  1. I have just had a letter from RWC saying they can supply me with a copy of my Crap1 application form but not a copy of the agreement and I should ask Crap1 for it. Shame I have already SAR'd Crap 1 and know they only have the application form. I have sent them a F&F offer which involves them putting the balance to 0 and removing the default and all my details and never contacting me again. Do you think they will go for it???
  2. If they have got a judgement by default then you can still get it set aside. Did you get any 'letter before action' or any court paperwork? I would ask them to prove they have a CCJ on you and then apply to have it set aside. I would also send them a CCA request using template N from the Letter templates in the debt section. Having re-read your post it seems strange that they say they have a CCJ yet are willing to accept a lower F&F.....smells fishy to me!!

Check the T&C's page to see what charges are stated for over limit, late payment etc. Alot of DCA's send out current versions that all state £12 and not the £20-£30 that would have been on the original agreement (assuming this account is from before the unlawful charges case) indicating they only have the front sheet of the agreement. Did you get a notice of assignment from the DCA or are they working on behalf of B'Card? Is there any charges on the account that you could claim back? Did you get a default notice?
  4. Once you get to the 12 days then the account is in dispute and they should suspend all collection activity. I CCA'd them in May and have had 1 phone call since which I pointed out (and confirmed in writing) they had sent me an application form that didn't have pre terms etc. I think they knew I was on to them and have now got a letter saying they cannot supply a copy of the agreement and I should ask the original lender for one. Suitable letter sent given them 3 options all of which involve them going away. If it doesn't go quite then just ignore them for a while, send them the harassment letter and then make a formal complaint to RWC requesting their complaints procedure. You could also send an s10 request telling them to justify processing your data but its a bit early for that. If you need any letter templates just ask Hope this helps

  6. Be careful what you put on this thread as worst crudit are avid readers!!! The letters you have are standard ones so just get the CCA request off ASAP and let us know what happens The more info you give on here, the more likely they are to work out who you are and then they will know your every move!!! (that doesn't mean don't post, just be vague with details )

  9. My on going battle with worst crudit has taken a new twist. I received the standard LCS letter which said that they will not enter into correspondance with me etc to which I sent the 'I am slightly bemused letter....'. I am gonna have to send them a reply along the lines of 'thanks for replying to my letter stating that you will not be replying to my letter and I hope that you will reply again confirming that you will not be replying to my reply to which you won't reply!!! ' Anyone want to add anything?

  11. Ok I have CCA'd the Co-op for a loan and an old NR credit card that they took over some time ago. I got back an application form for the credit card () and an enforcable agreement for the loan except that parts of it are illegiable and its blatently a computer print out of a scan. I sent them a 4 page letter explaining my concerns and what I needed from them to retify it. I got the usual 'we are sorry you have felt the need to complain balh blah' letter back. I then get a reply yesterday with the old you have been paying for years, you have had the money, this is proof enough there is no dispute, we will send it to a DCA etc rubbish. I could send them a similar letter back but they are obviously trying to ignore my requests. Anyone got a good, short, [edited] letter when they won't listen???

  14. Recieved the standard LCS 14 days to pay letter today so guess what........I gave TS the authority to pass on to OFT and the local TS so we will see what happens there! Bring it on......!
  15. There is a specific layout required for default notices with certain prescribed terms. I thought there was a sub-forum just for default notices but can't seem to find it. The letter may constitute a default notice but it sounds unlikely. You should maybe scan it and put it up on here (minus ALL personal details) so everyone can comment. An overdraft is credit (running account) so they can default you and put it on your credit file. You may find that they will report it to the credit agencies without a default notice but it would be unlawful and people here could help you start your battle! You would be best of getting your wife to get hold of a copy of her credit file from the 3 agencies to see what's on there. Hope this helps
  16. They may have got your postal address by doing a full search on companies house but is/was your postal address not on your website?? I would guess they just put 2 and 2 together and hoped it equalled 4. I would add something in your letter stating that you have never given them that address and that you won't allow them to hold that info and then insist the business address be removed from their files, as is your right under the DPA. If they ignore your request then report them to the information commissioner. As always print don't sign, send recorded and save the receipt
  17. And the only people making money from this will be them, £640 fee I would guess that this is all info you can get for free elsewhere AVOID!!!
  18. You said that you recently set up a business? Are you a director? If you are they could search companies house for your name and get the registered office address for free. They may have been phishing but I would guess that's how they got it. As for the mobile number, try putting your name into google and making sure it doesn't appear somewhere you have forgotten about. Also if the first couple of points are true have you got a business website? Do it have your mobile number in the contact section etc? Just some thoughts
  19. I reported my suspect letter from Northern Rock to TS and they want to take it further so if you do get one then report them immediately particularly if they are from worst crudit
  20. I would personally go for 'removing any defaults and late markers' as they could register a whole heap of these that would damage your file

I would also suggest turning your mobile voicemail off as you can rack up a fair cost listening to their endless nonsense which is money that could be put to better use, like special delivery costs for CCA requests I generally answer every call from a DCA but never speak just connect and then carry on whatever I am doing as this doesn't cost me anything, annoys them (Hello.......HELLO.....HELLO.......click) and saves my voicemail costs!
