  1. Hiya, Ive been talking to barclays on phone for most of this week with regards to settlement. Received the letter yesterday offering full amount. Ive scored out the confidentiality bit and the bit where it says payment into barclays account as i would like payment by cheque which they agreed to. Signed copy of the letter accepting and a copy of the letter im sending to the to courts to be sent today. Many thanks to everyone that has helped me. Claire.
  2. hi after reading through alot of the threads of the claimants that went to the hearing on December 21st, ive decided to save my money and take the bundles with me on the day (if it gets that far) as they have not asked for them before hand, although i have just done my statement of evidence all i need to sort out closer to the time is a print out of my up to date schedule.   4. Hi all Ive received a General Form of Judgement or Order today. It reads: Upon the Courts own motion. The Court has made this order of its own initiative without a hearing. IT IS ORDERED THAT 1. Directions will be given in this case by the Designated Civil Judge, His Honour Judge G Hickinbottom, on the 26th March, 2007 at 10.30 at Cardiff Civil Justice Centre. 2. The parties may appear in person or make written representations as to how the case should proceed provided a copy of the representations is sent to the Court and te other side at least 7 working days prior to the hearing. Dated 22 January 2007
  5. hi, just add this to Section G: 'I respectfully request that my claim be allocated to the small claims track. This issue is not a complicated one; it is an issue of fact and not of law. The issue is whether the money levied by the Defendant in respect of its customer’s contractual breaches exceed their actual costs incurred. Accordingly, the claimant proposes the attached draft order for directions, for the courts due consideration.   7. hi missy, I believe they are asking for the more detailed version of the POC as when you file on MCOL you cant use the full version due to lack of space.   11. Hi, You have to contact the court yourself to enter judgement, try phoning the court to find out how you go about it(i believe it has to be in writing). The court staff are very helpful, explain to them that an order has been made for permission to enter judgement against the defendant and ask how you go about doing so. Claire
  12. Hi, Ive looked at your post a few times now. The court are now saying that you can enter judgement for the amount of your claim and costs on the grounds that RBS(defendant) have not entered a particularised defence for the second time in accordance to the order the court had made on them back in november. Basically RBS's defence wasnt good enough. You can now go ahead and enter judgement. IMHO It is going in your favour. Im not sure if they would be granted a set aside though(be given extra time to amend their defence again) Hope this helps you. Claire

  15. Hi, you need to send an up to date schedule of charges. When you did the schedule of charges it should have kept the interest up to date for you. Claire
  16. hi Graeme, The daily rate of interest is worked out like this. 0.00022 x your amount of charges = i.e. 0.00022 x £1,000 = 0.22p (22p) Hope this helps Claire

  23. hi just leave the bit about overdraft interest out if you are not claiming it. The interest you are talking about is the 8% which gets added on at court stage.   24. carry on with the LBA nikki. Stick to your timescales not theirs. Just adjust the LBA to say that you are disappointed that they failed to respond positively within the timescale given in your first letter. Hope this helps
