  5. Does this work? Dear Sirs Re: xxxxxxx I write further to your numerous letter concerning the above. I must admit to being somewhat surprised and bemused by the tone and content of your letters. I have received no notification, formal or otherwise, that Wescot have passed this debt to your company for collection. As you will appreciate, I am entirely within my rights to request that you provide me with this information, and I will be withholding payments until such time as I receive this paperwork. I need clarification that you have a legal authority to demand payments from me, and if the debt has been passed to you from Wescot you should be able to produce this. Yours faithfully Robbers way took the ball next - told them to sod off, they have written back to say that their client has provided the information and I must pay... which is funny as you will see by post 1 they actually admit they haven't got the CCA! Do I write and tell them that their clients are liars or... please help - thanks Can someone cast their eyes over the above letter before I mail it on Monday - thanks
  6. Robbers Way are a bunch of halfwits (and that is being very unfair to halfwits!). I have just taken great delight in writing to them and telling them to contact their client (Sharklycard) as they are demanding payment from us for a debt that has been paid off (we have it in writing from Sharkleys)... I told them if they contacted us again it had better be in the form of an apology!

Hi, Debt Morons are still demanding money - they have done a credit search and got the new address... can anyone point me in the direction of a letter I can send that says "X haven't informed us that they have passed on the debt, Y haven't produced proof that they can collect, especially as Y didn't know the arrangements with X. You can understand my concerns at paying money to either X or Y when neither of you appear to know what you are doing and I don't feel like throwing money into the abyss?" Thanks Bump - I really would like to get this letter out today if at all possible... thanks Bump again... please can someone help me with this... Pitifully bumping in the hope that someone will be able to help me with this...
  8. Suppose I should pull my finger out and write to these cretins... but I have been having so much fun watching Ashes To Ashes on DVD... Gene Hunt *sigh*... sorry, where was I??? Oh right, so, we have had no notification from Wescot and now Debt Managers are going to call (still waiting)... not inclined to pay anyone any more money as Wescot seem to have washed their hands of it but not told us and Debt Morons couldn't find their butts in a well lit room with sat nav, a map, and a large neon sign saying "Your @ss is here!"... any suggestions, don't want to waste the crayons! "We are sorry you have had cause to complain. One of our team are investigating and..." Makes no difference to me... unless the pre-school division are creating a CCA for me before nap time! Now we are in the Moorcroft Debt Recovery "even if it is not actually read by you" Pre-Court Division... do I just send them the "scratch my anatomy, what are you smoking, this is in dispute" letter???
  9. Hi Citizen B, thanks for the reply. We have had no notification from Wescot. The last communication we received from them was a letter asking why the payment hadn't been made on the date stated. We just made the payment when we could and ignored them. The next we start hearing from Debt Managers! I'm off to buy crayons again!!!
  10. No subject access request was done on this one - as the CCA was enforceable we made an agreement to pay Wescot... mum just wanted them off her back as she has others hounding her...

I was dealing with them... missed a payment and got the "red ink treatment"... sent them a CCA request (wasn't for ebay) and heard nothing... sent in dispute letter and got a reply saying that they wouldn't be responding as my account has been closed and returned to the originator! Hope they enjoy spending my £1!!!
  12. Consumer Direct say that I have to speak to National Debtline on this one! Had two letters from Debt Managers today: 1) a letter with multiple choice boxes - the "other" box is ticked and says: This account was passed to us to collect on the 21/5/10, we will accept the offer you made to Wescot if you advise what it was, and they payment should be made to us from now on (spelling mistake all theirs!) 2) a letter (dated the same as the above) titled "settlement opportunity" we have negotiated a range of special settlement terms with a number of our clients, and your overdue account may qualify for a discount. To take advantage of a possible - without prejudice - reduction, call us immediately. We will discuss any potential discount which may be available to you and confirm the date you expect to make the payment. A dishonoured payment will make any offer void and the full balance becomes due immediately. Credit and debit card payments will secure the offer on the day of your call. Settlement of this overdue account may help to improve your financial status Now, as far as letter one goes - if they took on the account then surely they should have all the information. Is it really down to me to do their job for them? Letter two - are they having a giraffe?!? Call them? Give them debit/credit card details? As if!!! Comments, suggestions... crayons to write back with!

  14. I guess I have just joined this playpen... two letters from Robbers Way and one from Horribly Farrelly for an account that AIC admitted in writing that Royds-TSB don't have a CCA for! About to report them all for being f***witts!
  15. I now have Horwich Farrelly Solicitors telling me that they have advised their client to take court action against me as a result of my failure to settle this account... Ignore or tell them to bring it on as I have it in writing that no one can produce the original agreement?

  17. We were asked to make payments on the 12th of each month, which isn't possible as the money doesn't go in until the 19th. The first payment has been made (last month, second not even due yet!) and now we have received the following from Debt Managers Ltd: NOTICE OF LEGAL ACTION Your failure to respond to previous letters has resulted in your account being passed to this department for court action and our solicitors may prepare the court papers within seven days. If you wish to avoid legal action you must pay now in full today... This letter is dated the 31st, and we got it yesterday (because our mail is being redirected)... anyone got any suggestions what I can write to the idiots? Thanks
  18. Ahh, my late father's favorite bird! The whole OFT/DCA etc thing just screams of the Old Boys Network... I shall be adding my voice to the choir of letters being sent - if there is supposed to be clarity then they need to start setting their various houses in order and stop doing deals "under the table" - as has been said, if they have nothing to hide, why all the cloak and dagger?!?

  21. Thanks CitizenB We received another letter from NCO offering a reduced settlement in two equal payments... which they won't be getting! Robbers Way are now sending on average two letters a week... have told them to foxtrot oscar... but they can't read! Off to buy crayons tomorrow! Sharkleycard have also ignored the letter sent asking for the CCA... sent a thinly veiled threat that if we go to the financial ombudsman then they will say that we didn't "allow them to try and resolve the problem" - I thanked them for the letter and enclosed a copy of the CCA one saying "Please see enclosed, which I believe is self-explanatory!" Refunding the PPI, deducting what they say we owe and crediting the rest... a little over £1K is what we will get back... only got the letter today, haven't reponded yet Funnily enough the CCA still hasn't materialised!
  22. I agree, I am not happy answering any of them... surely it is down to them to produce the (alleged) agreement that my mum (allegedly) signed, proving that she requested the PPI? Why she we do our job for them? I am even more convinced that there is no agreement! Can I write back to them and say to them that it is down to them and not us to provide the proof that there is an agreement with PPI requested?
