee and "They" wouldnt let you , who do you mean by they? its just that i was advised that the collect activity fee is a result of late payments and as such are reclaimable as they are penalty charges for late payments. im currently a second year law student and through my contact i have had some advice from a solicitor and they seemed to think both types of charge were recoverable im just interested as im currently filing a claim for both charges from black horse Good Luck with your claim regards paul

Hi All Just had a strange call from my local bank to say they have been informed by their data protection department that they will deal with my problem but it will probably take a week or so due to the "excessive amount of these type of requests due to a recent television program" i wonder what that was then?:grin: :grin: :grin: still it looks like lloyds are struggling to deal with thesee type of requests and as a result they are transfering data protection requests straight to their statement copy unit according to this bloke who called me and that is why things have gone wrong. i will update this post when i hear any more regards paul
  11. Hi mollymoo as far as im aware they can, they are fees that are just another name for late payment charges and should therefore be recoverable . atleast thats what i have been led to believe. i will update this post when i get a response to my prelim letter Regards paul

Hi christinajanep i think i can, ive certainly sent a follow up email to my previous emails clarifiying exactley what i require from them within the scope of the Data Protection Act (section 7). i have explained that i require the information and its up to them which format its in as long as its intelligible. i pointed out that i said in my letter i would accept copy statements, as they are not covered within the data protection act ( from my understanding of it) but i pointed out that I’m not requesting the statements per se, but the charges and transactions, which I’m entitled to by law i hope that they understand what im asking for and refund the money they have taken. the information commisioners office did say that if i clarify what i want with lloyds and they then refuse to comply and refund me the money they would take up a complaint so we will have to wait and see what happens i will keep everyone up to date with my progress regards paul

Hi All Just got off the phone to the information commissionerss office as lloyds took 190 pounds for my S.A.R ,in which i gave them written authority to deduct ten pounds for the service from my current account DO NOT DO THIS as the request i sent was using the basic C.A.G SAR template letter which asks for the information in statement format as an alternative, apparently the bank can charge what they like as the request asks for the info in a particular format and the bank have the right to charge what they like for this service. apparently the SAR should only ask for the information to be provided and its up to the bank to provide it in a inteligible format WHAT A SH*TTER still i will learn from my mistake and send a cheque next time i just wanted to make others aware of this so that you dont get caught in the same way i did. regards paul

Hi Everyone. last night lloyds tsb took over 110 pounds from my bank account for my ONE S.A.R that i sent them. i emailed them as they had initially took 20 instead of the maximum 10 pounds that i had given them written authority to take and they for some reason then went ahead and took another 90 pounds from my bank account.so i emailed them last night to raise hell with them . however today i noticed that they have taken even more money from my account ( its up to 190 now) so i called their customer services to complain and i was told by someone with a foreign accent that i would probably not get my money back as they are allowed to deduct 10 pounds per statement( NOW IM ANGRY) not per single S.A.R . i tried to reason with them that the letter i sent gave authority for one single fee of ten pounds to be deducted for statements between 2001 and 2007 but they wouldnt have it. does anyone know who to contact to get my money back as customer services wont help and i know my local branch wont be able to do anything as they are completely spineless when it comes to overriding higher departments. also if i incur charges as a result of this lloyds C*CK UP i assume that i can claim them back from lloyds? any advice would be great please thanks paul
  15. BARSTEWARDS !!!!!! LLOYDS TSB have taken a shed load of money from my account for my S.A.R . they initially took 20 quid instead of 10 then when i questioned it with them they told me they would refund it now when i checked my bank statement online tonight i find that they have taken well over 100 quid for my request. i guess they are trying to charge me 10 per page of my statements!!! still i have sent them an email which is about to be followed up by a phone call to their customer services department. this is the email i sent them.... Dear Mr Bowden i wish to bring to your attention AS A MATTER OF URGENCY that my authority to deduct the sum of 10 pounds from my current account was in accordance with the DATA PROTECTION ACT 1998 a one time only payment for all the statements from january 2001 to january 2007. however i note that from checking my bank statement Lloyds TSB have made 11 deductions of ten pounds each from my account ( see copy below) this is unlawful and not in accordance with the DPA guidelines which clearly state that the maximum you can charge for a Subject Access Request is TEN pounds for the complete set of statements going back to a maximum of six years please with immediate effect refund all the funds over and above the initial ten pounds fee to my account COULDNOT INCLUDE A COPY OF THE BANK STATEMENT ON HERE AS IT WOULDNT ALLOW IT DUE TO SIZE? ANYWAY THERE WAS 11 CHARGES OF TEN POUNDS should this error incur me any cost whatsoever i will seek recovery from LloydsTSB Bank my letter clearly states what i require from the bank and i cannot understand how this could have happened Please enlighten me hopefully this should get the desired response any advice though would be greatly recieved Cheers Paul

I was wondering if someone may be abale to offer some advice regarding mis sold endowments. in 1990 my mother and father re mortgaged their house and the financial adviser told them the best option for them was an endowment mortgage ( infact it was best for him in the way of commision which he never told mum and dad) he told them that the endowment would pay off the mortgage and would give them loads of cash left over which is now not the case.he also didnt look into the fact that the endowment would continue past dads retirement. its horrible seeing my parents suffering and struggling to meet their outgoings because of some leech of a salesman and i want to help them out but dont know where to start. iam ok dealing with banks as i have a claim going on against lloyds ( largely thanks to all the advice from the C.A.G and everyone associated with it) but im not sure where to start or how any help would be greatly appreciated thanks Paul

Hi Sparkie1723 this S A R is reference to lloyds tsb bank as im having a go at uncle Lloyds as well as Black Horse Finance. i made the request via email with a hard copy letter in the post and they have replied by saying that they have recieved my request along with my authority to deduct the funds from my bank account ( this was sent through lloyds secure email to their customer service) then 2 days later they send a further email saying that they have 40 days from today as far as im concerned im gonna take it as 40 days from the 10th as they have already deducted the money from my bank. in fact for some reason they have taken it twice and debited 20 for the service:mad: however with regardsto black horse i have spoken to a contact i have within the info comm`s office who is gonna look at this issue of registration so i will keep you posted regards paul

  21. well, ive just had an email form Lloyds TSB - Customer Service Recovery,Birmingham informing me that they have recieved my request for statements. however on the 10th they said they had received my request at their customer service centre and had to transfer it to birmingham.so now 2 days have passed and this bloke who emailed me this morning is claiming he has 40 days from today? i thought it was 40 days from the point they recieve the request at which ever branch i sent the request and not at the point which their internal mail reroutes it to the correct departmert. can someone please clarify this for me please

Hi Lu1 firstly good luck with your claims. i agree its our money that the barstewards have taken from us so why shouldnt we claim them back. between me and the missus weve got 6 claims on the go now . weve got lloyds,B/Horse, egg ,the woolwich, GEcapital and barclays so it should be fun over the next few months black horse have 14 days to respond now as they have recieved the prelim letter via special delivery today at 10 am so we will have to wait and see i will keep updating the thread on here to keep everyone posted on my progress regards paul

  24. Well here we go again..... Already got Lloyds Tsb, Black horse finance, Barclays, GE capital on the go so i thought i may as well add the Woolwich to the list. Sent the subject access resuest to the Woolwich this morning so i will have to wait the 40 days till i can work out how much money they have taken from me regards paul
