  2. Hi Shane, Thanks for the reply. At the moment we will probably have about 23,000 equity in the house provided we get the asking price we are hoping for. Im sure there are penalty charges on most of the accounts but as in my last post regarding the Halifax credit card I cant afford to take a claim to the court stage because of the costs and I feel that because we owe them money they will just call our bluff and push us all the way knowing we cant afford to take the final step as the Halifax did.
  3. Thank you Tiglet. Im really confused by this CCA request thing. I did do it with my Halifax account and my charges came to over £1000 but I fell at the last hurdle because they took it to the court stage and I couldnt afford th £120 to go the whole way and am not entitled to it FOC. This thing about them having the correct paperwork confuses me because even if they dont have it what do you do? Do you still have to go to court yo argue it out because if you have been making payments then surely that means you have been acknowledging a debt which you are now disputing exists. Also if do I work out which are unlawful charges on the loan are they not just going to call our bluff on the premis that we owe them more than they will owe us.
  4. Im sorry this is a bit long but I really need some advice. We have a lot of debts and have been to the CCCS and done all the usual income/expenditure form filling and sent copies off to all our creditors. We have also have had the building society try to repossess the house although that has been suspended and we have it up for sale at the moment. Our plan was to sell the house and then make offers to each creditor to see if we can make reduced offer settlements. Some debts are mine and some are my partners and all of the companies have accepted reduced payments for a while and all but one have suspended interest. This is where we have the problem, my partner has a loan and a credit card with Nationwide which together come to just over 20,000. His credit card had a balance of just over 4,000 and even though he obviously no longer uses it they have added interest and charges each month and so now the figure is nearly 8,000. Nationwide have been inflexible from the start even though he has continually made reduced payments regularly and did inform them of the problem right at the start. On the loan they did accept a smaller payment which they said they would review after 12 weeks but during this period they twice took the origional amount from his bank without any warning which again caused him a £38 charge each time for the direct debit failing. They did agree that they should not have tried to take the larger sum as they had agreed smaller payments and promised to repay his bank charge but it never happened. Yesterday he got a letter from a collection company and he rang them this morning. The woman he spoke to said they want over £150 extra each month. He told her that we do not have the mney and so cant promise that. They admitted that they had his income/expenditure form in front of them and could see that there was no possibility that he could increase the payments, however they said he must find a way or be taken to court. He told them that they would have to take him to court then and that he would show that he couldnt afford any extra and that he had always made a payment every month and so was doing his best. They told him that they would take him to court and have a charge put on the house. The problem is that if they do this it will mean that ALL the collateral in the house would be eaten up by them. Our plan was to distribute the collateral between all the creditors to try to get back on our feet. We thought selling our home was a last resort but would allow us to make some headway to becoming solvent again. Can they do this when we have other creditors? As the house is jointly owned and the debt is my partners are they entitled to my share of the equity? There really is no point in selling if they are going to take it all and by the time we get a sale they are going to add court fees and more interest and we could end up with negative equity. Sorry this is long winded but can anyone advise please. Thanks
  5. Why on earth would Ebay stop the practise. They make a fortune in fees from the sales. The higher the bid, the more Ebay get. I dont think its fair but thats life. Having a picture on the tickets would not help because many tickets are bought for other people as presents.
  6. We are in the same situation with Swift. We borrowed £16,000 18 months ago (worst thing we could have done) and the monthly payment on that loan and the mortgage have risen so fast we are now having to sell the house to get rid of the debt. Swift will be taking the loan figure back plus half the collateral in the house as the figure they want for settlement is one and a half times what we borrowed. Its basically legalised robbery.
  7. PS, sorry Powell. I meant to mention, OH is working, we have no other assetts and have debts totalling about £50,000 with only about £30,000 equity in the property. Also when we sell the house we will need to use some of the equity to get rented accomodation.
  8. Thank you for the replies. We have been to the CCCS and they advised us to sell the house at the beginning of the year but we did try to hold on to it before finally admitting defeat in September and putting it on the market. we have the mortgage and a secured loan on it which we would be able to pay off comfortably when it sells. Our other debts are 2 loans which my partner had when we met as they were taken out for his former partner and also we both have credit cards which we have got agreed payments on but they are all still adding interest even though we have sent them all a statement of earnings and income/outgoings. The thing is that we dont mind sharing out the equity across the debts to get rid of some of them but we dont see an 'end' to the situation which is why we thought about considering bankruptcy once we ahd no home they could take off us. But as I said it wouldnt be suitable for me to take that step as it would impact on my business which I am working really hard at to try to get us back on our feet and get some quality of life back.
  9. My partner and I have a lot of debt and are doing our best to sort it out. We also have a large mortgage and a secured loan which we are struggling to pay. Our house is up for sale at the moment and when we get it sold it will help pay off a lot of our debts. The problem is that both myself and my partner have individual debts and there wont be enough equity to pay everything. Would it be possible, or even sensible, for us to clear the debts that are in my name with the equity (which technically is mostly mine as I put down a large deposit on the house when we bought it) and then for my partner to declare bankruptcy. Even after selling the house we will still be making substantial payments out each month as even though we have been to the cccs and made payment arrangements with out creditors most are still banging on huge amounts of interest each month and we will also still have to rent. It seems to be a vicious circle, the more we try to solve the problem the worse it gets. Would it make sense for him to declare himself bankrupt, I have a small business so I dont want to put myself in that position but he is fine about doing it if it will help solve our problems. Its just that Im not sure about the pros and cons, I tried looking at the bankruptcy thread but it looks very complicated and I would just appreciate it if anyone could put it in a sort of compressed laymans version or advise from experience.   11. My sister runs a shop and wants to get some Gift Vouchers to sell to her customers. She has enquired at the local printers but feels she may get a better deal with a larger company online. However we cant seem to find a website selling them. If we input 'gift vouchers' we get 'Argos' etc and if we put in printers we get loads of stationary printers but none we have found seem to do gift vouchers. Can anyone recommend anywhere please?

  13. Please HELP! Am panicking a little now as I just found another thread where someone paid back a Swift loan after 2 years. In this case he borrowed £4000 and had to pay back 8,500. as they said they did not do early redemption. If we have to pay back double what we borrowed we will not meet it by selling the house. There isnt enough equity there.

  15. Thanks for the fast response Gizmo. The only figures on the agreement show what you would pay back if a quarter, half or three quarters of the term have passed. Obviously we are only 2 years into the term so they dont help. We have written to them twice, recorded delivery to ask for the figure but the only letters we get back are ones telling us we are behind with payments and now this one from a solicitor telling us we have to pay within 14 days or they will take us to court. When we ring them they tell us we need to put the request in writing, we are just going round in circles. we have written to say thet the house is up for sale and therefore will be paying off the loan but they dont respond. Is there a legal limit to the amount they can take back on top of what they loaned us or can they charge anything they like.
  16. We stupidly took out a loan with Swift which was secured against our home. Of course we are now behind with the paymnents for a number of reasons and they wont help in any way and have now sent a letter from a solicitor. We have put our house up for sale so we can get rid of the loan and our other debts. We have only had the loan for 2 years and are 3 months behind with payments. We borrowed £21,000. We have asked then twice for a settlement figure but wont quote it over the phone and have ignored 2 written requests. Has anyone had experience of payibg back a secured loan when the term is nowhere near finished. Are we likely to have to pay back loads more than the origional £21,000. We know there will be charges on because we are behind and also that we will have paid very little off the original balance but does anyone have a clue as to what they may take from us on the sale of the house?   17. Thank you for the help and for the link. Sorry for posting on 2 threads, my mistake! When we made the offer to pay we knew we were scrimping to raise it. I havnt worked for the last 3 months because of a broken hand so we have had very little coming in. Once I start the new job we will be able to afford the payments easily. Its just that I wont have an income for another 4 weeks.

We are in arrears with the mortgage. 2 months, but because of the added charges going on each month they say we now owe £2100. If we cant find it in 7 days they begin court proceedings. Of course we cant find it and when I last spoke to the Abbey she told me that if we made a payment of £400, which we did it would not go to litigation last month and then if we pay £500 by the 13th of this month it would not go to litigation this month. We havnt got to the 13th yet and I have got the letter this morning. It says not to contact them but to wait for another letter. Im terrified of losing my home and dont know what the next step should be as I cant find £2000 in 7 days. I start a new job in 3 weeks and was hoping we could hold them off until then. I have been renting a small shop which I ran as a shoe shop.I got into difficulty about 6 months ago partly because the landlord let another shoe shop rent a shop 2 doors from mine and I couldnt compete price wise. I told him I was having trouble raising the rent and even though my lease has not run its course he told me to advertise for someone to take it over. I did this and someone takes over next month. However I owe nearlt 2 months rent and he has just told me that if I cannot pay it at once when I vacate the shop I will not be allowed to take the remaining stock or the fittings which I paid for. I have advertised my remaining stock on ebay and sold it as a job lot to recoup some money as I need it for my mortgage next month having no other income at the moment until I can get a job. I have told him I intend to pay the arrears as soon as I can get a job but he says that is not good enough and it is 'in my best interest' to pay him immeadiatly. What are mt rights please?
  22. Can anyone answer this please? If a person pays child maintenence (sorry, put benefit by mistake in my title) to an ex partner but then has the child to stay for a month during the summer, do they still need to pay the maintenence for the period the child is staying with them? Can anyone give me a link to information about this please. I have looked on the CSA site but cant find anything relevane to this question.
  23. The thing is that an adult can make the decision to change a name. In this case the mother has done it out of spite. As she said, shewants to remove all trace of his father from his life. She will not suceed but she is ebbing away bit by bit.
