  1. Ok, so if i dated & sent cca on the 5th, was a wed - 12 working days after = 19th (today) +2 for postage = acc in dispute letter can be sent 24th (mon)? I realise am really thick sounding here, but i was getting a tad excited bout being able to send next letter this week, under the impression it wasn't only 'working days' lol, spesh as they didn't seem to have many qualms about contacting us every weekend by letter & phone ! Have gotta hope they don't send anything now for next few days, doh! Fingers xed eh! Many thanks Cym! x ps. didn't know bout no more 30 days counting - nice one!
  2. Evening peeps, Hope all are well? Just a quick query please - The 12+2 days...Is that incl weekends or purely 'working week' days? If is the former then Cabot's time is up tomoz so am not sure what the next step is please? Is it an 'acc in dispute' letter i send or another cca type reminder or something? Also, when do i stop paying them their monthly payments? Is it after this initial 12+2 days or is it after another 30? Would be so very grateful if somebody could clarify please? Haven't been able to get online for few days due to youngun's being off school with this horrid bloomin tummy bug that seems to be going round, doh! Is mighty quiet tho No post OR phonecalls from any creditor/DCA since the 13th!!! My quietest week in months (years?)!!! Thankyou fellow caggers!!! Take care all, Jx

  4. Just received reponse from Lowell to CCA, States, "We are requesting a copy of the agreement from the original lender with whom you originally entered into the agreement. While we endeavour to reply to you with the required info within the prescribed 12 day period under the CCA you will appreciate this is dependant upon receipt of the info from the original cred" I'm thinking 4 down so far all 'requesting' info from original lenders - 3 to go! Am beginning to actually feel a bit excited to see the postmen now & wondering what piece of crud will fall on the doormat next! Hi PGH, No is: 01202 415780 so don't no but is no prob - will just keep screening the calls. Am adamant not to speak to any of these sods on the phone again thanks to the brill advice received from fellow caggers! Thanku muchly tho!
  5. Hi blind-as-a-bat, I sent my CCA request to littlewoods/NDR last week on the 7th & no reply as yet, so am going to check tracked receipt on p/office site in mo. As far as i can gather, darryl may be right because any corr i have been getting statements etc from NDR & Letters from littlewoods at same time & one in particular few wks back re, default sums notice from NDR but with littlewoods addy on! Anyways, i sent CCA to l'woods add (aintree innovation centre etc) - if no response by time up then will pursue it & poss send one NDR addy too. gd luck hun!

