  1. I will go along with varangian - it would appear a deal has been struck to let the banks off the hook.
  2. Started my claim last march so not as long as you, I think we will need a judge with some balls to stand up and be counted although I hate to say it I think a deal has been done with the banks and the courts. We are so near and yet so far, but hang on in there we have come this close, who knows what could happen in the next few days.
  3. Just recieved my letter from YB they intend to apply for a stay, my court date is for next week same day as you, so already sent my objection letter so see what happens from here on in. All good fun.

Just received letter from YB stating that "I should be aware that the Bank will shortly be applying to the Court for an order to stay (put on hold) my claim until resolution of the Banks proceedings with the OFT. As a result, your case is likely to be out on hold until the outcome of these proceedings is known", so that is the state of play with me at the moment.
  5. Come on phoeb chin up at least we are not being hung up by our toes while we wait, use the time to plan how you will spend your dosh, pop down to the travel agents or the car showroom, new bathroom/kitchen the world will be your lobster.
  6. Hi maggie what is the state of play now at your end - did you contact the bank regarding the proposed stay.

  8. Hi alex, myself I put the bundle in order tied them with ribbon ( to much Rumpole of the Bailey) but I am sure elastic bands would be ok. Put into a large padded envelope and sent recorded delivery to Glasgow and hand delivered to the court, hope this helps and the best of luck to you.

  10. It says use the updated application for removal of a stay as part C of the N244 form, so I presume the 2 would be used together..
  11. Hi maggie I dont think you need to send the N244 until the judge has stated there will be a stay and then you send it to have the stay set a side. The N244 and a document you may need by GaryH can be found in the templates libaray try this link Application for removal of a stay. Good luck
  12. In anticipation of a stay being put on my claim I have completed form N244 and draft GaryH set aside document. Should the stay be ordered by the judge at the actual hearing would I submit the N244 etc to the judge there and then or would I need to take it into the court office on my way out, all opinions welcome.
  13. No harm in contacting the court to see were they are up to although I would save my phone bill and not bother with YB as I suspect you would be totally ingnored like the rest of us - only my opinion;)

  16. Maybe someone with a bit of knowledge about law and court procedure may come up with an answer as to which way to go. I have just posted my court bundle and the tought of it just lying on a shelf gathering dust and cobwebs for years, after all the work we have put into it is pretty depressing. But I suppose we need to stay positive and hopefully justice will prevail however long it may take ...
  17. Yorkshire bank is one of the banks involved as it is part of Clydsdale. The suspension of claims may well last until the test case has been resolved, which going by some newspaper could in fact be years from now. The general opinion here seems to be just carry on with your claim unless the court informs you otherwise. Hope this helps..
  18. Are we to take it that as all claims maybe suspended that this will apply to any further bank charges being made on their customers accounts!!!!
  19. You could try contacting the bank again but I think with this test case in the offing the whole claim procedure will grind to a halt and evrything will be suspended...
  20. Yes it seems to be carry on and await your local courts decision to either wait till next year for the out come of the OFT vs The Banks or they may still hear your case on the date you are given - best answer I can think of at the moment:confused:
  21. Just heard on channel 4 news that all claims maybe suspended due to the OFT taking the banks to court - anyone any more info on that situation:confused:
