Hi there, What a truly awful situation to be in Yes send the CCA request and dont sign the letter instead print the name on the bottom of the letter and dont forget to include the one pound postal order and send it recorcded delivery at a minimum you can use the CCA request at any time to request this info as its a statutory request so dont worry about the fact that you have been paying the debt i would also consider speaking to your local trading standards too Trading Standards Central - Trading Standards and Consumer Protection information for the UK use the post code search to find your local trading standards as i

Hi Rilly, As Goldlady mentioned, CL Finance have a bad reputation for filing claims extremely quickly, if they did not send you a letter before action giving you a set period to comply (normally 14 days) then they have not complied with the Pre Action Protocols of the Civil Procedure Rules. Hi Rilly and welcome to CAG, I know it can be very worrying when one receives notice of a claim being filed against them, but you've come to the right place! the majority of cases such as these are instigated by the banks / credit card companies in the hope that the defendant will 'bury their head in the sand' and not bother defending, or indeed counterclaiming, that way they can easily get summary judgement. Okay, firstly can you post up details of the Particulars Of Claim, i'm guessing their incredibly vague and very non specific. Secondly, you mentioned you sent a SAR to the creditor, did you also send a CCA Request?

As Rory has stated, RED should not be pestering you whilst an ongoing dispute and investigation is underway, it's against OFT guidelines on debt collection; http://www.oft.gov.uk/shared_oft/business_leaflets/consumer_credit/oft664.pdf They can't send bailiffs without a CCJ and subsequent Court Order following non-payment of the CCJ.
