MTB v Yorkshire Bank
Gogivit replied to alamand's topic in Yorkshire Bank and Clydesdale Bank and Northern Bank
Hello alamand, That is a standard letter you received! We all get them. If you have your figure you wish to claim back I would advise you to make an official claim via the courts. T&C's well regarding them my bank advised me they were destroyed! So I am currently in stages asking who and why destroyed them? Though in my favour if are destroyed because one thing I can state to a judge on oath is that penalty fees were mentioned! -
Fuming at Clydesdales latest trick
Gogivit replied to dc0u's topic in Yorkshire Bank and Clydesdale Bank and Northern Bank
Hello dvOu, Firstly make sure its 1 of 1 pack or it may have 1 of 2! If it is 1 of 1 then send a registered letter to your bank stating this is not acceptable and set a date for them to supply the missing copies. I myself waited for pre 6 years statements to arrive then when eventually after exceeding the statutory 40 days by double, I instead recieved statements that were not the dates requested! I pointed out that they took £10.00 from me to supply the goods and failed to do so instead sending me duplicated copies of last 6 years not pre 6 years. I personally believe this is a stalling process as they are waiting for a presedence to occur... I have now set my own date to seek what was paid for and if not supplied within my time scale I will seek an enforcement from my local court. This tactic by the bank is merely to deter you. Please do not be detered. Set your timescale and stick to it. You are not alone in your frustration. I myself had blood boiling but felt much better after producing another letter for them giving a date to comply but I do not expect a reply but feel for probably a £30.00 fee to the courts I will get the pre 6 year statements and they will know I am not detered in the least. Fortunately the courts have now recognised that the banks are stalling us and thats why we can claim for wasted courts. 2 steps forward 1 step back as they say but you'll get there in the end. -
sococarolyn v Yorkshire Bank
Gogivit replied to sococarolyn's topic in Yorkshire Bank and Clydesdale Bank and Northern Bank
If you told me I owed you £50.00 I would think "what you talking about", the fact these banks offer good will gestures is beyond me! If they feel they owe us nothing then why offer these goodwill gestures? Maybe only coincidental but I received a goodwill offer for £200 on my birthday! Naturally I returned it and pointed out it did not cover general costs for postaage etc let alone the refund of charges in there thousands Please always send letters registered post, is expensive at £3.20 but at least a form of proof you have tried to settle the matter out of court and I assure you without proof they will deny any knowledge!!!! -

SNAP! No not playing dim just hoping to drag things out! Immediately write to them hi-lighting their error and point out the fact that others ( I too am in same position as you regarding pre 6 years statements requested and not received) are aware of their stalling practises and that any response with OVERSIGHT is not acceptable! They are getting tougher on us but we as a group need to be even more tougher! Remember to keep proof of deliveries. -
Beware Of Yorkshire Stalling Us!

Of all my bank charges I have the following entry (only 1 of) that sticks out like a sore thumb. Does anyone know what it means? On the 1st March year xxxx payment was made to my council for the community charge for sum of £66.00 On the 2nd March xxxx £66.00 was coincidently credited to my account. My statement showed the following? 02 March ADJUSTMENT CREDIT 66.00credit DEBIT UNDER ADVICE 33.00debit Does anyone know what the above actually means? Is the Debit Under Advice a manually entered transaction? -
Desperately seeking ...
Gogivit replied to zootscoot's topic in Yorkshire Bank and Clydesdale Bank and Northern Bank
As per one of my previous threads I asked my bank to supply me with my t & c's and the bank worker told me they were destroyed! I have since asked for information requesting who ordered this? To date they will not respond! Could be in my favour? My point is write to your bank demanding them. At least you can show a judge that they have either refused to supply you with a copy or they no longer have them! -

Hello Jenn1irance1, My envelopes have a type of bar code on them but all the same, if they are removing date enties on their communications there has to be a reason. What proof do we have that they reply to our requests within statute time limits? But saying that at least by kieeping the envelopes that accompany the goods judges then I am sure will find it unusual practise for a supposedly professional company to send out documents with no date reference. -

Do not be detered! Demand all your statements after all you requested them and they cashed the cheque so to me that is an agreement! -

Wobbles5063! Yesterday (Saturday 23-06-2007) I have made a formal complaint to Yorkshire Bank about the issue you quote (back to back) statements that is not easy to follow! I have copied my MP who is very interested in my case. I suggest you complain too (can only be a good thing as a judge will not be too happy with this latest tactic by Yorkshire Bank) -
All, Please do not phone these people. From my experience is best to send letter by registered post. Also keep a receipt for all expenditure! The banks can choose to ignore you but at least you can prove to a judge you have attempted to get what you seek whereas the bank will be shown to be non complient and ignoring you and waisting time!

