Kia ,..Sure we will all get it right in the end ,Just stick with the 8% seems alot easier,..Well got my LBA off & just read a thread about changing solicitors,..Very dirty trick,Well I put my thoughts in the thread about that,..All we can do now is sit and wait for the DOSH as you put it,...mmmmmmmmm sound fine to me,..Good luck talk soon Mx.

Hi Guy's,...So their are changing solicitors,..Well shabbey are now playing and operating like a xxxxxxxxxxxx ,..These are the tactics of high powered xxxxxxxxxxxx,..When things are looking bad and things are not going your way,.The xxxxxxxxxxxx will switch legal teams,(this buys them some more time & freedom till the new team pick up were the old team left off with a new shot under a new judge & new legal team ,.. Its a dirty trick and think this should be noted to the judge in our cases (As this shows abbey have not acted reasonable in trying to clear these claims prior to any court hearings,..)..My thoughts are that abbey realise that with many claim against them before christmas,..Their customers(US) will fight tooth & nail as the windfall would come in handy for xmas,Maybe their want to deflate everyone by dragging this into the new year messing everyones xmas up,..Or maybe this is the latest ploy ,..(So come xmas abbey's new team offer 50% of the claim (knowing most are stretched this time of year and chances are 50% will accept these offers,..Looks like their are thinking way ahead of us,...We should all try and fight back together (add more pressure) We should all try and get 2 (or as many people in our families to start the process of a claim)..Stack up the work for the new legal team (maybe their might get that snowed under with paperwork their let slip/or do not submit a defence,..We can not sit back and let shabbey decide the way things should go,.. Well I am just behind you Kia so I have the same stresses to come,..think you just put the 8% think its easiest to do this,..then its done,..That's all I am going to do,..read you need to know your balance on each occassions to work out the overdraft interest,..Or some thing like that,..just as lost as yourself,..just think I have it sussed out then its gone,..Well sure we will get there,..keep a update as I would like to see how you get on,..Talk Soon Mxx.

Nearly ready to send LBA,..but have one concern,..Will be sending this letter to marc winder but the address on the letter I recieved from him is a PO box(milton keynes)..I'm sure I have read not to send corrospondance to PO boxes!..Am I right in thinking this,..Or will it not matter in the final outcome?...all thoughts on this is welcome thanks Mx. Sent my premlim letter to my local branch,..Is it best to do this or deal straight with mark?

  11. Well Folk's its the LBA letter tomorrow,....Recieved a letter off Marc Winder with a how to complain leaflet,..wants another 4 weeks but does not know the outcome! Any suggestions on LBA Letter,..Anyone got a killer I can use,..Thanks all Mx.

Well here is the best explanation which I believe to be correct; The claimant seeks XXchargesXX plus interest at 8% to date of claim= XXtotalXXX plus interest daily at £1.04 pence per day until date of judgment or earlier settlement. (The £1.04 - or whatever is calculated on the charges total only.) You work out an annual figure of 8% on what you are claiming then divide it by 365 to give you a daily rate I don't know what all this .22% is. The way I have described it is that way I have always done it - never any complaints.. However, I suggest that people claim the contractual rate of interest or s.69 in the alternative __________________

Morning all,...Thought it was the 8% you added when filing with court,..Will have a look for the thread which explains how to work that daily interest,.Not as complicated as it sounds,..Me myself are justing going to go with the 8%,..Plus the 22p per day thing will change depending on your total amount of claim,...off to find it now,..Mx

Hi there again Kia,..Think I have it worked out now at long last,..Not going to bother with the non-compliance(I have a estimated claim their will have to show these at some stage after I put the estimated claim to the courts) Sent them my prem letter 19th sept so from the 20th I will take served as next day recorded delivery,..The 14 days is up this wednesday 4th october. Will send the LBA Letter on the 3rd to arrive the 4th.(Giving them a further 14 days (18th october) Then will file my claim with the courts 3 copies of N1 plus 3 copies of schedule. Assuming ;Notice of Issue is within 2 days (like most of the others)..Their have 14 days to acknowledge the claim(3rd November)...(IF NOT I WIN BY DEFAULT) If their acknowledge the claim their will have a further 28 days to submit defence.(1st December) *No defence after 28 days, FILE APPLICATION FOR DEFAULT.(1st December) *Once the Defence is lodged with the court it will take about 2 weeks to A+Q's stage(15th December) . Any thoughts on this is more than welcome,..This is my plan after reading all weekend,..if you can pick up on anything which is not correct please feel free to point this out,.. Best Wishes Mx.

Excellent thread,..Good explantion into the process ,Not far behind you Guy's so will be watching this closely(ready to send LBA letter for refund of charges )So another 14 days after wednesday coming & its off to file my claim with the courts,..Not really bothered about the wait the longer the better,..Well at least this christmas will be special with around £5k plus 8%interest off the abbey,..Will be feeling like a kiddie does come december and ready for the settlement,.. ,Best of luck to all who are still fighting the fight Mx.

Thinking over things,...think I might let the non-compliance slip,..might not file for missing statements,..(there have had there chance)think I will wait till next week till the 14 days are up for return of estimated claim,..Then its the LBA,..can not be bothered spending time chasing things what their do not wish to send,...Let the estimated claim run,..Do not mind paying £30 to adjust the figures,...Well what you all think???????
  19. So I just fill the non-compliance to suit my situation??also is the N1 on the site to look over or download??all help needed now as shabbey have had a day over now,..(Been busy with work to get myself even after all the charges,..)but all advice is welcome as I need to act. thanks all Mx.

Right gang,...the 7 days are up tomorrow for non-compliance of my list of transactions/charges,..Should I file with the court ?...Also can I do this online,..Or am I getting mixed up and only claims can be lodged online?..any advice would be greatly appreciated as I am more than ready for any & all battles with the shabbey,..next week there will get the LBA letter and 14 days after that I will file straight away for court as their attituide needs to change big time,..Well sure their will get sick before ourselfs,..Well best wishes all with all you challenge M.

  23. Well still nothing off the abbey,..Not even a letter to say their recieved the non-compliance letter,.. Well it looks like court it is,..Think I will get my LBA letter sorted out aswell as the 14 days are up next week,..And Kia you are right nice little earner and their can take as long as their wish,..the longer the wait the more the money their will pay out,..Will keep this updated M.

  25. Well still heard nothing from the abbey,..Was expecting a letter today or some type of responce,..well the 7 days are nearly up so a LBA will be sent ,..Well never mind the interest is worth the extra wait I think,..
