The problem is that even if I use the Civil Procedure rules to request documents for a proposed action what Natwest are saying is that they simply do not hold records for longer than six years. So whether I am making the request under the Data Protection Acts8) or under Civil Procedure rules for an intended action Natwest will simply respond saying that it is physically impossible to supply the requested information because they don't hold the records.   3. Hi Guys, I understand that the reclaim process began by a university student back in 2005 or 2006 suing Abbey National plc and having his claimed settled. Can someone please tell me if this is true and where I could read up on his story? Thanks. TheyrCriminals
  4. Hi InformedResearcher, You're quite right in saying that the tax payer should have more say in how these banks are run. The fact that banks are still applying these charges and as you say doing so in a moments notice and the consumer is still being forced to pay these charges is totally unacceptable. It is an unfortunate consequence of the very one sided deal that the OFT, the FSA and the banks came to in July 2007 which put the consumer at a huge disadvantage. TheyrCriminals
  5. Hi Guys, Can anyone who has managed to get more than 6 years worth of statements from Natwest Bank plc please tel me how they did it. I know that some people have managed to do this. I have received a letter from Natwest stating that they can only provide 6 years worth. I think this is unacceptable and I know other people have managed to go back further and therefore it appears that Natwest do keep record for more than 6 years. Can anyone help at all? TheyrCriminals

I have been down this road before and even though it is a business account we did rely on one part of the Data Protection Act (1998 ) to force Barclays to hand over the statements (I forget which part of the Act it was) even though it was for a company. This time it is not a company but a partnership business. TheyrCriminals

Hi All, We just recently wrote to NatWest in order to obtain bank statements going back after the 6 year limitation period and Natwest have just sent us a letter stating that they only hold statement data for up to 6 years. I don't believe this as I'm sure I have seen people on here obtain statements for periods after 6 years. Can anyone please advise. Thank you. TheyrCriminals.

  14. Hi, Thank you to everyone who has contributed above. If there any others out there pwith similar experiences or know of any who have had these experiences please post them up, in actual fact I wonder if perhaps an Administrator could move this over to a new thread. My research is taking me to levels I had suspicions existed but now realise there is a very good chance they do indeed exist. As has been stated before it is important before I start filming that I get evidence of bank charges directly contributing to people's suicides. I will therefore be asking an Administrator to see if it is possible to get an announcement made. If not please keep posting your stories up and I will contact you by PM. If I eventually do prove that bank charges have directly contributed to someone taking his/her own life then I believe, as a society, something has gone severly wrong somewhere and I would like to expose this.   16. Hi Guys, I have spoken to some people who have told me that bank charges has significantly affected their finances, in many cases a debt has purely been made up of bank charges. This is becoming an increasingly distasteful experience. As we are all aware this problem has affected many individuals and families and has even directly contributed to the collapse of some small businesses. I must now ask the following question: Has bank charges been a contributing factor in someone committing suicide? Any thoughts from anyone welcome. TheyrCriminals

  19. Hi Guys,Can someone please help me. Some of you will know that I have been posting on this website for almost 2 years now. What most of you may not know is that I am on Year 2 of a Media degree and am currently working on a documentary which is focusing on debt and more specifically unauthorised overdraft charges. I have been witness to various people's stories regarding the impact of these charges on ordinary peoples' lives. This in turn has directly contributed, detrimentally, to the quality of some peoples' lives, often being a major part of someone's debt, and has played a significant part in the closure of some smaller businesses. If these stories are true and that bank charges have played such a powerful role then I would like to hear from people. Ideally I would like to speak to an adminstrator via telephone if this is possible but if not a message to my CAG inbox is fine. I should stress that this documentary is not seeking to examine or comment on the test case itself, it is looking at the human experience of such charges and how they have affected people, their families, the quality of their lives and the impact these charges have had on small businesses.Many Thanks.TheyrCriminals

  21. Hi Guys, Sorry to post this here. But I have asked before and haven't had a response. I have a friend who is claiming on a business account with Natwest. I am fully aware of the business claims situation as regards the test case. However I have been told that in some circumstances some Claimants have recovered charges beyond the 6 year limitation period. I understand it is something to do with concealement, which is detailed in the Staute of Limitations (1980). Can anyone please advise, at least to get the ball rolling with this.
