  4. Yes you can still accept their offer, it is your choice to stop the court proceedings whenever you wish. I would wait until you recieve the money though before withdrawing your claim. Once you've recieved the money notify MCOL that your claim has been settled in full and that you wish to cancel any further developements through the court.
  5. I would phone them and ask when they intend to refund this money and by which means, explain that you are prepared to take tis matter further if need be and persue the full amount plus interest and fees through the courts if necesary.

From personal experience I think you'll find that they get their defence in at the final hour, or maybe even a day late, the court seem to allow this which is why it's not advisable to hit that judgement button too hastily. With regards to offering them a further week I cant see how this will help your cause, they are quite aware of the deadlines and don't feel as though they should be given that extra privilage......do you think they'd do the same if the roles were reversed.......I think not!!!!

Include copy of schedule Cheque to HM Courts Service Fee will be added automatically to your claim
  8. The court process is not as daunting as it may sound, and like Nattie has quite rightly pointed out there are plenty of people here to help you with that final push.
  9. Dont include the court fee on your schedule as this was not a charge, it is a fee which is reclaimable though and you will get this back too.
  10. Rest assured they will get their defence in at the last minute, don't be too hasty with regards to entering judgement. If you do and the defence is submitted they may apply for a set aside which could delay the whole process even further. i would leave it a couple of days after the deadline before even considering entering judgement.

Spend time reading the FAQ's and the Step by Step guide as this will stop you making mistakes along the way. Use the letters and spreadsheets in the Templates Library as these have all been tried and tested in successful claims. Read as many threads as you can especially ones that relate to your bank.   15. Once you've sent your preliminary letter it is best to stick the timescales that follow though!!
  16. Just to add to that, now that you've filed your claim through MCOL you will need to send your schedule and ask for it to be attached to your claim. Send 2 copies of your schedule of charges, clearly marked with your claim no. + a brief covering letter asking for them to be filed with your claim to: The Court Manager, Money Claim Online Northampton County Court 21-27 St. Katharine's Street Northampton NN1 2LH Dear Sir/Madam (Your Name) –v- (Bank) Claim No: ******** Date Issued: xx/xx/xx Please find enclosed a schedule of penalty charges taken from me by the defendant, along with interest claimed at the annual rate of 8% pursuant to section 69 of the County Court Act. The interest in addition to the amount in charges equates to the total amount of my claim, namely £(AMOUNT). I respectfully request that the enclosed schedule should be attached to the particulars of my claim. Yours sincerely, Wait until you receive the Notice of Acknowledgement (not the Notice of Issue) from the court and then send a copy to the bank’s solicitors, since they are the ones who will now be dealing with your claim Dear Sir, (Your Name) -v- (Bank) Claim No: ******** Date Issued: xx/xx/xx Please find enclosed a copy of my schedule of charges relating to the above claim.
