    • Hello, After seeing all of the posts about BMW on here I really wish I hadn't even considered them! I bought a used car from them over the weekend, one specifically which had a reversing camera and cruise control in the advert. I was foolish at the time of purchase and didn't check to see these functions work on the test drive (totally my fault). Now that the car is home I've checked and checked and neither of these functions are available. I even checked on Parkers and it seems that no Skoda Kamiq '21 models come with any parking cameras at all. When buying the car, I was told all that was needed was 'Four signatures and £500' to secure it. I was never shown any of the documents, and instead the sales rep opened a box on his iPad and asked me to sign. He had been complaining about the length of time some customers take these days all throughout my time with him. (Again) foolishly I signed. In my email inbox I now have four attachments from BMW, one of which is my signature under a letter which says that the cars don't need to match the advertisements online, or have any of the features that a sales rep talks about. I realise that I've made mistakes in not doing my due diligence here, but thought I might as well ask the experts here if I have any rights left to claim that the car was miss-advertised, or if I unknowingly signed them away?       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

WEll done Penfoldthat I think is a good thing.... he wants you to have your day in court that HSBC thought they woud deny you....... we have plenty time to prepare your arguements....:):) well done........... i have some case numbers for you and there are other bank numbers as well.............

Penfold might be worth changing it to your worship. as that si what county court judges are called you honor in the high court.......... the part about the luton thing. here is part of the clip

 

Judge Abrahams, at Luton County Court, has ordered Barclays to stop applying the charges until a High Court test case settles the legal issues involved.

 

also if you can find some where to fit in that the bank's collectively have settled 94 cases since the oft announcemnt on the 27th July when they went to the high court.......this is the ones we know about........ there coudl be more that we dont.....

but again all this info just adds more weight and also shows just the extent to which they will go to manipulate the system...........:):):)

Nope a they only needed to submit defence then went straight to stay by the judge.............. ok

 

Point taken about worship and will alter on real thing........... just thought as you had made sucha good job of it.......

 

Glad you spoted the 94 thingie, so they are settled cases, but we just do not have the case numbers right?. no we do not............ it was on someone elses post i saw it........... but the numbers you have are from the hsbc on and I have collected them form those concerned. when I have seen a judgement awarded. I have aske dfor the number and kept a list......

 

Can't put the charges bit in as no account with them, but did sort of include it...ah right ok...........

my view is it is VITAL the JUDGE gets to see it first, DG well, last minute fax to them woudl be appropriate...... again only my view but thisis a costly excersise for them, it also takes outthe intimidations factor.....of having a Barrister come up and introduce themselves adn puff out thier chest with you are going to lose......

 

agian only my view but this judge has doen oyu a favour (i think) my gut feeling is they will nto set it up, make you an offer before it and ask you to cancel the hearing, like they are doing with others.......

but I could be wrong.........:D

IMHO the judge is just stalling, he is making it look like he is allowing your case to move forward!!!! he knows you will nto be alloted a slot before the test case starts........... and that very possibly by the time your hearing/telephone conference is reallocated this whole sorry business wil have gone away and he will have his court back:):)

 

as I have said several times in the past few months I really dont see it gettting into court.........an 11th hour deal will be struck...... but then again I could be wrong.....

 

any prabs, I know how frustrating and extremly unfair it is, as far as this topic goes, there is only one winner the banks, the courts own cpr do not apply in these cases but big business does............:):):p

IMHO firstly you are not 100% clear in your wording, have the put clearly in writing they hold statements going back till the account was opened?

 

If they have then I coudl be asking for copies of them now , as they shoudl be covered under the S.A.R....... but some of the others will correctme if I am wrong.........

 

if they are and they have not supplied them, then you have them for failure to comply !!

 

my next move before I did anything was get the copies, there is a very real chance that the bank could and would claim they had made an error and did not in actual fact have them!!! and then you are snookered......

 

the only other thing I can see is that the other banks may very well claim, that is not our procedure, proving they all operate the same might be very difficult.....

 

if it was me I would be pushing for copies of the statements refered to and going after them under the SAR rules if they have not fully complied.........

I am slightly confused............lol. no surprise there then........ if you are not after the charges, erm why the interest in the statements?

 

Yes this maybe of interest but again the banks could claim that each individual bank operates a different policy.........
