  1. Moorcroft or Debitas by any chance? No cooment on their content, this is the 4th DCA barclays has passed the debt to. By my reckoning i wouldn't think even barclaycard has got a copy of the executed agreement, just a thought though. :D

Sent a CCA to this lovely bunch of daffodills:rolleyes: recorded and that, re a barclaycard account that keep bouncing from DCA to DCA.:o This morning a letter with a lot of tick boxes: "We are no longer instructed on this account. Please referto our client directly":???: This arrived after they threaten me with court actions. I will fire a SAR to barclaycard first thing on monday and TAKE THE BARCLAYBULLY BY THE HORN.
  4. my partner had the same treatment from moorcroft stick to your timeline not theirs. in my opinion it is highly unlikely they will came up with the goods. keep us posted and we will help you.
  5. Ukaviator thanks for info, i am doing exactly as you suggested. I also forgot to say that i ve sent a CCA request to Debitas so them toohave got a deadline to respect yet they threaten me with possibility of court(i really want to see their faces trying to explain that to the judge). Also i am making a token payment as well, although they say is not acceptable i am still making it(hopefully the same judge will not punish me....too hard:D ). Since all the calls stopped the debt situation seems more manageable than before.
  6. Choose to refuse is amazing. I was getting too many call from 2 companies cap1 and debitas and since blocking their number the phone hasn't rang for the past fortnight once. The number to call is 14258 and then insert your pin and you can block the number
  7. Thanks DD On the 14/03 i will fire a nice letter asking them politely to take a hike. What puzzle me is this timeline: Debitas letter requesting payment 18/02 My reply with CCA request 21/02 Debitas letter requesting payment 25/02 My reply with account in dispute letter 27/02 Debitas letter contemplating issuing court proceding 06/03 My reply with account in dispute 07/03 I am still waiting fot the CCA and yet debitas wants to take me to court? That'll be a laugh debitas trying to explain to the judge why they haven't complied to my request!
  8. enaid i ve spoken today with RM and after sounding rather sarcastic( not rude mind you!) i ve finally got what i was looking for. All my letters(includind b'card) were all delivered
  9. this strange bunch are a bit clueless. Sent a CCA request on 21/02 re cap1 credit card debt and today i received a letter saying that they are contemplating court action, i should call them to agree a payment. I was on the impression that until they produce the credit agreement they could not take me to court? today i have sent another letter spelling clearly this account is in dispute. By my reckoning times up on 14/03 (12+2 working days)and if they fail to provide the agreement they have defaulted and 30 days(14/04?) they have committed an offence, have i got it right?
  10. In my honest opinion if the debt is older than 6 years it should be statute barred and should be unenforcable not even if it goes to court. I hope someone with more knowledge could confirm this.
  11. Sent prelim letter on 01/03 recorded of course. Received a standard reply today 07/03 saying it'll take them 10 days to investigate... errr no! on the 15/03 i will be sending the LBA. Time is running out FD, i am not interested in your very nice and colorfull leaflets....
  12. UPDATE The very nice(not!)people from DEBITAS are now considering court actions as i failed to contact them about making an offer of payment. What they did not mention is the letter i sent them saying this account is in dispute as i am taking steps to reclaim the charges cap1 applied to my account. it clearly state to withold any legal action until the dispute is resolved. and no word from cap1 re: SAR. Any suggestion on what to do next? Thanks
  13. i do understand your situation as i had a different problem. A 53 reg car still under warranty with less than 35k miles going into early head gasket failure:x As you can guess i was fuming and after kicking up the worst stink(complained to TS Fiat UK and the rest) they fixed it but still maintain the position as this is not covered by warranty and that blah blah.... Looking at every receipt i have in 2 and half years i had the car its been a staggering 52 time back into the dealership for various repairs. My advice make a fuss, someone is going to listen
  14. Update sent 7 letters on 26/02 all recorded(3 SAR + 4 CCA) and they were all delivered the next day 27/02 some as early as 7.48am:eek: I wish my postie was this early, usually my post get delivered 12.45pm-13.30pm:(

  16. lisa don't forget when you send a CCA request the 12 days(+2) are WORKIND DAYS, unfortunatly these peoples do not work on saturday and sundays like the rest of us
  17. IMHO it would be worth it as well sending a S.A.R. (subject access request) to the original creditor to check for unlawful charges(same process as bank charges) and you might be surprised how low your debt becames(it has happened to me, the charges outweight the debt). If the original creditor has "sold" the debt try to get the info on who they sold it to. If the DCA name your dealing with cames up ask for a true copy of the Deed of Assignement. Hopefully someone else with more knowledge will correct me if i am wrong.

  20. scarlett that was my plan of action but as i cannot locate my agreement this has to wait. i am not too sure about the charges so please don't quote me on this. Maybe somebody else with more info could add to this?
  21. thanks lbl that opened my eyes. i think when i bought my car i thought i had a hire purchase agreement, reading that i more than enough sure that i have a credit agreement for the car. unfortunately i cannot speculate anymore on that as i cannot locate the document...

  23. Djdave i had the same with a b'card so far a staggering 4 dca have passed the debt round the moment i sent them a CCA request. the latest was in fact call serve and they still haven't produced a CCA. so i will wait and see
  24. If that gets passed there will be a new meaning of the word violence. I hope i am mistaken but there will be nothing else stopping this thugs and the actual regulator of the bailiff's companies are just another puppeteer. i hope we could do more to stop this process.
