  1. Hey hope hun. If you put the monthly rate into Mindzai's spready it will give you the correct APR as there is a little more to it then just multiplying by 12. I claimed against Creation for my O/H JJB and got settlement of all charges and 8% (I settled for this when all the malarky was going on about CI)
  2. It changes every day really because of the compounding but the best way to get as close as possible is just add the next days date in the spready and deduct the total by the day before's. When you file, you can send updated ones anyway so the balance will be correct then.
  3. no probs. I sent all my inital letters via recorded delivery so I could check they received them. I also claimed the postage costs back when I filed to court.

  5. Nic, the spready looks fine so get it off asap. As DX says, they wont pay up until you file at court as we all well now. Post any questions here as you go along and we will help you. Expect the 1st letter to offer you the difference and then the next one to say, nope thats you lot. Stick strictly to your timescales and get it filed in court and watch the money roll in.
  6. Bibbaliz, they did this with me and I wrote back to them saying I had requested cheque in all my letters and I will continue to court unless they issue me a cheque within 7 days. They sent me a cheque! Dont cancel court action until your cheque has cleared.

  11. Cheers Chezt. I have just got judgement against 2 other claims with CI too so its definitely worth pursuing isnt it! Janey - I will let Tanz answer you on that one as I used a different one in the end as his POC related to bank account in my view and I wanted one more specific for credit cards

Update: This was on the back burner as the biggest claim Ive got/ Ive had a letter today (some month and a half later!) saying they will pay some charges and will use the refund to reduce the balance. There is no balance to reduce so no idea what they are talking about. Will send letter today saying no thanks and see you in court.

  17. Zootscoot. I just want to point out that if you are a pensioner the tariff income is £1 for every £500. The £250 tariff applies to everyone below 60. Hope this clarifies things.

But if they do pay the balance off your card.....just write back to them and say your previous letters have advised you wish to be paid by cheque and you will continue to court until payment is made this way. Worked for me and I dont see why it shouldnt work for anyone else. Just make it clear in your letters that you wish to reclaim your charges and be reimbursed via cheque and not credited to your account.   21. lol Thanks for the link Doo. Just had letter from Halifax sols today saying it will cost Halifax money to defend (yeah well pay up after the 1st letter then to save all the hassle!) and without admission they are willing to reimburse £179 (full charges) £31.88 interest that they have calculated...(god knows how they did that as that is not even 8%) and £50 court fee. They go on to say that the further £105.42 they do not consider I am entitled to and they will file a defence unless I produce further evidence! Ah well...they will have to pay the money to defend the claim then wont they...daft over £105.42 really. Hi Ho Hi ho...it's off to court Im willing to go... They also add at the end that they have reduced their fees in line with OFT and future charges will stand and they reserve the right to terminate my account if I do not manage it in line with terms and conditions. (yeah whatever!)
  22. They certainly have UK. They paid me full charges, court fee, postage for letters and full contractual interest..just waiting for the cheque. I just didnt want people to get confused over your letter
  23. Hi folks, Just wanted to make reference to UKs letter a minute. Yep short and to the point but I would worry if you accept partial payments, as then you are taking them to court for just the interest and as we know this has been frowned upon previously. I personally would refuse any partial payments and then the whole amount can be taken to court. I know you have sent your letter doo but just wanted to point this out for other people who are watching your thread and are dealing with Capital One. I think its the wrong route to go with partial payments but that is just my honest opinion.
  24. Paintball. I wouldnt worry too much if you have sent the 8% schedule. If they come back offering you that I would just write back and say it is the judges decision to award 8% not Cap 1s so you are willing to go into the court room to let the judge decide. They will soon pay up. Can you send me the link you were talking about to Doo please as Halifax have sumbitted a defence so I will need to get my stuff together too.
