  4. What an amazing man! Shame you didn't know his name; you could have nominated him for some sort of local hero award or something. Definately drop a letter to the bus company expressing your appreciation of him - they'll be aware of who commandeered the bus.

  7. Hi sillygirl, thanks for your reply. It is not welcome finance, it's a high street bank - don't want to say which one because they read these threads. So basically if I sign a Tomlin order I will be playing into their hands and laying my head on the block?
  8. To cut a long story short, I am being offered a Tomlin Order to settle a claim, rather than a straight forward Consent Order. I have been warned that Tomlin Orders are not worth the paper they are written on and that the creditor will find any ruse to screw you over and force it back into court, as they have the right to a forthwith judgement by proxy if you sign a Tomlin order and miss a payment, or any other infraction. Would really appreciate people's input on this as I am worried about what I might be signing up to if I do accept it.
  9. If the original creditor has a court judgement against you and you are paying them monthly instalments, how on earth can they sell the debt onto a DCA? Even if they had sold it on, surely the new owner of the debt would have to abide by the court order? They obtain the responsibilities as well as the rights, surely?
  10. I should hope so Dotty. If I were in your shoes, I think I would point out their errors (without revealing too much) and offer a low settlement figure - making sure they agree to write off the remainder and not to sell the remaining debt on to anyone else. Again, best of luck to you.

  15. Hi Hunter, thanks for your reply. Yes, I would have thought you would be notified if they did get a CCJ. My understanding is (and it may be wrong!) that a consent order is basically an agreement between 2 parties that just has to be rubber stamped by the court. Don't know if that makes it a court 'order' or not
