  1. bailiffs get salaried with OTE so the more money they can bring in the more they get paid. did you see dispatches on bailiffs the other day it was shocking! they have no right to enter your home ( unless its by an open window which apparently is legal) the police int he film didnt know the rights the bailiffs had and stood by as they broke the law as the police were unaware and one bailiff even blagged a LAWYER about the "new laws" and talked a woman into paying debts for someone else in her distant family who had once used that address. they cant take things in your house unless they belong to the person who owes the money and if the person who owes the money isnt there and has no valuables there they cant take a thing. shocking what they do to get the cash tho
  2. noticed that other than the moderators there are people with platinum account status and gold account status ( just up on the left by your name. wondered what this meant and how to graduate?
  3. oh my goodness! the statements arrived today ( the dears charged me the £10 too ) and in my entire banking history with them i was charged.... wait for it.... its hillarious..... £0. :o cant beleive i was ever that well behaved bankwise will put this thread to bed now cos i got nothing to claim back

  5. if they sent you a list of charges then they will have taken off anythign they have already refunded already. claim the lot
  6. yes, it is scary at first but once you get your noggin round it you should not only get back the charges but the interest you ahve paid on those charges ( contractual interest) basically if you are £50 o/d and they charge you £25 you pay £2 interest on that whole o/d amount of £75. what you want back is the £25 and the interest you have paid on it £0.66p ( or whatever it is) claim back the £25.66 and then when you get to court papers, add 8% on top of £25.66, ( approx £27.71 in this ficticious example) which is the s69 interest you are allowed by the courts. on a claim the size of yours if you are in overdraft fairly often you may find the contractual interest alone is around £100 i have a similar ammount with the woolwich y'see. thats your money. get it back

  9. yes can you get the £65 back on top of the claim as "costs"? they must settle in full now sureley, if they cant take anything into court then they are going to be even more reticent to go arnt they? good luck and if it were me id cough up, think about it it is less than two charges from them and then you have a garanteed win 'Ave em!
  10. it may be worth a letter to them once you have filed with the claim details in full, if you send that recorded they then cant claim the knew nothing about it and get any judgement set aside. they will deffo take you more seriously when you put "notice of action" at the top of the letter.
  11. i wrote the "you have XX days left of your SAR timelimit and i am still waiting for..." letter in the library and they got it sorted but only by the skin of their teeth.

  13. hi tilly now you have sent off the SAR its a good time to have a read thru the library and a few of the current cases on each forum for your banks/cc's that way you will get an idea of the way your bank plays the game ( for instance HSBC will probs ignore you till you sue, abbey will throw a lump of cash at you (but only about a quarter of what you are claiming) A&L will threaten to close your acct etc... have a read and shout if you get stuck there is normally someone about
  14. hi tilly, thought i recgnised the name matey alan, the standard protocol is to start a thread for each bank you are going after. that said you are more than welcome to post here too woolwich sent em a list of charges, i filled out the spreadsheet ( in the library on this site) and then sent then the Prelim letter ( asking for it back) they have sent me a few guff letters offering a timetable for my complant of 26th october, i will ignore that and 14 days after the prelim send the LBA ( letter before action, the give it back please, or ill sue letter) they get 14 more days then i file MCOL ( moneyclaim on line, the online versions of court papers, yes actually suing them) they will defend ( another 14 days ) then they will wait till 27th day of the following 28 days they get to come up with credible eveidence as to why these charges are viable ( they cant cos they aint) and then they will settle the full ammount out of court. basically about xmas time i should get my wedge back toot toot if you need any help there is normally someone about
  15. that was the way i thought contractual interst was calculated but when i use the spreadsheet in vamipressess chambers for people with no balances, all itdoes is add the portion of interest that relates to charges already applied, so charge of £20, interest £1.20 total £21.20 regardless of the number of years the interest has accrued over. ( ie not £1.20 for this year and last year and the year before when it was applied) is it enough to just issue as it is ( cos i have and sureley it s me im shortchanging so at least the bank wont thnk im deliberatly inflating the figures :? )
  16. id send another LBA stateing that further inforamation had come to light with regards the aplication of interest to charges you are now disputing you have added that figre here...
  17. dunno about the endowmemnt but am surprised you had to wait, woolwich sent me a complete list o the charges, all i had to do was type them into a spreadsheet and add the interest

  20. standard "we're sorry you are not satisfied" letter arrived today. no mention of my complaint that they had ignored 6 months of my banking history with them( they claim in their letter that i have been with them since oct 04, i have in fact been with them since june 04 as i have a statemnent number 2 from july a copy of which i sent to them with my letter) they will fully investegate my claim and aim to reply to me by 26th october.... hmmmm. well thats sad cos i am sending the LBA on the 11th and will be filing MCOL on 26th october so it will be nice if they can get backto me by then who do they think they are dealing with??????

( MCOL not the pub LOL) basically you have done everythign right and it has worked for hundreds ( actually over 2,500 and thats just those who use this site and have filled in the survey) so why wouldnt it work out for you. you hold 'em down and ill kick 'em!

    Me vs HSBC

    hi guys, im eagerly awaiting 2nd oct when i can send the LBA to hsbc they have idnored me completely there seems to be no continuity, sometimes they reply and offer %'s and sometimes they ignore completely ( like with me) and wont pay attention till you get to MCOL. i have printed the LBA already and am waiting for 16th oct for MCOL. off to have a mosey over there now and see if i can fill it in early and then just submit at my own timetable.
