  1. Hi all I have recieved a response to my letter, which was to offer me all the charges, but not the interest. Interestingly, the cheque arrived today. I spoke to one of the customer resolutions team (?!) who said I would have to write back, but they are treating all claims the same. Has anyone got the interest back? I still intend to post the cheque back and ask for the interest, as I see it, I'm £400 out of pocket, but if they only refund the charges they're only £103 out of pocket overall. So if there are any posts here with interest won please point me to them!
  2. Just posting my prelim letter. Took me nearly 2 months to get the statements though! There are still 6 months missing, as the balance was £0, so no statements are produced. Just thought I'd put that incase that's the reason for anyone else's gaps. iPeach

  4. Hi Furzle, From what I understand, Wardle had already filed with MCOL 2 weeks before the offer was made, so is not obliged to accept it, especially since additional costs have been incurred. A wee update on our 2 cases. We've asked for interest on both claims before proceeding to court. Both of which we've asked for at the 29.85%. They settled my husbands (quite small) one fully after the second letter. They've offered me part, which we've refused, and we've made it more than clear that we are looking for the full amount plus compound contractual interest to stop us filing at court.
  5. the graduate royalties charge is £6 a month, but they often bundle this with a maintenance charge, so it comes up as £34.

  7. so just so we are all clear, Occasionally, and whenever they feel like it, RBoS has been levying additional charges to accounts the month following unpaid items. These are in addition to the fine levied at the time and are a second charge on a single item. ????!!! :o Niiiiiiiiiice. and they wonder why we are annoyed!!

  10. *applauds* Hi Gary, What made you decide to claim contractual interest on this one, but not on the others?? I am considering claiming contractual interest against RBoS because their rate (which I have been subject to) is 29.85% So I read your thread with interest! Our claim without charges is probably going to be over £5000 so we'll have to file with big court anyway, so we have nothing to lose. Congrats iPeach

Hi Wardle, I don't think you can claim back the royalties charges, as they are considered payment for additional benefits, such as free travel insurance or the ilk, sort of like a membership fee! I am currently trying to get to the bottom of the referral fees, as they appear several times in my statements, but with no reference to why they are there. I think they are an additional maintenance charge for a "bad month" although they don't seem to fit any particular pattern! If I can find out any more I'll pm you! Good luck iPeach xx

Hi Natweststaffmember I'm sort of with Kidson on this one, Although the information is not definately correct, I've had problems with a direct debit the bank cancelled, I tried repeatedly to set it up both with the company and with the bank, but it failed every time, and no-one could explain why. I even had letters from both sides confirming the DD had been set up, but it STILL failed *sigh* Could it happen without it being a policy as such? If that makes ANY sense. Gah, my brain hurts now. iPeach

Hi Wookerson I don't mean to be rude, but there are several threads in the faq sections that lay out quite specifically what steps to take, and there are template letters included in the section. Yes, what your friend has said is 100% true, and what you need to do is send a subject access request and a cheque for £10, all covered in the faqs! The only reason I am being slightly abrupt is because the more of this site you read, the more informed you are, the better we are all able to do! If you slip up somewhere, your entire claim could be thrown out putting you back to square 1. And I appreciate you want to do this properly! So welcome!   15. Hi all, I have another awkward question. My husband and I have a joint student royalties account, now we've been told several times that this shouldn't have been done as a student royalties account can't be a joint account. IF (or when) we are successful on the last 6 years, should we go after the 7th year on the grounds that if the account was unlawfully set up, then all charges applied were thereby unlawful?   17. hi iMac. I presume you are claiming against BoS, from inside scotland? if so, I would stick to 5 years just to be sure, what percentage of the overall figure is from that extra 6 months?? iPeach

Hi Yvonne What follows here are entirely my thoughts, and have no "real" grounding! 1) No, I believe each account has to be handled separately and claimed separately. 2) Yes, Claim every charge back on every account. Closed accounts, joint accounts, single accounts etc. The only case where this may not be applicable is if he has filed for bankrupcy. 3) I think that would be unlikely, but if he is claiming charges back on the loan account that are more than the balance outstanding they may use that to close the loan.   19. Hi Smonty I believe you have to have an English correspondence address. There are several threads on the proceedure for claiming in Scotland, including splitting it up so it's in £749 chunks. Sorry not to be more help. iPeach
  20. Hi flyboy Are you asking about the fees for having a royalties gold/silver/extra fancy/with knobs on account? if so, I don't think you can reclaim the charge on that as that's an opt in. If it's the maintenance charge for errors (going over limit) that's claimable. As far as I know the £12 ruling doesn't make a difference to what you can claim , I'm not deducting £12 from every charge to claim it, but we're in the early stages...

  23. From what I understand (and I am no expert) you refuse the goodwill offers, until you get an offer you are 110% happy with. If you've taken it further and incurred your own costs, then you need to get a settlement that covers any out of pocket expenses. hope that helps. iPeach
