  1. Hi, 2 weeks ago hubby sent off his forms to his bank, with details of all his charges and asked for them back. Now that 2 weeks is up, we were just going to proceed with handing everything over the the financial ombudsman, as this worked brilliantly with my claim against lloyds. However i now find out about this test case, and think the financial ombudsman isn't dealing with these at the mo, is this right? if so what do we do now. The banks 2 weeks to reply has come and gone, with nothing, and i don't know what to do
  2. I gave my complaint about my lloyds charge to the financial ombudsman, as i didn't feel confident enough about the Scottish small claims stuff. They kindly sorted it out, and the bank made me an offer of the full amount, £892.75, Which i was thrilled about. I worte and accepted the offer. then yesterdayi got a 2 letters from lloyds, one addressed to me, letting me know that £847 will be credited to my account within 10 days in full and final settlement, as i'd agreed. (i'm assuming i'll actually get a cheque as that account is closed) the other letter was to both me and my hubby, and i'm assumed referred to our joint account, letting us know that £45.75 would be credited within 10 days as full and final settlement. now the total is correct, the only hitch is that at no point have i ever mentioned my joint account in all this. I have only sent off information relevant to my sole account, and accepted £892.75 as payment for my sole account. I've tried ringing the number, but the message box is always fulll. I called into a branch yesterday, and they were singularly unhelpful. any ideas what i can do?

  4. how come some claims get settled just like that, and yet some are taken all the way to court? the whole thing doesn't make sense
  5. Hi, 2 weeks ago i sent my bank stuff off to the financial ombudsman. I haven't had a peep out of them. I don't even know if it's been recieved. How long should it be before i hear anything at all? even a 'thanks we got your stuff' sort of thing?

  7. Right. I've read and i'm going to go with the ombudsman. I'm terrified at filling out the form in worng though. (you wouldn't believe i've an MSc in an intelligent suject would you?) i've printed it out, but am not sure about several of the fields. Firstly the address of lloyds bank - is there one in particular - probably not the scottish one posted earlier, as my bank account wasn't held in scotland. Secondly - the date of it - now i am claiming charges from a range of dates do i just sort of fit that in somehow. finally the 'tell us what your complaint is about' do i jsut paraphrase my original letter to the bank, as that puts it quite succinctly? terrified and nervous thanks t
  8. so what sort of timescale would i be looking at for a summary cause action? can i just toddle of to my local sheriffs court? and do i put the head office address for lloyds bank in that box? I never know which address to put for them.
  9. thanks for the replies guys. How do i go about a summative cause action - i've never heard of it before! It is tempting to go to the financial ombudsman simply because it takes the pressure off me, but i want to know all the facts about all my choices before i decide. thanks again, and any info on the summative cause action greatly appreciated
  10. Hi! i'm claiming £792 plus interest back from lloyds. I sent them the initial letter asing for my money back, I got a reply saying that they weren't going to pay me, so i've sent them a letter saying that if they don't pay i'll go to court. that was over 2 weeks ago and i've not heard anything. My lloyds tsb account was opened when i was in england, i've been up here for 3 years now. i've noticed people saying that i shouldn't make multiple claims to get it up to £792 plus interst, and that i should go to the financial ombudsman instead. How do i do this>? is it successful? etc etc etc can i do this now or do i need something else from the bank first? please help! i'm feeling lost!
  11. Hi, Ihave an ongoing claim for Lloyds. I've got to the stage of going to court, and this is where the confusion happens. My account was opened in England, and I moved to Scotland 3 years ago. My bank account never moved to Scotland, this caused all sorts of problems, as there are many things that the Scottish folk cannot do to an English bank account (I had one bank manager up here credit my account by £100 to cover the charge that would go out, because he was unable to take the charge off!) Anyway, I have £792 of claims. the sheriffs court can only accept claims for £750, or do i need to go to the english small claims court because my claim is on an english account? Do i need to drop the £42 to bring my claim under the £750 scottish maximum? why are the scots so tight?
