  1. This may be PCWorlds customer service policy and in some cases it exceeds the requirements under the Sale Of Goods Act but in a lot of cases falls short. Their STATUTORY rights are, as always, unaffected by any company policy. When a customer purchases any goods they enter a binding contract with the retailer. The retailer has complete responsibility for complying with the SOGA and must deal with the problem themselves. The customer has no contract with the manufacturer and therefore the retailer must deal with the manufacturer if this is necessary.

  3. This isn't a criminal matter at all, just a civil matter. For theft to have been committed there would have to be dishonest at the point of appropriation (the date you sent the laptop to him). From what you have said here I think that when he received the laptop he genuinely wanted to repair it. I think he has either made a complete pigs ear of the repair and doesn't want you taking it elsewhere as it will damage his reputation or he no longer has it (lost it, damaged it and disposed of it or something like that) As Bookworm has said, you should pursue this through the County Court
  4. I would like to make it quite early in the New Year. Yes there are definitely YHA's up here but not sure where yet. With most CAG gatherings people are generous enough to host visiting CAGers so if anyone has a spare room to let they may contact you via PM. I have ended up on many a CAG floor (some have even been kind enough to lend me a bed)

I do not like these Civil recovery companies but the store is perfectly entitled to reclaim any costs they have incurred that are directly relevant to your case (i.e. they cannot reclaim for costs of installing cameras or things not directly relevant). I would say that, by retaining the shoes that you had paid an amount for that they should have recovered enough from you to cover these costs. I would put his information into any response to RLP. I am not comfortable with your many references to not being British. Are you trying to use this as an excuse or are you trying to say you were dealt with more harshly because of this? You have been dealt with very leniently
  11. Hi Lara, I think that you accept that what you did was a mistake. You were lucky not to have been arrested. I think whether you have been a good customer at TkMaxx or not, it would be unwise for you to return to the same store. Regarding other stores, it is unlikely that you will be recognised and even if you do you will only be asked to leave if you are. I would, personally, be too embarrassed to enter any of their shops again, but maybe that's just me.
  12. Thank you for the clarification of the issues in this post. If the place you were cycling was, in fact a pedestrianised road then the case is different. There would have to be clear signs stating whether bicycles (or any other vehicle for that matter) were prohibited and at what times. If this is not the case then you should have a fairly good chance in court. I wish you luck and will follow this thread with interest.

  16. I notice you keep putting Special Constable in inverted commas as though it makes a difference. A Special Constable has exactly the same powers as a regular Constable and, if he/she is issuing Fixed Penalty Notices, has the same level of training in the laws behind them. I hate hearing the words "Why aren't they out catching real criminals?". I got this myself from a driver that had half a crate of beer in his bloodstream. Laws are there to protect people, this one trying to protect the large number of people that are injured and, in some cases killed, by cyclists riding on pavements. Before you say that you were being careful, listen to what the cyclists who have had accidents have said afterwards. I agree that cycling on the roads isn't necessarily safe but this should be where you should put your efforts in, campaign for cycle routes etc. I live in Newcastle too and the cycle routes here are very good.
  17. I'm sorry to hear that your pup is unwell. I think the breeder could, as a gesture of goodwill, refund some of the money but you have no proof that the breeder was aware of the problem when the puppy went for it's first vaccinations. Unless you can prove that then I don't think you will have a case.
  18. I speak with 8 years experience as a train conductor and 3 years as a transport police officer. From what I can make out you have been charged a penalty fare, which is £20 or twice the full single fare to the next station stop, whichever is greater. If this is the case you will have been given a penalty fare notice and told to send payment to the address on the notice within 14 days or, if you are not satisfied that it was correctly issued, appeal to IPFAS (Independant Penalty Fares Appeals Service) within that time. If you fail to do this then you will be summonsed to court for the offence of fare evasion Fare evasion = "Travel or attempt to travel without having purchased a ticket with the intention of avoiding paying your fare" By declining the opportunity of appealing the penalty fare they would have no trouble in proving this to a magistrate and you are likely to end up with a fine of about £150 plus costs. My strong advice to you is to pay what they want now. It will be much cheaper.
  19. How about organising a meet either between christmas and new year (if people are up this way visiting family) or sometime early in the new year? I take it Newcastle is the best place for it.
