  4. Good afternoon all, Mrs Z here. We have just got back from a trip to visit our son who lives overseas. An N150 AQ has been sent from Northampton CC with a letter saying that the application to lift the "stay" has been granted. This was dated 30th October but the actual postage stamp is dated the 3rd November, sooo annoying! We went away on the 4th November. Anyway, the AQ has to be filled in and arrive at the court by Monday 17th November. Incasso has sent a bundle of paperwork, the alleged properly executed CCA is the same as the first one sent except where the red boxes appear on the image and the 2nd page (2nd image) wasn’t received last time. Good morning all, Mrs Z here This morning Mr Z received a letter from Bank Of Scotland with enclosures re his Halifax CC CCA. http://i305.photobucket.com/albums/nn216/Misterzeus/BOSFinal.jpg Quick re cap: Mr Z first heard from Blair et al in July, sent off a CCA request in reply. More threatograms arrived from them in August and September and an alleged CCA (application form). Letter sent mid September telling them the CCA did not comply etc. etc. Notice of Intended Litigation sent in reply. End of September letter sent by Mr Z in response under the Civil Procedure Rules. Bank Of Scotland wrote mid October saying they’re dealing with Mr Z’s complaint. Then the latest instalment today! The CCA is exactly the same as Blair et al sent back in August – an application form. 9 Pages of what I presume are the “historical” Terms and Conditions but headed CREDIT CARD AGREEMENT REGULATED BY THE CONSUMER CREDIT ACT 1974. 8 pages of the current Terms and conditions headed the same. Any advice on the next step please? All comments/advice welcomed Thank you, Mrs Z:)
  8. I was however very impressed with a recent courtcase where TS prosecuted another market stall holder for selling things in imperial measurement. Even though the European Commission has said it is no longer a crime. Apparently it is still on our statute books and TS felt they just had to make an example of a pensioner trying to make a living ??? That seems to be the only level at which some Trading Standards can operate!! Thanks yet again citizenB for your help, will have to start again with a complaint to the FOS. I will make sure the covering letter explaining why Mr Z is complaining is crystal clear!! Thanks again Mrs Z
  9. Hi, Mrs Z back again! This post is more of a moan really; it concerns Citi Cards/1st Credit. As mentioned earlier in the thread, I wrote to our local Trading standards, 1st Credit’s area Trading Standards and to the OFT. The post has just arrived and Mr Z has received a reply from our local Trading Standards. I despair, I really do! What is the point in writing to these people? I feel it’s been a complete waste of time. All relevant copies of letters of communication between Mr Z and Citi/1st Credit were enclosed, which TS have kindly sent back to “re-use” in a complaint to the FOS. Personally, I find the comments rather contradictory, especially point 5 – or is it just me?? Thank you so much for going to all that trouble for Mr Z and I regarding the Moorcroft morons!! I shall certainly write to them on the basis of your telecom with the Information Commissioners Office, thank you so much once again! I will also do a complaint to the Information Commissioner's Office too! Also a big thank you to Davey77 for his input, we very grateful indeed! The CAG has truly restored my faith in human nature, I feel quite humbled, thank you all from the bottom of my (and Mr Z's) heart. Mrs Z

  13. Hi all, Mrs Z here. Mr Z received the following from the Moorcroft Morons today. After sending the letter (recorded delivery)to said morons (kindly posted by citizenB), also sending a copy of Moorcrofts last letter and a copy of Mr Z's reply to the FOS, they have the temerity to send this latest garbage. The FOS has sent an acknowledgement so I presume they are willing to add it to the complaint file! http://i305.photobucket.com/albums/nn216/Misterzeus/Moorcroftscan2done.jpg I love the last bit - Please note we have confirmed with a major public utility that you are in occupancy at the above adress. how scary - not!! Well bully for them! Mr Z isn't trying to hide where he lives from the idiots!!! Should I file and ignore? Or send a copy to the FOS and still ignore Moorcroft? Any opinions/advice gratefully received as always, thank you Mrs Z

  15. Thanks citizenB This is the part of Andy's reply that made us wonder when we should actually apply for a strike out. Having said that, it costs the defendant to have a claim struck out doesn't it? So in answer do nothing excersise patience and then apply for a strike out. How long should we wait?? I know I'm being impatient, I can't help but worry about it Mrs Z
  16. Good morning all, Mrs Z here. Mr Z has just phoned Northampton CCBC re our Co-op (Smile) CCJ. The person at the court said that the case went into “stay” on the 26th August, but the claimant has indicated that they intend to pursue this further. Mr Z asked what will happen now, to which they replied, the claimant will need to apply to the court to have the stay lifted, and it will then be transferred to our local court. Mr Z was also informed that he would be notified by the court of this in writing, if or when it happens. We feel that in a sense, we are still in “limbo” as to the direction this case will go. Has anyone else gone through this rigmarole? If so, would you care to comment please? Also, is there anything we can do, apart from wait and see if the Co-op follows through and reactivates the case? Any advice, comments etc. much appreciated. Thank you, Mrs Z:)

  20. Hi Khadijah, If Power2Contact knock on your door, just tell them to put everything in writing and also that if they don't leave you will call the police, then shut the door. This is what Mr Z did back in May when Power2Contact called and they never came back. Try not to worry too much, easier said than done I know. Regards, Mrs Z
  21. Thanks spamheed I totally agree with your comments. Mr Z will not send any extra info, TBH they are the bottom of the pile of creditor. Gaining employment will not change the payments they recieve, Mr Z's wages only just cover the mortgage anyway. I don't think it's worthwhile requesting A CCA as it was a CC only taken out around 2 years ago or so. We keep all paperwork, always insist on everything in writing and never ever phone them. They no longer have the right to telephone as I wrote to their Data Controller some months ago telling them to remove the number. They've never attempted to ring!! Thanks berrylover, I was thinking about photocopying the relevant letter and sending it to them also telling them that they will not get anymore. I could rub salt into the wound by telling them that they are not our only creditor and perhaps that they are last in the pecking order too Regards, Mrs Z
  22. The more I think about it and have looked again, it is weird and doesn't really look like a signature at all! Compared to Mr Z's signature it does look decidedly dodgey!! Does it make a difference though? I tried to write a few words in Adamsky Outline SF font but it changes when I preview my post! That style font reminds me of their rep's signature!   23. Thanks 42man The signature I'm refering to is Cap One's representative and not Mr Z's. I take it that their rep's signature doesn't matter then ( the fact that it looks odd I mean)? Thanks again, Mrs Z
