  1. Thanks pt, I agree there can be some confusion between the definition of term as per the dictionary( the word term can mean a few different things aswell as the word limit lol), but the additional info you have given has most definitely cleared that up for me.

    That`s a bit of a story. They got it first with my SAR request which they sent back as it was unsigned-royal mail printout says 4th Feb, they got a second letter stating exactly the same thing except with a few clauses and subsections thrown in about not needing a signature and that they were misrepresenting the law by claiming they NEEDED my signature before sending it out on the 16th Feb (royal mail printout to prove it again), instead of saying they needed it to prove who I am ( which they hardly needed because I sent them two forms of id with my CCA request-what dumbos!!).

    I wouldn`t convert it to a loan ( the agreement of which will almost certainly be 100% perfect ), from a credit card agreement which may not be, so like tendogs says one step at a time-it is overwhelmingly worrying I know-that`s why I`m here as well.
  6. I`m told that the judgement on this case-ie "credit" and only the word "credit" will suffice etc wasn`t about a credit card. The financier involved doesn`t supply credit cards and never has. (source The Penalty Charges forum). Is this true? I know there are an awful lot of very bright people on here-I can`t seem to find anything except a brief paragraph which tells me nothing.

    They are acting against the consumer credit act if they issue a default whilst the request is in default or the account is in dispute. As long as you have everything-proof of delivery and copies of letters there isn`t much they can actually physically do to take the money out of your wallet. Hoever, Egg will trash your credit file regardless ( hard faced gits) and that will be the pain to deal with.

  10. Then they have not complied-send letter informing them they are in default of your legal request. I wonder what could possibly be the problem????Maybe they can`t find it.

    They ring me from 8 in the morning until 8 at night-makes no difference, I still don`t go through the security. If they want to spend their money calling me, they can be my guests. It would do them good to read these forums-they might just realise it isn`t washing any more.

    No, you`ve done nothing wrong. What these companies rely on is your sense of obligation to them and your lack of knowledge of the Consumer rights. Also and most importantly, remind yourself of one very important thing. Your telephone is there for YOUR convenience NOT theirs. If you don`t want to talk on it then put it down.

    That because of the ever present threat of identity theft you no longer give out such private information over the phone. If they then discuss the account with you then you ask them how they know it is infact the account holder and that because they have not verified that they are in fact giving out confidential information.
  15. No, don`t know when they changed it, but changed it most definitely has been. And no Livis, I doubt very much that they have changed it for no reason.
  16. Just found something that`s interesting-not a clause or subsection etc- Eggs current credit agreements use the term "credit" limit not "approved" or "individual".
  17. My Mum in Law is happy for me to complain on her behalf-it`s in the post tomorrow morning, plus to local MP.
  18. Okay, I am out now to show the letter I am sending to my Mum-in-Law, have changed the To.....part for MP, FSA just thinking-perhaps a copy to Citi ( and Vanquis on this issue) might get them to recognise the issue-or am I being optimistic?

Hello, I have spotted that the wording is slightly different to the letter they sent me for my SAR-they did not mention that it wasn`t legally required and they were just asking for their own sake-I wonder...................................is the fact that they are only saying they need it before sending docs out (with out stipulating it isn`t a legal requirement)perhaps a little naughty??? Are they misrepresenting the law???? I will have to check it out-it isn`t the first time they have changed the wording on their letters because they have made a big mistake.
  20. Bit personal this question, but what percentage of the total outstanding is the £190? If it is reasonable then let them take you to court-it`s worth knowing that a bailiff cannot attend your premises without appointment-there is a letter about harassment of creditors on the template thread-it`s a scare tactic, but if you have made a reasonable offer of F&F settlement then let them take you to court.
  21. Bumping for you-but that`s is too legally technical a question for me, I haven`t ever stepped within the front doors of a court before. Sorry. I think if you PM a site team member with a link to this thread they can at least point you to another thread which has the answers you need. The card agreement is the same as the one I have disputed on account of it missing the prescribed term "credit limit", but I am nowhere near where you are at the moment-yet! So as far as the technicalities of it (DCA and such)I don`t know.
  22. Hi, it doesn`t seem to make any difference what it says on their deadlines. I mad a query over two weeks ago now and other than-we are waiting for our specialist department to get back to us I haven`t heard anything except-you`re account is over your limit and payment overdue. Which I think is a bit naughty of them.
  23. I have actually combined the two letters, there are some excellent responses in them both. I am going posting it in a minute. Having read more on the citi issue, it seems predictable that I will have to CPR them and start digging the trenches for a very long protracted battle. I will be getting in touch with the MP and all the authorities-but what I don`t understand is why the OFT and the rest won`t actually DO anything. Looking at the desperate circumstances of some people who come here for help, I`m left wondering -what a shower of sh***! Who are they here to protect? As far as Citi doing the right thing for once, and seeing some of the cases on here, I won`t hold my breath.
