  1. Asking the question on behalf of my son. My son lost his job in November 2004. He would have been sacked as he had left a duty unfinished which was against the rules and instead of owning up he tried to cover his tracks as he was embarassed about it. At his disciplinary hearing he resigened rather than being sacked. He got a wage paid into the bank each week for the next 4 weeks. He was unsure as to if it was pay in leiu of notice or holiday backpay. he was also paid a week in arrears so for the first couple of weeks he didnt think it was odd. When they paid him for the 4th week he rang them to query the payment. They told him that he had been overpaid and that he would recieve a letter telling him by how much. He never had a letter and so never bothered about it again. He has now recieved a letter saying that they wrote to him in November 2005 (which was a full year later) saying that he had been overpaid by over £1000 and that they had not recieved a reply. They now say he has 14 days to repay the money and that if he cannot afford to pay it all at once he can pay back £50 per week. He is out of work at the moment and so cannot afford payments. He hasnt got the payslips and so cant remember what hours he was paid for or what holiday pay was on them so has no proof as to how much he was paid. When he rang them to query the letter he was told that they paid him because HE failed to notify the wages office that he had resigned, surely that should have been up to the personel departmente. Is it right that after two and a half years they can now demand money back?.
  2. Just a quick question please. I have sent off my letter requesting my charges be returned. The 14 days is nearly up so I have my LBA ready to go. I was wondering how they make you the offer, I assume it is by phone. I am at work all day so am i correct in thinking they will call in the evening or should I be ringing them with a mobile number. Its not really convenient for me to take calls at work but I dont want to miss it of they do ring to settle.
  3. I think you hnave misunderstood my posting Buzby. The Royal Mail are not at fault. The bills have been coming to my current address for the last three and a half years but suddenly 2 months ago the Virgin system reverted to my old address and thats whre the last 2 months bills have gone. Virgin CS cant explain why that would happen, in fact she says it is impossible but when she told me the postcode they are going out to and the address it was our old house. I have been getting my bills at the new address every month since we moved here.

Got through to them today and after being told that 'I must have recieved my bill' (I have not), 'It must have been put through the wrong door by the postman't (Er no, I live with him) we finally managed to sort it out. When I initially got through I was asked to confirm all my details inc postcode, password etc. After the debate I was put on hold for a few minutes whist she 'looked into it'. She came back to the phone and said 'Your postcode is B** 3** isnt it. I told her it wasnt and that she had just asked me to confirm my postcode at the beginning of the call and that wasnt the one I gave her. However the postcode was for the address we lived at 4 years ago. She then informed me that they had a billing address for us and an installation address and because of this all my bills had been going to the old address. I told her that it was only during the last 2 months that we hadnt got the bill but she told me that the bill had been going to the old address ever since the package was installed at this house. Even though I told her that I went through the bill every month as it was itemised and it definatly has been coming to this address she would not have it. She said it was impossible for their system to revert to the old address once a new one had been set up. Obviously all those NTL envelopes that have been coming through my door for the last 4 years were a figment of my imagination then.
  5. Customer services were unhelpful when my partner rang them straight after getting the call from the debt collectors but that was because the bill is in my name. They wouldnt tell him how much we owe even though he knew the password for the account etc. Since I got home from work I have tried to contact them but there is a recorded message saying the system is down, please try later. I cant understand why they havnt just cut us off
  6. Absolutely no change in the service whatsoever apart from some of the channels going, but that was because of the Sky change. There have been no reminders, letters , phone calls or anything which is strange as like you say I would have expected them to threaten disconnection.
  7. I have been with NTL for years and since the change to Virgin Media I have never had a bill. I tried to ring them 2 weeks ago, firstly to report that the box was not working and also to find out why no bill had arrived for 2 months.I gave up after holding for ages and being told I was in a long queue. I know I should have tried again since but just have not got round to it. Today we have had a call frm a debt collection agency saying they are ringing on behalf of Virgin media about non payment . Surely there should also have been a reminder as well as a bill before they put it on the hands of a debt collection agency. When we rang Virgin they insist that they have been sending bills out. As my other half is also our postman we know there have been no bills addressed to our house. Its strange because NTL bills were always on time. Has anyone else found they are not getting thier bills?
  8. it wasnt a current account, it is just a bog standard debit card account. I never had a cheque book for it and have no recollection of these £5 charges. Obviously I must have known about them at the time and find it odd I hadnt queried them. I have checked them against the statements I got today and have noticed that on 2 occasions I had been in to the branch to complain about the charges and they reversed them. The statements show the money going back in. However the sheets they sent me with the total charges added up by themselves dont show that they were reversed. Therefore when my request for repayment is sent off tomorrow I am sending them a copy of the sheets they sent me with their total on rather than doing the spreadsheet. After all, how can they argue that its incorrect if they have added it up.
  9. I rang the Halifax yesterday to complain that I had not recieved what I had asked for and guess what! TODAY, I got a full set of statemnets going back to 1992. The bad news is that I only seem to have incurred 1 charge prior to 6 years ago. As for the list they sent you and I, i checked mine against the statements and they are correct. I thought I would have had so much more to claim back than I have so am slightly dissapointed but never mind. One thing I should mention though, when I checked them against the statements ther are 2 instances were I had complained to the Halifax at the time and had the charges reversed. On the statemnets it clearly shows this, but, on the printed sheets they sent me which they have totalled up the reversed charges are added on. So, if they insist they owe it me, who am I to argue.
