  2. Well said SP, I know we shouldn't "feed" the trolls but as the wife of an ex serviceman, I find their insults very offensive, therefore I feel the need to respond. EDIT :grin:

  4. The thing is, this is an awful burden for you to have to carry on your own. Are you sure that you won't be able to talk with her? I don't know your personal circumstances of course, but at some point you may find it difficult to hide it from her. I know how awful I felt when DH informed me of the extent of our debt, because secretly I knew it couldn't go on, so in a way it was a relief for me too that it was now in the open so to speak. Please think about it, your wife may be more understanding than you think. Good luck with whatever you decide to do
  5. Hi, Mrs Z here, if it makes you feel any better, we are over 90k in debt albeit unsecured. What I will say to you is this ; you should not keep it from your wife. When my DH put me in the "whole" picture as to just how much debt we were in I felt sick as a parrot. TBH, deep down I knew our finances were a mess and that in a matter of time it would become unmanageable, but I had stupidly buried my head in the sand for a good while leading up to the inevitable. As a team, you and your wife can work it out I'm sure. I know how Mr Z felt when we finally had the discussion, he said the relief at us both sitting down and talking about it and our plans for our way forward was unbelievable. As much as it scared me, I came to realise that the financial burden was the both of ours and not just for him to cope with. Our debts built up through trying to maintain living whilst our business was just not working out, certainly not for luxuries. I truly hope that you and your wife can sit down and talk and plan your own way forward and I wish you the best of luck

My headache has subsided now thank goodness Yes I agree, the court would have notified Mr Z if they had anything, so will not worry too much It's pouring down here - quite depressing really, but then, it's the bank holiday weekend - so par for the course really!!

Hi citizenB, We are fine thank you (not strictly true with me, I have a raging headache that has flatly refused to acknowledge the ibuprofen I have taken ) Re the "pessimist club" - I laughed so much that it's really lucky that I don't have (or should I say Mr Z has banned ) any coffee in the "office" or I would have splattered it all over the keyboard!!!!! Perhaps it may be best that Mr Z phones them on his next day off to check then. It's funny you know, you're a member of the pessimist club, I think I may be eligible too, I should certainly be a candidate worthy of the panickers club!!
  8. Hi citizenB hope you're well. Mr Z has not heard a dicky bird from either Co-op or Incasso (apart from the unenforcable CCA and other stuff with it as per part 18 request). Surely if they had filed something with the court, they (the court) would have sent an AQ as Andy said a few posts back? The earliest Mr Z could phone the court is possibly next Tuesday, they obviously wouldn't speak with me about it due to the Data Protection Act. TBH, I wouldn't particularly want to ring myself, I would get all tongue twisted Have a good bank holiday weekend

Thanks for your quick response Andy – a star as always I’ve just reread the letter from the Court regarding confirmation of the Embarrassed Defence and it states the Claimant has 28 days from receipt of a copy of the defence. The copy sent (recorded) by Mr Z was received by Incasso on the 22nd July, so even allowing from the 23rd, I make it that their 28 days were up on 19th August. Dare I say it’s looking good for Mr Z?   10. Good morning all, Mrs Zeus here Just a quick question if I may: The 28 days given to the Claimant to respond to Mr Z's "embarrassed" defence - is that "working" days or just consecutive days? Any help appreciated
  11. Hi JOSH_IOU, Re the telephone calls from Lloyds TSB, compared to some people who receive several calls, once a day didn’t seem that bigger deal! Strangely enough, I got all the harassing letters mainly BLS and the phone calls seemed to be for me. Mr Z got letters too but not as many. Perhaps they thought they could intimidate a woman more! Lloyds TSB got a couple of complaint letters from me with all the acts I could muster (thanks to this site) and a couple of months ago they agreed to a payment plan for 12 months. Mr Z still pays his token payment but has not received any more letters from Lloyds TSB or BLS and what’s more, no payment plan was agreed for him. So not sure what’s going on there! First Direct only phoned the once and the answer machine took care of that call. :grin:

Only two of Mr Z's creditors had our landline number: LLoyds TSB - They were ringing only once a day - but that was once too much in our book, they eventually complied, took a couple of letters though! First Direct - They ignored first letter so wrote to their data controller quoting the Data Protection Act 1998 demanding removal and telling them they were not to pass it on to any DCA. They complied. The other Creditors only had a mob number which we quickly got rid of!! :grin:
  13. nuthatch, first of all, condolences on the sad loss of your husband. I am not going to pretend that I know what you're going through, because I don't. What I do know is that you must allow yourself time to grieve, so you are quite right to tell any creditors that you won't deal with any of them until you are good and ready. As others have said, compassion is not a word that is understood in Creditor's or DCA's vocabularies. Try not to let it worry you too much, as you can see, you will get lots of help on here.   15. Thanks again Andy, a star as usual. We will do as you say. By the way, we are involved in litigation with a CCJ ongoing with the Co-op as posted in the Legal thread!! If they try to go down the same route then we shall have to prepare ourselves once more, hope not as there are only so many dental appointments involving extensive work excuses (to explain time off) Mr Z can give his boss!!!! I suppose time will tell! No point in worrying about it until it happens. You reckon that EOS will be the next shower to attempt recovery as B, O & S will get nowhere - so will be back asking advice on how to deal with them!! Thanks again Andy citizenB, I was only pulling your leg!! I don't know what gets into me sometimes :grin: I must admit, the trace form threw us too?? No, they don't ask for any signature. TBH, as far as I can see, it's been sent as information only so don't understand why they've sent it really :idea: Perhaps it was a mistake, lets be honest DCA's are not the sharpest tool in the box are they Thanks babybear - it's good news, as far as I'm concerned, Hellifax have been real ignorant to our circumstances and I have a favourite saying - What goes around, comes around, I need say no more

  20. Hello all, Mrs Z here. Update: I am shocked after reading on this forum re B,O & S and not responding to CCA requests. This morning, Mr Z has recieved a reply, I am unable to scan it at present because I still haven't learnt how to!! Anyhoo, surprise surprise - it's headed "Credit Card Aplication"!!! Also accompanying this is an "Application Trace Request Form" which is filled in by them. I will get Mr Z to scan said documents as soon as possible, so anyone can give their opinion as to whether or not it is enforcable. Thanks for reading
