  1. I still get the odd call off of a particularyl persistant DCA, I just enjoy listening to them blow their stack when I refuse to go through security!
  2. You can ask for a copy of your Consumer Credit Agreement at anytime, makes no difference if you've been making token payments or not!
  3. After reading your original post again (sorry, sore eyes), I don't see why you shouldn't send a CCA request off to who ever is chasing for this alleged debt be it Fairfax, Eversheds...whoever. They have 12 Working Days plus 2 for Delivery to comply, should they fail to send you your AGreement you can then send them a 'Account in Dispute' Letter. Send any letter recorded delivery, keep proof of posting and do not sign letter, just print your name. Should they send you anything, post it up on here so that one of the experts can take a look at it. GOLDEN RULE: Do not speak to these companies over the phone, keep all correspondence in writing.

  6. In my experience of DCA's, I cannot even think of a sentence that nice & DCA go together!!! Many of them get aggressive when I refuse security & refuse flat to pay them anything....no proof, as for being nice back...me putting the phone down on them without the last two words ending with off is being nice.

Bit of a sensitive one: Friend takes out a loan from Provident in October 2009 was making the requested payments weekly (£30), they are on benefits, they recently became sick.....very sick & has been in & out of hospital, they haves missed one or two payments because of hospital visits. They contacted the agent by phone to tell her whats going on & the agent said to her that she can pay £15 a week for 6 weeks, they have told me of the problem & that they can't really afford to even pay this £15 a week. The agent is coming tomorrow for them to sign some sort of waiver or what ever. I have told my friend that as this is a recent agreement I would have to ask for help, so any help would be appreciated.
  8. Lol....I don't know what is wrong with my eyes apart from them being sore & streaming & the fact that I had two calls off of Cabot today myself plus one of their delightful letters. Like I said earlier don't let these a***holes beat you. In my experience of them they do send out rather long winded letters in many cases mis quoting the law etc, their letters I've had thus far are fit for one of two purposes a: In the toilet or b: Petie & Twizzles litter trays.

Sorry I seem to have Cabot on the brain at the moment...my mistake, I have just read through this thread again, you mention about other debts that have been through the courts or are in the process of, if its for a different problem other than this debt on this thread about the NatWest loan you would need to start different threads for each debt so that the questions you ask don't get missed and that you get the correct advice for each. I hope this is making sense, having a stinker of a cold & sore eyes doesn't help!!
  10. I'm not an expert with court proceedings, so I couldn't comment on that, I'm sure tjhat an expert will be able to advise you on that one. So that you get the answers you're looking for, the court hearings is this for the Cabot case or something else?
  11. Sounds like the usual long winded guff you'd expect from Cabot, as for not being bound by requests...well....no CCA = No payment, simple. If Cabot are chasing you they should have a copy of your CCA or failing that they should then send your request onto the Original Creditor. I would now make a formal complaint to the OFT via Consumer Direct. If Cabot send you more letters demanding money put it on here so we can take a look at and advise you accordingly, get copies of all your correspondence between you & Cabot & vis versa & keep them safe. Please down let these cretins get you down, stay strong.

Firstly, you will need to send them a Consumer Credit Agreement CCA Request, the letter template can be found in the Debt Collection Library, you will need to get a Postal Order for £1 and send the letter to whoever is chasing you recorded delivery, keep the receipt & do not sign the letter. They have 12 + 2 working days to come up with an enforceable agreement, if they fail then you then send them the Account In Dispute letter, also recorded (do not sign). If you get anything post it up minus your vitals so that the experts can have a look at what if anything they send. Also can you tell us when the account was taken out please? Take a look at the Doorstep letter in the library also, send this too. If...IF anyone turns up they have no legal rights whatso ever to demand anything from you, just tell them to leave in words of your choice as they will be trespassing, if they refuse you call the police. As for telephone calls, just refuse to go through the security questions & put the phone down or tell them to get lost & put the phone down.
  13. I have no real plan of playing letter ping pong with the either, no enforceable CCA....no payment.....simple! Harass me then they get reported, I have more important things that need my immediate attention at the moment. Thanks Huff&Puff.

