Hi Rory, Hope you well! Anyways, Thanks for your post. Am wondering whether should put complaint in but not sure really whether it should be to Cabot for trying to enforce acc or Cap one for selling it on (presumably the latter, as to be honest Cabot haven't got too shirty YET and from what i can tell cap one were in the wrong first of all by passing it on. Also have gone back through paperwork from them & Have got letter from Cap One stating Thanks for request for copy of true executed agreement etc etc under ccact etc, whereas Cabot have stated that i apparently only asked them for copies of t&c's etc. So its obvious (& on paper) that they twisting it to play silly bu*gers etc. Can i ask what you think/would do please? Good afternoon everyone, Received another letter from cabot (has been a cabot day lol) stating; "Repaying your acc: The cabot group has recently bought the acc you held with Barclaycard littlewoods and we've tried to contact you previously. It's now vital that you contact us urgently to discuss your acc. Choice of payments..blah blah...If we don't hear fom you - If you don't contact us to agree a suitable replayment plan we'll have to move your acc to the next stage of our collections process. Contact cabot...blah blah. Signed Peter Anderson." I haven't yet sent anything in response to the duff paperwork i received (above & other thread - Soz, not sure how to merge 'em), as wasn't 100% sure which template to send & have been unwell the last few days so not had head on straight (Shouldn't be an excuse i know) and now they have sent me this telling me they have bought the acc that they already bought Oct 07, apparently & which is presumably now in dispute considering they have not actually sent through the proper paperwork in response to cca yet. Any advice please as to which response i should give or whether to ignore them a while until they start chasing for payment again? Many thanks as always, Mpolsx

Good afternoon peeps, Had letter from Cabot in response to acc in dis whilst passed on. Reads : "Cap one has confirmed that there is no dispute or complaint on the acc. You requested a copy of the terms and conds and copies of statements from them and these were sent to you in nov '08. As a result this acc will not be returned to cap one. We trust this clarifies the matter. If you have any queries, please call....." Ok, Firstly i requested copy of agreement & the other paperwork due under the cca, not simply T & C's. When cap one replied they only encl current (blank) copy of T & c's for me. Then i sent Cabot the above acc in dis letter to get this reponse - Any ideas for the next step please? Should i ignore them until they decided to request payments etc or should i send them something else to argue the point or, even, should i send something else to Cap one. Thought about sending cap one note to say am going to complain now re' them passing on acc whilst in dis? hmmm. Many thanks as always, Mpols x

WOO HOOO!! Thankyou for clarifying SH- Have been bit concerned the last couple days i think more due to my lack of confidence in calling it right or wrong - Doh! So do i ignore them completely now or send them the template i have seen (somewhere) which starts "i am glad you have sent me this & claim it is my agreement etc etc" (something like that i think). Hi Fox, What a pain in the ar*e they are being for you - I think Hillards has got a fair point tho' in as much as you could surely claim for the defamation side of things (vaguely remember something about it & tort etc from gcse law ha ha) - also, would u be entitled to financial help with taking em to court maybe like a legal aid kinda thing (if thats still about or applies?). Make sure you post up any drafts you do before sending hunny. Gd luck! Have started new thread for the cabot paperwork i got & had dome1 say the same as me & you did so am just waiting really for a few more comments hopefully agreeing the same then will see what is the best template to use to respond to the them - although i could poss just ignore them if it IS unenforceable, until they start to chase me again. Thanks for your comment - thats kinda what i thought too - Has got things like "we cananot process your application without this info" and "application ref" etc printed on it by is soooo small & really quite bad copy that i think it is prob intentionally that bad so that they hope i can't determine which it is, the agreement or an application! Have just been reading through a few more threads & very handy sticky and have come to conclusion that this is not enforceable as it appears to defo be an application form not an actual agreement. It doesn't seem to include on the sheet that i signed and of the prescribed terms regarding running credit. Would be extremely grateful if any1 else with more savvy could offer their opinion pls & also as to what to do next. Is Duffers comment above the best option? Many thanks as always, Mpols x
