  1. No. Don't go there. Don't follow any advice from that site - They know nothing. In all seriousness, it will land you in more trouble, just as it has to many people before. _______________________________________ Anyway: The main things are - was notice served within 14 days of the offence? If not, are you the registered keeper? And if you are, how long have you been the RK? Apart from that, there's not really any other way out of it. Especially if you don't intend on going to court.
  2. No, this is not always so. Especially when it is a minor accident. "This exemption applies only to an accident of which at the time the defendant was aware and so did not need a notice or warning to bring the circumstances likely to give rise to prosecution to mind." Halsbury Bentley v Dickinson [1983] RTR 356:
  3. Is the NIP dated? What is the date? Don't forget - you will still need to complete the s.172 form.
  4. For the offences that the police are considering, notice must be given within 14 days.
  5. While filming in a public place is not illegal, If I had someone follow me around while I got on with my job, I would feel a bit annoyed. It was probably a mistake for the CCTV guy to get into a strop. It guaranteed that the footage would be distributed.
  6. Any injuries? If a solicitor wont look into it, may be best to see what the police do. There is the criminal injuries compensation authority, but there has to be injuries serious enough to warrant damages of £1000....
  7. The problem will be finding someone to take the case. Depending on what happened, there may only be the prospect of nominal damages - and not many solicitors will want to touch that.
  8. Legal Aid is available for some people - Eligibility Calculator However, whether it would be available to you to pursue a claim for tort is questionable. The CAB may be able to advise. When you say he assaulted you, what did he actually do?
  9. If he did go to court, I doubt very much that he would be able to recover all of the costs he has listed. These will have been refunded anyway. That will all depend on what the arrangement was regarding this "weekend away" You can tell he used to be a debt collector!! As for forcing you to buy the car - thats equity and to be successful there he would have to show that he has been reasonable. So keep records of all the calls and threats - have you got an incident number or some record from the police? Also - I assume you used the "buy it now" button? Was there a reserve price on the car?
  10. Hi Mad Nick, The police will just be in the investigation phase at the moment. One of the first things they need to find out is the identity of the driver alleged to be involved. You have not been charged with any offence yet. The police are likely to further their investigations, which may involve interviewing you. It will be at the conclusion of their investigation that the decision to charge will be made. If they decide to, you will receive a summons. It does appear that there has been some sort of confusion here which may be down to cloned plates, witnesses misreading number plates or fraudulent activity. It may be worth reporting this to your insurance and possibly the police.
  11. Not sure about recourse, but changing springs is a dead easy job. Changed mine a few weeks back - cost £30 all in.
  12. Car B's insurers need to get some new lawyers in: No way they should have accepted sole responsibility.
  13. Glad it's resolved! The vans do go around, I would expect that is what happened. I have reported untaxed cars before and no one turns up for ages. I assume its insured?
  14. Road Tax laws are hardly new. They have been around in some form since the 1888s and applied specifically to motor vehicles since the 1920s.... To get the £160 back, you need to purchase and produce a valid tax disc, as you have done. How long it takes? No idea. Says the person that come back and 'forgot' he had to tax his car...
  15. It may be possible and seems to depend on the car. My sibling was insured on my dads vehicle (focus 1.8) when 19. He was however refused on the car before then (Focus C-Max 2.0) the reason being that the insurance group was too high. I do believe that the motability people said there was a list available showing which cars could be insured by which age groups... I may be wrong on that.
  16. DVLC? You're about 20 years out of date! I take it you are no longer using the vehicle and are therefore trying to get a refund of the tax disk?
  17. The advice on this thread questions the "respond or ignore completely" debate: I do not think you have made things worse - you have possibly opened yourself up to some more correspondence from the PPC though.
  18. I would urge you to create another thread.
  19. From my own knowledge. See page 136 of the magistrates sentencing guidelines: http://webarchive.nationalarchives.gov.uk/20100519200657/http://www.sentencing-guidelines.gov.uk/docs/sgc_magistrates_guidelines_including_update_1_%202%20_3_web.pdf As for the fine - there are various ways the magistrates can deal with it.
  20. 6 points I'm afraid. The penalty is per tyre. As for the fine, it is worked out using a percentage of your weekly income. For this offence, the lowest you can expect would be around the 75% mark. Pleading guilty at the earliest opportunity would be a good idea (if you believe you are guilty of course.)
  21. Too true. A guy once posted here and tried the freeman defence. He ended up in jail.
  22. Dave, The freeman movement has been discussed on this forum. As you state, you are no lawyer. I am. Common law has long since held parliament and therefore statutes as superior. Your apparent attempt to find a difference between common law and commercial law is unworkable. Commercial law is law governing commerce (at a basic level) and encompasses both statutes and common law judgements. Go research what common law actually is. As I stated, the freeman movement was discussed on this site and the conclusion was that it is a load of rubbish. ____________________________________________________________ Since this thread is quiet important, I request that you stop posted nonsense about this now. If you wish to continue the discussion, please start your own thread somewhere else on the forum (I am not too sure if there is a general chat forum here?)
