  1. Hi, I recently collected a used car on finance(hp) from my local dealer, I have done about 200 miles in it and the vehicle had already done 50000 miles. Vehicle is an Insignia 2.0 cdti sri 2012. When I test drove the vehicle I noticed that the gearbox was a bit different to the one I was used to but thought it may be the characteristic of the box. Having now driven the vehicle a bit more it is apparent that the gearbox may have a fault which I am going to ask the dealer to investigate. Could I ask for advice on who is responsible for any repairs that maybe required and also what to do if I am unhappy with their response when I raise the issue. There is also a buzzing / humming noise heard in the drivers side of the bonnet which sounds as though it maybe a vacuum unit that needs replacing which again was heard when initially testing the car but was not mentioned to the dealer at the time. I have not had the car for more than 30 days as there was an issue with the v5 which meant I had to return the car until a new v5 was arranged and I could tax the vehicle. Nic

Hi, On 29th july I ordered a car on finance and paid the deposit and arranged to pick the car up on 7th August.When I went to collect the car there were a few more documents to sign, when these had been signed the salesman said that he will go and get the keys and log book and I can then take the car. When he returned he told me that they (Perrys) had not received the log book from the previous owner when it was part exed. He then said not to worry as they had applied for a new log book from the DVLA and it should be back in 2 weeks. I thought no more about it until I remembered one of the other employees had told me that the tax was not transferable and would be cancelled when the DVLA were notified of the change of keeper. I checked online the tax status last week and it was showing as untaxed. I was now worried about this as I was using the car on the road with no tax. I contacted Perrys who were very apologetic and they arranged for a vehicle to be brought to me to use and took my car back to the garage. I have now found out that it will be another 2 weeks before I am able to tax the car and I am now wanting to return the car and see if there are any other cars that had the log book with them that I could take. Perrys have said that I should not have been sold the car but have not asked if there are any other cars that I would like to take instead. I also told the sales manager about a few other issues with the car that I had noticed in the short time that I had it and he said they will have a look at them. Could someone advise how I stand with this matter please. Nic
  3. Hi all, My Wife bought a sliding door wardrobe from Argos last year , when it was delivered there was damage to the sliding doors which they replaced free of charge. One of the doors has always been problematic with opening & closing and now a second door is also being an issue. The first door is constantly coming off of the running rails and now the door has become damaged where the castors fit into the door meaning that the castor does not stay in the correct position anymore. The second door has a similar issue. The doors are made from a plastic coated chipboard which is around 10mm thick and I wondered if I could say that they are not fit for purpose due to the material used and that the wardrobe should last longer than it has. There are other slight issue with the wardrobe also but the doors are the main issue as these are the finishing touch to any wardrobe. Nic

Hi all, I have attached a copy of the reasons that I feel descriptor 2e (moving around) should be applied to my claim and would be grateful if someone could read through it and advise if it is OK. It mainly covers what the Face to Face assessor based there decision on when she said that I could walk between 50 & 200 meters. I remember that this was a factor when my DLA was awarded and I think that this descriptor should apply now for PIP as my condition is degenerative and therefore cannot have improved.   5. Hi, My deadline to send a letter of reasons why I feel I should have received more points is 29th June , I hasvve requested extra time to reply but have not heard from the DWP. Is it worth phoning them to ask if it has been allowed ? I am also struggling with the content of the letter and wondered if anyone can advise. The main area that I feel I should receive points but was awarded none is the Planning & following a journey section. The assessor states that because I am able to drive I go the the local shops and to work on most days, she actually said to me you can get to work & local shops can't you , as I was being pressed for an answer and the assessor was rushing me I said yes but did not get given the opportunity to say that my Wife comes with me to help me in and out of the car and also to get a taxi for us when I feel that my pain is too great to allow me to drive back from the shops. The decision maker has said that I attended the assessment alone which as I feel that the journey to and from the assessment forms part of the assessment this is not the case as my Wife had to come with me and help me plan the route into the building , and also show where the toilets were. Can anyone help me with the content of the letter to challenge the decision. Nic

