We all miss things on an occasion. The complaint to the OFT FCA should be followed up as the Gym has no way of causing the consumer much 'hassle' where as the DCA can. They need to have their wings clipped. The DCA's seem to be looking to get into all sorts of areas for 'debt' and are increasingly looking at areas where the debt is quite small in the first instance. -

It is clear that I did not make myself clear. The company to complain about is the debt collection company not the gym or the gym contract. I cant imagine why any thought I would suggest the gym contract as the thread seemed to refer to problems with ARC -

You should complain in writing to the OFT/FCA concerning their fitness to hold a CCL licence. The more complaints the better -

FOS have told me that Redstone have to cash in a number of their mortgages every year under the terms of their borrowing agreement. Is this treating client's fairly, is this just not harassing them beyond reason -
Has any been contacted by this company or one of the firms of solicitors that they use and been told they have forfeited their property due a breach of the mortgage contract. This action is taken without any reference to any court and usually give 14 to 28 days to repay the full amount of the mortgage plus costs. I am aware of at least two other incidents of this happening but keep reading of rumours of many others.

You should pay what you can afford then submit by recorded delivery to the council a financial statement showing them your financial position. Who is the local authority ???

move your wife or family/partner back in on the 16th then instigate a complaint to FOS about the actions of Redstone and potentially their solicitors to the SRA. They (lawyers) will bleat about confidentiality and acting in client's best interests but they cannot do anything unlawful. By the way who are the lawyers acting in the matter. -

There is extensive evidence of the use of personal information being used to try and base a claim for breach of mortgage contract and thus allow the company to appoint an LPA Receiver and sell the property. If you Google Redstone or search on here at least one incident where the company knew of the letting of the property and agreed to it then appointed an LPA, will show up. There are many others! -

To anyone who is in conflict with Redstone please ask questions about their use of private investigators, we are trying to find out if they and either of the law firms they use regularly are involved in this scandal that is brewing about breaches of the data protection act potentially these actions could lead to criminal charges. -

First they assumed that our property had been let. It hadn't but we had been marketing it. The lawyers they used never bothered to check our application or even the offer and underwriting sheet. Which showed our home was allowed to be unoccupied which was the other tack they tried. I assume you are not direct Redstone borrower and that they took over on the day the mortgage completed. The lawyer dealing with had to deal with me as I 'represented' myself. if you wrote to them to inform them what you wanted to do did you ask for permission or did you assume permission. They are skating on thin ice. I think they (Redstone) are in difficulties and looking to cash in your property, it is likely the next thing they will try is to sell it. In the meantime they will be racking up charges. Your lawyer must not sit back an wait for hem to come to you so to speak rather the must go after them. we need to know how many others are effected by this type of Redstone tactic. -
I have had a few run ins with Jacobs and am planning a campaign against them. they act for Flintshire County Council and at the moment we have three formal complaints against them as well as proof of unlawful actions. Who is the council you are having problems with. Together we can break these companies.

This has just happened to me but they wrote to me first (via Irwin Mitchell) and they had managed to get it wrong as what I was proposing to do was covered in the original offer. I have been offered compensation but am taking the matter to FOS for the upset caused. let me know if I can help with anything advice on what we did.