Update: The missus had a letter from Equidebt today with a cheque for £1, here is the contents of that letter: ******************************************************** Dear ****** With refernce to your recent correspondence and your request for a copy of your clients Consumer Credit Agreement. We confirm that we no longer hold the account and it was recalled back by Ikano Financial Services. Any request for a copy of your Consumer Credit Agreement would need to be made directly with Ikano Financial Services. Please find enclosed a cheque for £1.00 as a refund for the postal order that you sent with your letter. We trust this clarifies matters. Your sincerely ******************************************************** No CCA then, as expected. What next?

Update: This is a response I got this week from my account in dispute letter: ******************************************************* Mr David **** ************ ************* **th February 2010 Dear Mr ******* Our response to your correspondence I refer to your letter recieved on 16th February 2010. Cabot has previously responded to the issues you have raised and our position remains unchanged. I would with respect advise you that you have been misinformed in relation to the arguments you continue to raise and you have no grounds for your continued dispute and failure to repay your financial liabilities. In relation to your concern regarding the processing of your data, Cabot is legally entitled and obligated under the original credit agreement and under the Data Protection Act ('DPA') to process information and also report to the Credit Reference Agencies ('CRA's'). We disclose information to CRA's about customers' conduct of their accounts because that disclosure is necessary for the purposes of legitimate interests pursued by us, other members of the credit industry and the CRA's to ensure responsible lending. CRA's hold such data and disclose it to prospective lenders because that is, similarly, necessary for the purpose of the same legitimate interests. As previously advised, with regards to your request for all communication in writing, your telephone number has been temporarily removed from our records. However, I must re-iterate that if we do not recieve your co-operation in paying towards your outstanding balances, we shall reserve the right to re-instate telephone contact. The Customer Assurance department will not enter into any further correspondence with you regarding this matter as we have continually responded to the issues you have raised. Your account has been returned to our Collections department and will be escalated in our collections process, if we do not recieve a payment proposal within 7 days. Yours sincerely ******************************************************** The only thing I can say to this letter is that if Cabot is bound by my original agreement to process my data.....where is a true signed copy of said agreement? Any thoughts on what I need to send back? Help please.
  17. Just send the Account in Dispute letter, don't sign the letter just print your name. As for information they ask you to provide, tell them to get lost they're not entitled to it, only a County Court can request your information.
  18. First of all, stop talking to Crakbot over the phone, they will lie & bully you, golden rule never speak to any DCA over the phone. If they say they have no CCA on them & that they need to retrieve it from the original creditor just sit back & wait, any begging letters just file under ignore. Once they have gone past the 12 + 2 working days for the CCA request send them the Account In Dispute letter, also send them the Telephone Harassment Letter too. If they phone just say to them 'correspond in writing only' then put the phone down or just tell them to go away in your own words! Crakbot in my experience of them are full of c**p so don't worry.
  19. Smudglet. you must report this company to the OFT as I did this time last year when I was having problems with them. The more people who complain the better the chances that the OFT will do something about this awful company.
  20. Have you complained to the OFT & Trading Standards yet? If not, I would do so ASAP. CPUTR (Consumer Protection from Unfair Trading Regulations) I think you are thinking of.
  21. Cheers, I'm in no mood to speak to these cretins at the moment as my missus is recovering from serious surgery today! I have sent them the Telephone Harassment letter twice now, along with a CCA & a Account in Dispute x 2.

  23. Just a quick one, it's probably in the wrong forum but here goes: Partner had a message on the home phone basically asking her to call 0844 7360022. I've googled the number to no joy, don't really want to phone them in the morning. They didn't say who they was when they phoned, didn't say when I tried the number just now.....I suspect its a DCA, can anyone help shed any light on this please?
  24. 'Confuesed? You will be.:-|' You bet!!! Still considering my next move, The funny thing is I sent the bemused letter a while back & this letter & the other sheets that came with it was their response to it, so which company is the account in dispute with now Capquest or Crakbot?
