  1. Hi Middenmess- have tried to post a new thread on legal threads but the page won't load! Wondering what the hell I can do if legal team abandon me completely with no paperwork to present to the court - which it looks as if they are going to do. Never, never, never put your trust in solicitors, people.
  2. Thanks Elsa and Shadow. Hmmm, I am getting very worried about that barrister now,especially as he is saying the court will be more sympathetic to me if I represent myself at trial. Yeah right! I'll get slaughtered - I don't even have a copy of my paperwork and the trial is in a few days!
  3. Thanks, Shadow. Barrister alludes to Carey and the right to reconstitute agreements - thinks this will allow them to get round their previous failures.
  4. That was my thoughts, too, Elsa I am inclined to fight on and risk the CCJ.
  5. Thanks Elsa, you're right of course. I don't have a thread for this as it was with lawyers so I had to keep it o the QT - basically they had no right to modify the agreement in the original terms but they have modified it. To my mind that is game over, whatever happened on the modified account should be null and void as it should not have existed in the first place. Barrister is very pessimisstic, saying that it was modiifed after April 07 so I have no protection. However the original agreement was years before this date! I just can't get my head around how they can get away with modifying the agreement when they never had the right to under the original terms. Apologies for wandering off topic again.
  6. Thanks,Lexis. Bit off topic, I know, but would advise anyone wishing to have representation to secure the services of a direct access barrister and not a so called 'no win, no fee' solicitor - all they are interested in is screwing you for their own costs.
  7. Barrister is very pessimistic in light of the Carey judgement; which has spooked the sols. I thought no win no fee meant just that too - apparently not! Looking at going this alone now - guess I should have done that in the first place! A salutary warning to everybody!

  10. Be very wary of **** - total barstewards who will go for jugular. Even my soicitor is scared of them! Don't want to alarm you - just to give you fair warning of who you are up against. Tread carefully!
  11. Completely agree, not just for debtors as claimants, but also as defendants. Just been told by sol to roll over and accept the whole debt plus the cred's costs, plus my 'no win no fee' solicitors costs, plus barrister's costs. Has doubled the debt and will ruin me; but hey, the barstewards get their costs, so what the hell! All because of the Carey judgement, apparently - feel stupid for even trying to fight: Even more stupid for trusting lawyers.

  13. Yes my family/relatives always make me smile - some when they arrive for a visit and some when they depart ;-)