Hello again, I have just been reading the Assessment Provider report that has been sent to me by the DWP to enable me to write my reasons , the report has a page count of 30 but there is no page 4. The printed report individual page count goes from page 3 of 30 to page 5 of 30 and no page 4 of 30. Can anyone advise what I should do as it now appears to be an incomplete report. Thanks Nic
  8. Hi, I have now received my report from the face to face assessment and have seen a common theme from the daily living questions. No mention of the help my wife gives me on a daily basis just an answer saying that if I used this that & the other I should be able to do the task and so have been put down with the low points for each part. The assessor has also put that I walked 50 meters to the room from the carpark but no mention of having to stop after distances of around 15 meters to steady myself and continue with my wife assisting me. On the section relating to this I was marked as being able to walk between 50 meters & 200 meters on a repeated basis which is not the case. Any advice on how to progress with this and how to respond to the parts I disagree with would be appreciated. I have also contacted my MP about this who has asked for my permission to question the decision also. Nic
  9. Do you mean when I receive the MR decision letter record the date I received it or when I receive the report from the DWP? Is 28 days the maximum? Nic
  10. Hello all, I have now registered my request for MR , I also asked to be given time to go through the report when it arrives with me. The advisor said thar I have 28 days to submit further evidence or details of why the claim may be incorrect. I then asked how long will the report take to arrive at my house to which he said upto 2 weeks. As this would not give me much time to go through the report to meet the 28 days I asked again if the 28 days should be extended to take into consideration the time it takes to arrive , He just said you have 28 days from today. Is this the usual approach ? I also asked if they could take no further action until I had time to go through the report, again 28 days. No pressure then.. Any advice? Nic

  12. Hi, If I ring DWP to ask for the Reconsideration to compile the reasons I will need to wait for the report from the face to face assessment is delivered to me. At the moment I only have what the decision maker has written on the award letter, will I be given a longer period to go through the report and list my reasons for the reconsideration. I have said earlier that the report on the award letter says I attended the assessment alone which is not the case, this and what the decision maker has written makes me believe that the facts have not been documented correctly on the assessors report from the Face to face. Also, should all of the things that my wife(carer) does for me to keep me safe be documented on the face to face report as the decision maker has not mentioned it nor does it appear on any of the sections that I have been given points for. Apologies if I am confusing you with the way I explain things. Nic

Also, I will need the full report to challenge the decision , will I be asked why I want the MR when I call them and will I be allowed time to submit the reasons for the MR knowing that I will be waiting for the full report ? There are a few points on the decision makers report that comes with the award that I feel are not correct and in this report there is nothing about my need to have my Wife(carer) with me when doing various activities in the house to keep me safe, the report does say that I need an aid for some activities. If the full assessors report does not say that my wife attended to help me is it worth complaining to Atos or should I send a complaint now with the Decision Makers statement of attending alone. Nic

  15. Hi, I have just received my PIP award letter from DWP and have been awarded Standard Care no mobility. On the short report it says that I attended the Face to face assessment alone. The fact is that my Wife who is my carer came with me and carried my medication into the room, placed them on the assessors desk, checked with me that I am alright then waited outside for me. She did not stay in the room as she gets upset very easily and also angry and frustrated when in that type of environment. To avoid this we agreed that as soon as I am with the assessor I would be safe and the assessor could get my wife if I needed her before the end. Is it right for the assessor to say I attended alone? Surely the circumstances above say different and getting to and from the assessment is part of the process. Nic

  18. Hi, I am looking for advice on how to complain about unfair treatment by Acenden/ spml a number of years ago now and also how to claim unfair fees back from the same. Does anyone know of any recent sucessful claims for mortgage fees from these companies ? I would also like for the ombudsman to look at the history of my mortgage to see if missed payments add upto the amount quoted on my re-mortgage as I believe that when Acenden / spml received a suspended possesion order the arrears quoted were made up of payment arrears & mortgage fees. Due to an illness in 2010 I was desperate to keep my house and agreed a re-mortgage with Acenden, at this time I was in no position to check if their figures were correct, I just believed them that they were right and still do to this day. I remember that there was around £7500 owed once the re-mortgage had been completed which was hidden in the mortgage agreement. Needless to say I was in despair when they contacted me a month later to ask how I would pay it. I feel I have many issues besides this to write about but I am also in fear of what Acenden might do if I complain. I have wanted to complain for a number of years about the treatment I received but have never done it and now I feel that the time is right. Appologies if this doesn't make complete sense but I can feel my anger building up the more I think about this. If anyone can advise me on the best way forward I would appreciate it. Nicurro

  22. Hi, Just received a letter from BW Legal saying the following, Our client intends to continue with the claim. We have filed notice of our client's intention to proceed with the court. No mention of failing to provide info from the CPR / CCA requests. Anything to do or worry about? Nic

Hi, Just received a letter from Lowell from the CCA request . it is a refund cheque for the £1.00 postal order I sent with the request and that BW legal are now handling this matter and will be in touch shortly. I sent BW legal the CPR request but have heard nothing since 10/10/2016. Are they out of time now and if they are do I need to do anything with the court claim ? Thanks