  10. Well, Im amazed. Today, less than 24 hours since I rang the Halifax, I recieved a full set of statements going back to the opening of my account in 1993. That was the good news! I thought I would claim back further than the 6 years but was really dissapointed to find that prior to 6 years ago I only incurred one charge. One thing I am confused by though, it seems that during 2001/2002 I incurred a charge of £5 every month and always at the beginning of the month. I was never overdrawn at that time so cant understand what the charges are for as it only says 'charges as notified'
  11. I rang the Halifax yesterday as I has been sent 2 sheets showing charges and NOT the complete list of transactions. Today I got a full set of statements from when I opened the account in 1993. Amazing how I had to wait 50 days for them to respond to SAR and yet they can post me out a full set of statements within 24 hours of complaining.
  12. Please dont send this, stick to the timescales and letter templates given on here otherwise they wont take you seriously. they shouldnt be given 8 weeks, you are letting them know you can be put off.
  13. I have been sent a sheet of charges but not a full list of transactions as requested. I rang them today and after 3 attemps finally got through to someone who seemed to be trying to be helpful. She told me they are sending out lists now instead of statements because it is faster and also because they are doing them free now!!!!! I told her that I had paid £10 and wanted what I had requested, she said she will print off a full set of statements today and post them straight out to me. She also told me that they hold statements from the opening date of the accounts so thats what I am getting and may try to claim from day one.
  14. I rang the Halifax today about my statements. They told me they hold them from the opening date of the account and are sending me a full set. Im tempted to go for the whole lot, Im just a bit unsure as its a bit untested and I dont want to end up being greedy and not getting any back.
  15. I rang them today and was told that they are now sending them out in this format to 'help people' and also because they are now being sent out free. There is no charge for these. I pointed out that I had paid for mine and would like the full information I requested. With these sheets there is nothing to say what the charges were for so its impossible to fill in the spreadsheets. The good thing about it though is that I spoke to a lady who was really helpful and has promised to send me a complete set which should arrive within the next couple of days. She says they can send them out from the opening date of the accounts so I am going to claim further back than the 6 years.
  16. I did have cover and have been paying monthly for it, I have had no claims. I cancelled it because I was so annoyed at them taking £25 for the failed direct debits. I know thats my fault but its still a lot of money for something like a failed DD. I have written to them to ask them to break down the final cost so I know what they are charging me for and I also asked them to deduct the £50 they had taken off me unfairly from the sum owed. They have not replied at all but have put it in the hands of a solicitor who has written to say I have 7 days to send payment. The company are called ITS 4 ME.
  17. I think i will ring them tomorrow and also go into a branch and say that I want the complete list within 7 days or I will persue it through the courts. I dont want to go through the whole 40 days thing again, it took 56 days to get this far.
  18. Hi Lulu. I have had the same thing happen to me today. I have been given 2 sheets, which I had to go and collect from a branch I never use!. these show the charges, but like you its nowhere near what I thought it would be. I have waited 56 days for this info. Mine dosnt even show what the charges are for. Have you spoken to them since posting this. I dont know if I should accept it or get back in the queue and wait again.
  19. At last today I have got my statements from the Halifax. BUT- what they have sent is 2 sheets of paper with a list of charges on and they are totalled at the bottom. Firstly the figure they add up to is £620 which is nowhere near what I though it would be. Secondly, at the side of each charge it just says 'DR' so Im not sure what the charge is for. Also in 2002/2003 there is a charge of £5 at the beginning of each month, again with the letters DR against them, them at the end of 2003 the charges suddenly become £30 or £28. I have 2 accounts and these £5 charges only appear on one of them. There are also a couple of £30 charges with no letters against them so again I have no idea what to put these down as on the spreadsheet. From reading on the threads I was expecting to have to go through my statements highlighting the charges but these are just 2 sheets of printer paper with what it says are a list of '94D' charges incurred. Does anyone know what the 94D is please? Has anyone else beeen sent these instead of statements?
  20. I twice had my direct debit fail on my car insurance. Each time the company wrote to me and said they would take the direct debit again in a few days but that they would also take an extra £25 admin fee. I then cancelled my direct debits so it could not happen again and also wrote to the insurance to cancel the policy. They have now sent me a final bill for £77. I refused to pay it unless they told me exactly how the £77 was arrivede at and also pointed out that they had taken £50 off me unfairly and so I wanted that deducting from the 77. I had no response but now have had a letter from a solicitor saying I must pay within 7 days or they will take further action. Shall I stick to my guns or should I pay up? Any advice would be welcome. Thanks.
  21. Things are progressing at last. I got a letter today saying my statements are ready and waiting for me at a nearby branch. Its not a branck I ever use as its not in my town but I can pick them up. Something to do with the address they hold is not the address I now live at so I have to go in with proof of ID. Didnt get the letter till I got home from work today or I would have gone straight for them. Now Im a bit naffed off because its bank Holiday Monday so have to wait a bit longer. Still, roll on Tuesday.
  22. I didnt realise you could only use one thread, sorry. But in each thread I have said that I have sent off the letter of non compliance. I was trying to get advice about the actual procedure when you have taken it to court. I assure you that I am taking it very seriously But as I have said I spoke to someone at Halifax who said I would not get the statements any faster by using the court and of course I would incur a cost as well. I was just looking for anyone who's in the same position as me to give an opinion if they have had to go to court fot the statements.
  23. I have sent the letter of non compliance. The time for that to be actioned has sxpired. What I am trying to find out is, how will it benefit me if I start court action as I still dont know how much I will be claiming? Am I not just going to prolong the situation even more.