  8. Hi peeps, just an update. Mine: Cabot CCA sent 06/11 - fee returned 10/11 they app requesting info from orig lender (Littlewoods cr cd). Cap 1 CCA sent 07/11 - No reply yet. Fredrickson sending CCA asap! Hubby's: Cabot CCA sent 07/11 - fee returned 11/11 they app requesting info from orig lender (Morgan stanley - (lol, ZACKLY same wording as my standardised templated answer). Cap 1 CCA sent 07/11 - no reply yet. Debt managers ltd CCA sent 07/11 - fee kept 13/11 & app requesting info from orig lender (Next). Lowell CCA sent 07/11 - No reply yet. Just wanted to keep you all up to date so can (hopefully) pick your brains later on in the procedure Also - don't s'pose any of you recognise a tel no beginning 01202? We have been screening our calls as had enough of 'numbers witheld' putting phone down on kids etc when they answer but didn't recognise this one and don't want to answer those we don't know. Plus it only started calling in last few days since sent CCA requests so kinda assummin is a DCA. Anyways, yep i'm prob bit nutsy for asking but you never know - doh! Hope everybody is keeping well! Snagpuss, i have a thread re cabot too, have today received standard template stating they not obliged to send me cca & have forwarded request to original lender etc & ave returned my £1 blah blah. Am sooooooo hoping that they can find it in their hearts to offer me the same deal they have you! Oh, what a merry crimbo that would make! Gd luck, well done & take care. Jx
  10. Hi Pookey Mr T - Thanku! Can't believe they have gone a full cycle on you & are back to the original letters! Am i right in thinking that i do not have to pay them if they can not provide the cca? Wasn't sure if yes & if so whether is after the 12+2 days or the following 30 days? They are only getting £11 a month at the mo (pro-rata payment), but would be very nice to think that that 11 squid could go towards a new winter coat for one of me littl'uns if you know what i mean! "Cabot are in no position to issue out instructions to debtors :rolleyes:" is an ominous but lovely positive satement Mr T! Made me smile (not often THATS been happening with all these dca stress lately!). Thanks again. Jx
  11. Hi S, Thanks loads - was worried that i had to repeat cca request or something as they returned the postal order etc. Will sit back and wait another week or so then & see if they send ir thru!! Thanks again for prompt reply. Jx
  12. Afternoon everyone, Am at another stage already & am grateful for any advise if poss? Got reply already from cabot re my cca request sent to them last week, stating: "acknowledge receipt of your request. .....The cabot financial group are not obliged to provide this info but are pleased to help & have already requested documentation from original lender... ...cabot financial does not accept the statuory fee required under section 77 and/or 78 of the cca '74 & as result have returned the fee received.... ..We anticipate that we will be able to provide this info within the 12 days. In the event that we are unlikely to obtain this info within those time limits we will write to you again." Seems like a standard reply some people get (gathered from a few other threads), but dunno what to do now as they have returned the postal order i sent & am presuming that if they dont accept it then they could say i never offered it or something along those lines?? Is there another letter i need to send maybe with the postal order again etc? Still nomore comms regarding the full outstanding balance that they are apparently expecting after supposedly terminating my agreement? Any help/advise most def appreciated please peeps!   15. Evenin all, I'm hoping to be able to blame the cag if can be successful against mine & hubby's dca's!! Have just sent cca requests to all those that have 'bought'/'taken on' our acc's & am waiting to see what kind of reponse (if any) we may get. Is soo soo scary just standing in the postoffice asking for the postal orders to send etc, wondering whats gonna happen in the next stage, if u know what i mean, but also quite satisfying that i can log on tonight for instance, & have a chuckle upon reading this thread whilst feeling a lickle bit of pride & hope for the 1st time in i fon't know when!! (Corny or what !) Anyways, nuff of that! Just wanted to say thanks & keep doing what every1 is doing cos ur all doing us proud! Take care, Julie x
  16. Hi Elaine - How r u? Have sent cca request to all creditors that have had our acc passed to & are now getting pooey - so will see how we go. Cabot should have had theirs by fri (am gonna check tracked sig etc in min) so am waiting for reply. Have had no more letters this past week but a few calls where the other end goes dead the min once of us says hello - happened to our eldest daughter (ten yrs old) a couple times & freaked her out a little bless her but 1471 just tells us number witheld/unavailable so we are guessing is either cabot or ndr who are the main 2 at the mo causing us grief! If carries on we thinking of just getting bt to change our tel no - that might pee em off (u can always hope). Anyways, just thought i'd fill u in. Take care hun, Jx

  18. by all means but to be honest i haven't tackled em yet myself - am gonna start tomoz by sending em the cca & £1 i think just to see how i get on? I'm not sure really what else to do with them as all was apparently well & now they getting pooey! Nice one - will get doing that - at the end of the day if they do produce info then we can just cont to keep up reduce payments until they get pooey & if they can't then we will take it as it comes - At they end of the day we take responsibility for the fact we are in debt regardless of what caused the change in our circumstances but we don't expect to be hounded & stressed to the point of breakdowns (NOT gd thing for your young kids to see) Harumph!! At the risk of sounding like a total naive plonker - between myself & hubby we have a fair few DCA that we have been dealing with - ie, fredrickson, ndr, cabot (me & him), Mercers, Lowell etc - the usual suspects from what i can gather! Up til now we have been struggling on with the 6 monthly updated fin s/ments & pro-rata offers etc thinking we were doing the right thing etc but now this has made me (quite belatedly) wonder if i should be sending that letter & £1 to all the dca's that have 'apparently' bought our debts? Even if until now they HAVE frozen interest etc as agreed - i can't help feeling they are all 'on the turn' so to speak like cabot have just done. Do u agree please? (i promise i'll catch on quick enuff (eventually) Hmmm - ave just realised i sub-conciously added a LOTTA etc etc etc in last post - doh! soz...

Evening all, Am not trying to gatecrash ur thread (i have one of me own just started re Cabot - aarghhh) but was flicking thru & urs grabbed my attn & thought maybe some of the advice might be able to apply to my situ? Basically has Littlewoods cat which subsequently dealt with by NDR, was working fine with them accepting reduced payments (pro-rata) & no fees added until approx 5 months ago when they started adding the now famous £12 so out of my £13 i was paying, obviously was not making any diff. I wrote & requested they stopped adding the fee which was shown on my statement as an admin charge, pointing out that i had adhered to the repayment plan they had agreed, but they haven't of course. Now i have had constant calls the last 2 wks which i refuse to answer (peed em off i think) & yest received a 'new look' statement with a 'default sum notice' stating that the £12 was a 'default sum' & would be added each month that i didn't pay the contractual minimum amount required. Hmmmm. Sorry again to trespassing ur thread, but advice if at all poss, gratefully rec please. many many thanks. x
