Thanks for the reply Yes it is a big company he works for a major energy supplier He has been to HR and they told him they were well within their rights to take it back and offered him a £400 loan to be paid back at £75 a month . His wages are quite complicated as he gets paid basic , commission and allowances which are paid weeks later and i think at different times . He hasn't realised there have been the over payments ,they where made over a 3 month period . He doesn't dispute owing the money but I just think this is wrong to give him 7 days notice just before xmas that they are going to take 75% of his wage! hes worked for them for over 10 years!

Hi , Wondered if anyone can help me , my dad has been over paid for the last 3 months in error but he genuinely didnt realise , anyway the company he works for has decided to take the overpayment back giving him less than 7 days notice and leaving him with nothing for the next month , they have taken approx 75% of his wages are the allowed to do this ? any advise would be appreciated , thanks
  3. My partner told them to come and have a look there are none of his belongings here but they wont do that . He said we have 2 weeks to prove he is not living here....absolute nightmare he only has his pension letter & bank acc letters sent here as he is paroniod about identity theft ..just worried now that the various friends he has been staying with will not want to write a letter as they might end up with an interview under caution !!! what a mess !! didnt think it would be a problem its only a few letters but i do understand that they think there is an extra income coming in.which would be wrong so suppose its right that they investigate there is alot of benefit cheats out there !!! its just a confusing and scary experience .
  4. Hi , My partner has been to the interview today . It is because my partners dad is having his mail sent to our address ...now we need to prove he doesnt live here he told us we need a letter from the various places he stays at which is going to be a nightmare as he is all over the place at the minuite....hope this will be enough and put an end to it !!
  5. me , my partner and our 3 children ...My father in law is staying with various friends at the moment so doesnt have a regular address to have his mail sent ...didnt think it would be a problem letting him send it here as we see him at least once a week so just pass it on to him ..... im sooooo worried that they will stop the housing benefit and we will end up homeless as trying to get work at the moment is a nightmare my partner is applying for everything and there is just nothing out there he worked for 13 yrs and was made redundent last year its been a nightmare especially not knowing how the benefit agencies work ... we have phoned the council to try to find out what the issue is but wont tell us anything !! how do you defend yourself if you dont know what you are defending ??

  7. Many thanks for the quick replys . The interview is with the council not DWP ...yes there are some prices but as i say they are cost price although i have not stated this on the page . I do have bank statements with the amounts paid and in total it comes to around £60 and have the reciepts of the things i bought to make them and to be honest I was left out of pocket !! if it is this cant believe it for the grand sum of £60 the other thing is my father in law is of no fixed abode and has his mail delivered to my address ..could this be an issue ??? just to add the £60 was to cover the costs not for my gain
  8. hi In need of some help/advise . I recieved a letter this morning asking my partner to attend an Interview under caution regarding a failure to notify a change in our household . It doesnt elabirate thats all it says .... . I have contacted housing benefit to check the details they hold on us are correct , which they are so still none the wiser . The only thing we can think of is my partner was in a car accident at the end of feb and the insurance paid out just over £5000 to replace the car . Not sure if this would have any affect ....also I have been doing flower arrangements for friends and family at cost (I have not gained) but have had them on a facebook page building a portfoilio for when i do go back to work when my youngest starts nursery . If it is this any advise on how I prove I have not made any income would be appreciated and how best to get prepared for the interview. In fact any advise would be greatfully recieved , I am so worried !!
  9. Just thought I would update on how we are getting on .... With the fantastic help of CAG , WD and PT we have now achieved stay of execution to the writ and have had a hearing to the variation order which was favourable to our circumstances, There are other matters to be examined and we will update as things move forward . Without the help from the kind people on CAG I dont know what situation we would be in , its such a comfort and relief to know there is help out there and we cant Thank you enough .

  11. I have just had another look at the WPO and it says , liverpool district registry and a high court claim number , The date is 11 or 12 cant make it out but if its11 that is around the right time i first had contact with them as my son was born on the th at our previous address .

  13. forgot to mention (baby brain) we also had a copy of my OH dads loan statement that he took out to buy the car , this is not finance he took out a loan and paid cash for the car. The hceo took a photo of this to send to his boss as proof of ownership but said because the car is hpi clear he could still take it .
  14. yes we are at the moment my partner claims JSA , we told him times were hard and on benefits thats why the first one said he would send out the means form but we have a feeling that he saw my OH getting in the car and thats why they came today because he said they had checked with DVLA who the reg keeper , the address its registered to and if it was hpi clear.... he didnt do it while he was here .
  15. neither of us can remember seeing a writ . My partner was going to go to the office tommorrow to take a letter from his dad to prove ownership of the car shoud he do this or wait and telephone for the details you said ? as for the stay of execution the HCEO cleared us out today is this really the only way as money is tight . When we agreed the payment plan my OH was in work as our circumstances have changed , we have done the means form they sent and can only afford to pay them around £8 per month
  16. dont think we have seen a writ the first time I spoke to them they came to my address in 2011, my partner was at work and I was pregnant and had a baby too so cant be 100% sure if he showed me a writ as I just wanted him to go away I said i would call him when my partner came home with an offer of payment we could afford they set up a direct debit and that was the last we heard the direct debits stopped being paid in april 2012 . The hceo who came before xmas took photos of the house which is rented , he said to prove he had been and then another fella turns up today to take the car unless we pay £320 all we have seen is the WPO we dont even know the exact amount as he caught us at the luchtime and had three children to feed we cant remember what he said .
  17. yes that was Gaunts too , no only had contact with them three times back in 2011 was the first time and i just aggreed to pay them £40 ...then just before xmas and today never aslked for a breakdown ..yes employment he was made redundent ..we have already told him and he is happy to submit ownership he bought the car from new and is still down as previous owner from first reg on the log book , he transferred the reg keeper details last year due to ill health but he still owns it , his licence has been revoked so he gave it my partner to use until he is fit to drive again

Yes its got the car on and my partner signed it the hceo said we have until wednesday to get a letter to them stating the car is his dads and then the will ask the claiment if she is willing to take installments if not it will be seized and sold ..im so confused as then he told us to set up a direct debit for the end of the month for £40 and wrote their bank details on the back of the reciept he gave us for the £320 we had just paid him ...Thank you very much for any advise...its so scary
  19. I am not really sure never had anything in writing from them to tell me and it was so long ago , Ive had 2 more children since so got baby brain . I payed at least £480 to Gaunts and then another £320 today , he told us today that if she doesnt want to carry on letting us pay in installments the we will have to go to court to let a judge decide who is the legal owner of the car , my partner or his dad ...my partner is the reg keeper but its his dads car my partner only has it as he is unable to drive at the moment due to ill health . thanks for reading
