Yes, I sent my AQ back to the courts 4th December 06, then i received a letter from the courts 25th january to say my court date was for 26th march. barclays offered full settlement on the 28th February. I was desperate for my money to pay funeral expenses and i pleaded with barclays (im not ashamed to say). But they dont seem interested in settling unless you have a court date.

  10. hi Have you looked through this thread http://www.consumeractiongroup.co.uk/forum/scotland/ or you could do a search for scottish claims, there were people asking the questions as yourself but getting conflicting answers so i really wouldnt like to say 'yes or 'no to yours. its not much help, but something i suppose. claire

  12. hi, you could enter this for section g, "I am respectfully requesting that my claim be allocated to the small claims track. This issue is not a complicated one; it is an issue of fact and not of law. The issue is only whether the money levied by the Defendant in respect of its customer’s contractual breaches exceed their actual costs incurred. I am happy to pay their actual costs and I am surprised the Defendant did not counterclaim for these, because I would have reduced my claim without argument. However, the continuing problem is (in common with the hundreds of other cases currently being brought by other bank customers) that the banks refuse to reveal the details of their penalty-charging regime. As the banks have a fiduciary duty towards their customers, they have a duty to deal straightforwardly and in utmost good faith. Accordingly, I would respectfully ask that the court in this case, not withstanding allocation to the small claims track, order : i) Summary Judgement as the Defendants defence did not answer the particulars of claim and consisted of no grounds for defence; OR ii) Standard Disclosure. I believe this would bring a rapid end to this litigation." hope this helps. claire

You are very much right johnnymitch and i had jumped ahead of myself there, you do not add the 8% at this stage thankyou for pointing that out to me, i am also very much past that stage as i have a settled claim with barclays(im wondering how now).   19. hi When i did my court bundles i included all correspondence that i had sent to and received from barclays in all bundles. I am sure that barclays will contact you in the next couple of weeks to settle the claim. send it to Barclays litigation and disputes address. hope this helps claire

  22. yes carry on and add them to the schedule of charges. you can add on charges up to the date that you file at court. any charges that you would want to add on after filing would incur a court charges of £35 for ammendment. hope this helps. claire Congrats by the way!!
  23. hi, probably a stupid question but have u done a schedule of charges with days since offence and 8% interest? It is my belief that some peoples interest may seem higher than yours as their days since offence go back further.(someone correct me if im wrong there) let me know if you need any help to go through it all. claire
