  2. Ida - its only been 2 weeks for me but I remember day 3 like it was yesterday! For me the absolute worst day was day 10 when I woke up in an absolutely foul mood and naturally blamed the lack of cigs - was nothing to do with them at all, was purely a bad mood! You can do it - tell yourself you will do it and dont let others tell you differently!
  3. Love the Grouse ads at Christmas. Hate those 'bring on the trumpets' ads which my OH finds hysterically funny and repeats at frequent intervals - usually when I'm trying to talk to him! Maybe that says much about me tho

  5. UPDATE! Got judgment for claimant States that it is therfore ordered that you must pay the claimant £28.75 for debt (and interest to date of judgment) and £45.00 for costs. You must pay the claimant the total of £73.75 forthwith. I have no idea what happened to the £300 they were actually claiming! Result!! I will pay this within 28 days then ask for the entry to be deleted from the register. Thanks for all the help guys and gals

  7. That is very interesting! The agreement is a hire agreement regulated by CCA 1974 but does have the clause re interest in it. The DN also refers to CCA 1974. Does this change my position at all?

  9. CCJ claim for £1900 against me which is all above-board & which I will be admitting in full BUT I have a query on the interest element. The agreement did allow post-judgement interest & they have indicated that this will be charged. My circumstances however means I can only offer a token £5pm so if the interest goes on, I will never ever be clear of this debt Is there anything I can do about this to stop the interest being applied? Does a judge even look at the paperwork if an admission is made and assess the repayment situation given that the 9NA goes to the OC?

Mine says 65 years, 10 months and 30 days old Hubby who is 9yrs youger than me will 66 years, 10 months and 3 days old so both of us will have to wait nearly an additional year because of being born in the 1st quarter of the year My son who is currently 18 will be 68 before he gets his apparently

If I had found paint on the carpet, you can be damn sure that I would have checked the rest of the room for paint where it shouldn't be & not taken several days to find any fault! I would not have text either so it appears that you are being reasonable but the householder is not.

  13. Are you putting your claim in now dx? My mortgage is in arrears and we are in court again in March (awaiting comencement of ISMI payments) so I'm not sure about rocking the boat as it were! If you're claiming now, please can you keep us informed??

  16. Hahaha - 12yrs puts my 5 days into perspective Jack - it really sounds as though you want to do it. Does your Dr's surgery run a stop smoking clinic? The one at our surgery is run by a nurse and we went there and got patches as well as an inhalator which are good. I'm guessing champix are expensive & that Dr might want to be convinced of your commitment before prescribing them but that would be very short-sighted IMO. You can get them over the counter in some countries but not here. Trust me I know about will-power and mine would have been sorely tested if I had any cigs or were with friends that smoke but I have kept away from them for the last week because I dont think I could have said no!!

Hi Jack I'm on day 5 of not smoking so feeling very pleased with myself I've tried just about everything there is out there including champix, zyban etc etc but in the end it boiled down to: got emphysema and breathing getting worse got no money to buy cigs (although always managed to 'find' the money) got a nagging 18yr old son!! I truly believe that no matter what you try, nothing will work until you are ready. My oh and me were smoking about 60/day between us and in that new NHS Quit Kit, you get a dial thing which shows the cost over a period of time. I was utterly gob-smacked to see that in 20yrs we would be spending £85,000 just on cigs & thats at todays prices. If we compare todays prices with 5yrs ago, a pack of 20 in 10yrs time will be £10 at least so that £85ooo is grossly underestimated. I wouldn't be able to be with smoking friends yet so we've not been out for the last 5 days lol One thing I did notice at the weekend was when I opened a bag of cheese and onion crisps - they stank!!! Obviously they have always smelt but I had never noticed it so my sense of smell is returning very quickly. You will get there but it's not easy and I wish you loads of luck. If you need to sound off about it all, let me know!

Again, totally agree The looks I have received as well when I get out of my car (leased under motability so nice and new!!) are the same and when I have been challenged, I simply ask if they would like my parking space and when they say yes, my reply is please can I have the use of your legs and back so that I can park in the regular space?? Shuts em up a treat The general public also seem to expect all disabled to be elderly and I'd like to think that I'm a long way from that
  19. 100% agree with this - lets face it, seems everyone only accepts disability exists if the sufferer is wheelchair bound. I had exactly this problem with Rossendales. Did they send it back to the council...not a chance!! What they did do after seeing my proof of income/expenditure including proof of disability, was reject my offer of payment of £20pm & insisted that the minimum acceptable amount was £120pm!!! The council refused to take it back but eventually did have to when our business went bust and we now live solely on benefits so they get £3.25pw via attachment of benefit. We were not eligible for CT benefit at that point because we got working tax credit which put us over the eligible amount but these limits do not take into account what someones other essential outgoings may be such as mortgage etc.
  20. Hi OH has a barclaycard a/c which he's been unable to pay more than token £3pm since losing job last year. Barclaycard got Mercers to issue a DN last month which is invalid owing to lack of time to comply - obviously not informed them of this Statement arrived today & Barclaycard are adding £50 to balance in the form of £12 late payment fees, £37 interest on standard balance so his £3pm is not coming off the balance at all. We feel the agreement will be enforceable cos it was taken out in 2008. We sent them letter saying that we have no money but dont know what we should be doing now. Should we respond to Mercers or write again to B/card repeating what we already said? Seeme ridiculous that we are owing more each month because they continue to add interest & charges so I cant see any point in paying anything at all Heeeeelllllp please
  21. I would write back again (for the last time!) enclosing copies of the letters you have previously sent. I would also be highlighting the bit which says "If it is your view that you are not the creditor, s.175 of the CCA 1974 applies in the case of a simple assignment, and places a duty upon you to pass this request to the creditor. In the case of an absolute assignment, you are a creditor as defined by s.189. If you contend that you purchased the rights but not the duties of any agreement, you are reminded that s.189 of the Act is clear that an assignment is of both rights and duties." Tell them that until they produce the CCA, you will be witholding payment & reporting them to the OFT but will not communicate any further until they comply. Keep filing the dross they send you with the envelopes attached in case you need to refer to them in the future.
  22. I had the same issue when FOS found in my favour against Co-op bank. I rang FOS who said that they couldn't tell me how much the refund would be and that Co-op would not issue the refund without the full & final signature acceptance! My argument remains that for an offer of full & final settlement to be accepted, an actual offer needs to be made!!
  23. Well if they dont provide the CCA, you can legally withold payment after sending them the a/c in dispute letter. If they still say that shes not paid, I would be asking them for an up to date statement to prove that she is (and if she isn't, just where are her payments going?)
  24. I dont know anything about summary judgements but there are several threads about them. I think you need more help with this and suggest you hit the red triangle for site team as they will advise.