Beware Of Yorkshire Stalling Us!
Gogivit replied to Gogivit's topic in Yorkshire Bank and Clydesdale Bank and Northern Bank
Ok guys and girls, I am now ready to take the plunge! Having experienced so much crap from Yorkshire Bank I have decided that I now seek contractual interest on all my charges (I know this is a gamble but it is one I am prepared to take) I am also seeking wasted costs and seeking refund for stationary, letter preperation and other costs. Is there anyone who can explain to me in laymen terms about contractual interest? For example: On the 7th January 2001 I received a £32.00 charge for an unpaid direct debit? -

Maybe a slight error on my part however they cashed the £10.00 which to me was an agreement to supply me what I requested. The fact they didnt gives me a right for address! -

Many thanks Paul. I think I have covered this in my letter posted today. -
Oh I forgot to mention that as no date was mentioned on the covering note I am keeping the envelopes that the statements were sent in as maybe the bar codes printed on the envelopes by Royal Mail may be proof of delivery date and in addition I have left the paperwork in the order recieved so that I can demonstrate to a judge that they have printed them in a a strange way that had I wanted them I would not have been able to match them up without at least spending 60-80 hours on them (fortunately my original set was recieved in a correct manner) AND FINALLY WISH ME LUCK AS IM NOW GOING FOR CONTRACTUAL INTEREST AND I FILE MY FIRST COMPLAINT IN NEXT 2 WEEKS

Hello Leebcoward, From my experience be aware of the following: During February period I received 6 years of statements from Yorkshire Bank for the period 2001 to 2006. The statements were received with just 1 day before the 40 day deadline! On March 30th I sent another request for statements for period; from date of bank opening until December end 2000. The bank took payment, several weeks later advised me due to heavy work load there was a delay. However 81 days later on 21st June I received pack 1 of 2 containing... part statements for the period 2001 to 2007! then yesterday pack 2 containing about 6 sheets for 2007! SO THEN, THEY HAVE TAKEN £10.00 FROM ME AND SUPPLIED INCORRECT INFORMATION! Now the interesting bit.................... Upon opening the packs-The statements are printed double sided. One side contains April transactions, the other side June advice on charges / transactions. In effect they have produced them in a way that will be extremely difficult to decifer! In addition to the above, the covering letter that comes with each pack contains no date and no name from the person who sent it (my original packs from February period did) and simply says: "In any future correspondance regarding the contents of this pack please quote reference number XXXXXX(I am not disclosing actual number just to be on safe side) However in Summary, From date of cheque being cashed for statements covering 1993 to 2000 period I am in turn given 2001-2006 period. The statements were received 81 days after cheque being cashed. They certainly know how to drag things out! I now have to repeat the process all again however having wanted to include pre 6 years claims with current 6 years I will now have to proceed through the courts with 2 cases and not one as I was hoping. However it can not be denied I have tried. So my reason to write to you is simply to say that on your cover letter you want to send, please mention that you are aware that other people being processed pre 6 years are receiving current 6 years statements and that you will not tolerate any oversights! Simply hi-light your dates wanted.ie I requested statements from date of the opening of my bank account until and including December 2000 Hope I have helped. Lee

Beware Of Yorkshire Stalling Us!
Gogivit replied to Gogivit's topic in Yorkshire Bank and Clydesdale Bank and Northern Bank
This is what I wrote (so maybe others do not make same mistake)? Dear Sir or Madam, Re. Account number xxxxxxxxxxx sort code xxxxxxxxxxxxx I am writing to request a fully comprehensive list of all default charges for direct debit, unauthorised overdrafts and standing orders I have paid from the period when I first opened my account to the period of 31st December 2000. Was this no good then? (so others do not make same mistake)? -

Having requested my statements for the period (start of account to 2001) I have instead been issued with duplicate copies for the period (2001 to 2006 which I already have)! It is interesting to note that the headed paper that accompanied the copies has no date reference. OBVIOUSLY A STALLING PRACTICE BY YORKSHIRE BANK! Once again I will be stalled for another 6 - 8 weeks.
