  3. we have same problems with G E Money , adding interest ,.. which is more then the £260 extra we were paying off arreas ,.. we paided £260 off arreas per month along with £260 monthly payment ,.. we make payment the 23rd ,.. G e money , hit us with a interest charge 30th of each month ,.. so how can we ever bring the arreas down , as our arreas payment is eaten by interest payment and a extra £75 onto arreas each month,.. can not do it no more so challenging them on secret commissions ,.. and sent off the 31.16 template letter requesting the underwriting sheets , and give 21 days for answer ,.. these are made pursuant to the Civil Procudure ,..

Morning ,... think you are still laughing regardless who you took loan out with ,.. as if agreement in place ith old lenders then this would be passed on when debt sold ,.. then if not and not in place , then they is another side of the coin,... our loan was taken out with first national and sold to G E Money ,.. who happen to be one of the same , just a new name (probably only done to throw honest people like us off they trails ,.. ) I am guessing when I say this , chances are once new company takes over new papers & doc's are sent out hoping to cover previous tracks with a new signature in place ,.. these companies are very clever in the way they play they little games ,.. I would request the underwritting sheet from the first company also ,.. (only costs a registered letter ) it all can look a little difficult once other companies involved ,. or this is what we are made to believe or think ,... but really you were paying last company per month so its upto them to provide the agreement ,.. as surely these companies would not buy debt without agreements in place ,.. as this would be looked upon as unsecured debt ,.. contact the last cllectors of this loan ,.. surely they will do all the running to find an agreement once the ball is rolling with legal proceedings ,.. once you get your head round all the obsticles in your way ,.. pretty easy with help off this forum , letters off and sit back , again good luck best wishes
  5. well if its even stevens , then at least can not blackmail you into demanding paying the outstanding lump sum borrowed ,.. not forgeting the inerest you could claim on monies paid ,... so could end up owing you money ,..

  7. well if secret commission , then after all I have read over the 30 + hours I have put in , says to me you can make agreement void , ,.. this means you would owe what you first borrowed minus any monies you have paid connected to this agreement , the ppi would come out the difference you would be owed from lenders ,.. I would take the secret commissions road myself , seems a lot less hassle in the longterm , if commission is paid without your knowledge the agreement classes as vid as commission is seen as a bride , so you can claim all monies on these grounds ,.. good luck and hope you get more then owed

Hi , did you manage to get a thread up ,.. ???????/ think the best thing for you to do is put in an N244 Form ,.. you can do this straigt away and take whatever you need to court on the 10th, we just did the samething 3 days ago ,.. we were waiting on info coming back ,.. but as we were close we needed to submit our appeal , ask court clerk if this would be fine to bring paperwork along ,.. it was fine and no problem ,.. good luck with this , should be fine ,.. we were worried , but happened as advised , you have come to a great place for help

Well it will be costs you would not otherwise have if not part of a inflated agreement which in the eyes of the law is void and not enforcable ,.. and as it is the claiment who has recieved the injustice , then surely fees should be cover , and if not ,then possible another courtcase to claim these as money owed

Hi on*the*case , I will not be going down the road of claiming unfair charges ,.. regarding the fees I mention , these would be solicitors fees ,.. as I can get a solicitor on No win No fee ,.. if we win would G E be expected to compenstate my costs to solicitor? ,.. as solicitor fees are 25% of claim , and as the account says £44k owed ,.. original loan £31k ,.. paid £22k over the years ,.. void agreement equals lenders owed £9k,... obviously my solicitor will expect 25% of £35k,.. as if we win debt will move from £44k to £9k

Well had another thought , if I used a no win no fee property solicitor , to fight my case and I happen to win ,.. would I be able to claim them fees off G E Money ? ,.. as if so then surely must be worth bring an expert along to put your case forward ,.. I know we get to know lots through this forum , but I think a professional spokesman would be great and oly strengthen our cases and show we mean business ,.. well all thoughts on this will be great

  15. my letter is sent off to G E Money ,.. 31.16 which will hopefully supply me with a copy of original credit agreement ,.. just 21 days wait now ,..
  16. Good to know ,.. yes it will be all the way as any judge could see these are "unfair terms & conditons" ,.. I mean these companies ask for trouble the way they do business ,.. adding untold amounts , giving backhanders , then first sign of trouble , trying to whip your home from under your feet , not one offer of help while things are bad or a struggle ,.. so what do they expect ,.. other then at fight till things are proven ,...

  18. what correct procedure to suspend monthly payment and interest whilst in dispute ? ,.. as do not want this to increase any further especially now a sale agreed ,.. I do not want to sell and if I can prove this commission then that will be a far better outcome , as we are very settled in our home , right near the kiddies school , everything including family ,..

I think I will follow the secet commission route , as definately charges , and the interest charges would be reclaimable ? ,.. although I do not want to claim charges ,.. they tried to boot us out our home ,.. we have been a customer for 7 years and paid £22,000 in that time ,.. only took £31,000 loan ,.. £2,300 aded on for brokers fees ,.. total credit £33,000+ ,.. now they say £44,000 outstanding ,.. even charged interest on the months I covered the monthly payment ,.. at least if I can prove secret commission can wash my hands of this company as in my book, would owe original debt so only £9,000 to find to get rid of them ,.. and I bet some other charges + interest will add another few £0,000 ,.. so will be close to even with this company ,.. otherwise just claiming charges , still have them hanging over me ,.. I will take your advice and send an CPR 18.1 , and this will give me the underwriters statement? ,.. as I believeOcean Finance were tied to this lender , and I am also going to be request info from Ocean Finance regarding the key facts to other deals they searched for me , and why they thought Ocean were the best for me ,.. anything to get a case going ,.. not ready to let them take the family home without a fight ,.. put to much into it to give it away ,.. and if I can prove my case will be over the moon ,.. £9,000 or less is a hell of a lot better the £44,000 and increasing ,.. thanks for your thoughts best wishes

  21. I myself had a second mortgage arranged through Ocean Finance , I paid broker fees £2000+ ,... I am hoping to void the mortgage , I have had this for 7 years nearly , paid £22,000 back ,.. original loan £31,000 + fees added on ,.. £33,000+ ,.. and now still owe £44,000,... I was in arreas , and offered to pay double the monthly mortgage payments to clear the arreas ,.. my normal payment is £260 per month ,.. so paid £520 per month to clear things up ,. I noticed on statement , that in june 23rd I paid £520 (£260 monthly payment and £260 off arreas ,..) on the 30th june I noticed an interest debit charge £335,.. so even though I paid that month they hit me with interest charge ,. *1 I paid that month so why charge interest ,*2 if they took the £260 what I give for arreas towards the interest payment , then that means (I am not reducing arreas and possibly adding another £75 to arreas (which too would collect interest ,.. so in reality on these conditions I would never be able to clear this account ,.. and the more I paid the more I would owe over time ,.. now that does not seem fair to me ,.. but like you say up to the judge to decide , so thats why I will be going down the lines of secret commissions ,.. open and shut case really ,.. might take time but will have account frozen till dispute is address and resolved
